5766ORDINANCE NO. 5766 AN ORDINANCE OF THE CITY OF ANAHEIM AMENDING VARIOUS SECTIONS OF TITLE 4 AND TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO FREEWAY -ORIENTED SIGNS. WHEREAS, Planning staff has made a comprehensive study of freeway -oriented freestanding signs to identify the visual impacts of existing signs, particularly in view of recent and ongoing freeway improvements, and to review existing sign development standards for functionality in anticipation of potential requests for freeway -oriented signs; and WHEREAS, the study consists of photographic inventory of existing signs, a survey of sign requirements in ten Orange County cities traversed by freeways and meetings with representatives of the Chamber of Commerce to receive insight from the business community; and WHEREAS, existing provisions of the Anaheim Municipal Code currently authorize freestanding freeway -oriented signs by conditional use permit for eligible land uses that serve the immediate needs of the highway motorist; and WHEREAS, the City of Anaheim has approximately 28 miles of freeway, which is more than any other city in Orange County; and WHEREAS, in enacting this ordinance, the City Council affirms and restates the purpose of sign regulations in Section 18.05.010, "to preserve locally recognized values of community appearance; to safeguard and enhance property values in residential, commercial and industrial areas; to protect public investment in and the character of public thoroughfares; to aid in the attraction of tourists and other visitors who are important to the economy of the City; to reduce hazards to motorists and pedestrians traveling on the public way; and thereby to promote the public health, safety and welfare;" and WHEREAS, it is the further intent and purpose of this ordinance to promote public health, safety and welfare by improving aesthetic qualities, reducing visual blight and clutter and discouraging a proliferation of signs; and WHEREAS, this ordinance provides smaller and lower freeway - oriented signs and discourages duplicate signage from a proliferation of signs along freeway corridors, consistent with regulations in surrounding communities; and WHEREAS, pursuant to the provisions of the California Environmental Quality Act ("CEQA"), the City Council has determined that the project is categorically exempt from CEQA under CEQA Guidelines Section 15061(b)(3), which provides that ORDINANCE NO. 5766 AN ORDINANCE OF THE CITY OF ANAH NDINO VAR SECTIONS OF TITLE 4 AND OP TWE MUNICIPAL CODE RELATING t�iEEWAY- SIGNS. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM HEREBY ORDAINS AS FOLLOWS: SECTION 1. That Section 4.08.020 of Chapter 4.08 of Title 4 of the Anaheim Municipal Code be, and the same is hereby, amended to modify the introductory language thereto to read as follows: "4.08.020 ADVERTISING SIGNS ALONG FREEWAYS — RESTRICTED. No advertising structure, accessory sign, post sign or other advertising sign shall be erected, constructed, located or maintained regardless of the district or zone in which it is located except as provided in Section 18.05.095 Standards for Freeway -Oriented Signs: .010 If such structure is designed to have or has the advertising thereon maintained primarily to be viewed from a main traveled roadway of a freeway; or .020 If such structure or sign because of its location, size, nature or type, constitutes, or tends to constitute, a hazard to the safe and efficient operation of vehicles upon a freeway, or create a condition which endangers the safety of persons or property thereon." SECTION 2. That subsections .010 and .020 of Section 4.08.050 of Chapter 4.08 of Title 4 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows: "4.08.050 PROCEDURE FOR ISSUANCE OF PERMITS. No permit shall he issued to erect, construct or relocate any outdoor advertising structure, sign or display unless the Planning Director or his or her designee shall have first determined as follows: .010 That such structure or sign is not designed to have the advertising thereon maintained primarily to be viewed from a main traveled freeway, except as provided in Section 18.05.095 - STANDARDS FOR FREEWAY -ORIENTED SIGNS; and 2 .020 That the proposed structure, sign or display will be so constructed that it would not constitute a hazard to the public. The Planning Director or his or her designee shall thereupon make known his findings to the applicant. In the event that the application is denied for the reasons set forth in this chapter, the applicant may take an appeal of the denial to the City Council by filing, within ten days of the receipt of notice of said denial, a written notice of appeal with the City Clerk. Thereafter the matter shall be considered by the City Council within forty-five (45) days following receipt of the notice of appeal by the City Clerk. The applicant, by written request, may waive the time limits set forth in this Section except the time within which the appeal must be filed. If the Council shall determine that the proposed structure or sign is designed to have the advertising thereon so maintained to be primarily viewed from the main traveled roadway of a freeway, except as provided in Section 18.05.095, or that the structure or sign, because of its location, size, nature or type would constitute, or tend to constitute, a hazard to the safe and efficient operation of vehicles upon the freeway, or would create a condition endangering the safety of persons or property, said Council shall deny said application, otherwise said application shall be granted." SECTION 3. That subsection .053 of Section 18.05.030 of Chapter 18.05 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows: • ".053 `Freeway -Oriented Sign': A freestanding business or guide sign, not including `Billboards' as defined in Section 18.05.020.010, located on property abutting a freeway right-of-way or freeway frontage road and whose height, location and sign copy is designed in a manner which permits identification from an adjacent freeway." SECTION 4. That new subsection .054 be, and the same is hereby, added to Section 18.05.030 of Title 18 of the Anaheim Municipal Code to read as follows: ".054 `Freeway -Oriented Wall Signs'. A wall sign (not including any sign erected, maintained or used for the purpose of off-site advertisement, unless said sign is otherwise authorized herein) located on any structure on property abutting a freeway right-of-way or freeway frontage 3 road and whose sign copy is designed in a manner which permits identification from an adjacent freeway." SECTION S. That subsection .010 of Section 18.05.076 of Chapter 18.05 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows: ".010 All freestanding and monument -type signs permitted herein shall be developed in accordance with the Planning Department standards approved by Resolution of the Planning Commission or City Council entitled `Monument Sign Detail (Planning Standard No. 1),' `Freestanding Sign Detail (Planning Standard No. 2),' `Freeway -Oriented Sign Detail (Planning Standard No. 3, Revision No. 1),' or `Freestanding Shopping Center Identification Sign Detail (Planning Standard No. 4)' (collectively, the `Standards')." SECTION 6. That Section 18.05.095 of Chapter 18.05 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows: "18.05.095 STANDARDS FOR FREEWAY -ORIENTED SIGNS. Freeway -Oriented Signs, as defined in subsection 18.05.030.053 of this chapter, may be permitted subject to the approval of a conditional use permit, only for service stations, restaurants, lodging facilities, regional shopping centers as defined in Section 18.05.020.032 of this chapter, or automobile dealership(s) occupying a site no less than ten (10) acres in size, provided no Freeway -Oriented Wall Sign as defined in Section 18.05.030.054 exists on the property to identify the same use identified on the Freeway -Oriented Sign. .010 Maximum Number of Signs Permitted. Not more than one (1) single- or multi -faced freeway -oriented sign designating the principal use of the premises shall be permitted on any lot or parcel of property. .020 Maximum Area of Signs. The area of each face of a single or double-faced freeway -oriented sign shall not exceed the lesser of one hundred twenty five (125) square feet or 0.5 square foot for each linear foot of freeway frontage of the parcel of real property on which the sign is located. .0201 Combining of Freeway and Street Frontages for Greater Sign Area. The combination of street and 0 freeway frontages for the purpose of increasing the permitted sign area of a freeway -oriented sign shall not be permitted. .030 Permitted Location of Freeway -Oriented Signs. No freeway -oriented sign shall be located closer to any property line of an abutting parcel of property (other than a street) than a distance equal to the lesser of thirty-three percent (33%) of the width of the parcel on which said sign is to be located in relation to said abutting parcel of property or one hundred twenty (120) feet. No portion of any sign, including its supporting structure, shall be located on or within any portion of a street, sidewalk or other public right of way. .040 Minimum Distance Between Freestanding Signs. When a freeway -oriented sign is permitted on a parcel, no such sign shall be located closer than three hundred (300) feet from any other freestanding, monument or legal, non -conforming roof sign on the same parcel of real property. .050 Maximum Height of Freeway -Oriented Signs. The maximum permitted height of any Freeway -Oriented Sign shall be determined through the conditional use permit process, but in no instance shall the height of such sign exceed thirty (30) feet as measured from the average finished grade of the property upon which it is located. The applicant shall submit the following information, which shall be considered by the Planning Commission and/or City Council in determining the height of the sign: .0501 line -of -sight drawings illustrating the minimum height necessary to afford freeway visibility from the direction of the freeway lanes closest to the property; .0502 photographed balloon tests or computerized simulations including existing signage in the area to adequately describe the proposed sign in the context of its specific location and to permit easier visualization of the proposal; .0503 illustrations depicting compatibility and scale of sign design with building architecture and existing signs on the property; .0504 plans which identify distances to freeway off -ramps and demonstrate access to the property from the freeway offramp; and 5 .0505 renderings depicting illumination at night. .060 Maximum Sign Width. All freeway -oriented signs permitted within this section which are less than one hundred fifty (150) square feet in area shall be limited to 15 feet in width. All freeway -oriented signs one hundred fifty (150) square feet or greater in area shall be limited to twenty (20) feet in width. .065 Required Landscaping. All Freeway -Oriented Signs permitted within this section shall be located within a landscaped planter, the area of which is at least one-half the total sign area of the sign located within the planter. Landscaping shall include shrubs planted at the base of the sign supports to visually screen the sign supports within three (3) years of the time of planting. .070 Maximum Height Limit Within 750 Feet of Any Residential Structure. The maximum height of any portion of any freeway -oriented sign or sign structure located within three hundred (300) feet of any structure used exclusively or primarily for residential purposes shall be twenty-five (25) feet. The height of any such sign or sign structure may be increased by one foot for each ten feet of distance over three hundred (300) feet that exists between such sign or sign structure and the nearest structure used exclusively or primarily for residential purposes; provided, however, that the height of such sign or sign structure shall not exceed the maximum height limit specified in this section. .080 Freeway -Oriented Wall Signs. One Freeway - Oriented Wall Sign, as defined in Section 18.05.030.054, subject to the requirements of Section 18.05.030.140, shall be permitted provided no Freeway -Oriented Sign as defined in Section 18.05.030.053 exists on the property to identify the same use identified on the Freeway -Oriented Wall Sign and further provided the total area of any such sign shall not exceed 100 of the area of the face of the building to which said sign is attached or 250 square feet, whichever is greater." SECTION 7. EXEMPTIONS Nothing contained in this ordinance shall apply to any Freeway -Oriented Sign or Freeway -Oriented Wall Sign which lawfully existed within the City of Anaheim at the time this ordinance became effective; provided, however, that any structural change or alteration of any such sign shall be subject to the approval of the Planning Commission and/or City Council through a variance proceeding as set forth in Sections 18.03.040 and 18.05.051 of this Code. III Nothing contained in this ordinance shall prevent the City from approving applicable building permits to construct any Freeway -Oriented Sign for which a valid entitlement was granted prior to the effective date of this ordinance and provided said entitlement has not expired. SECTION 8. SEVERABILITY The City Council of the City of Anaheim hereby declares that should any section, paragraph, sentence or word of this ordinance of the Code, hereby adopted, be declared for any reason to be invalid, it is the intent of this Council that it would have passed all other portions of this ordinance independent of the elimination herefrom of any such portion as may be declared invalid. SECTION 9. SAVINGS CLAUSE Neither the adoption of this ordinance nor the repeal of any other ordinance of this City shall in any manner affect the prosecution for violations of ordinances, which violations were committed prior to the effective date thereof, nor be construed as a waiver of any license or penalty or the penal provisions applicable to any violations thereof. The provisions of this ordinance, insofar as they are substantially the same as ordinance provisions previously adopted by the City relating to the same subject matter, shall be construed as restatements and continuations, and not as new enactments. SECTION 10. PENALTY It shall be unlawful for any person, firm or corporation to violate any provision or to fail to comply with any requirements of this ordinance. Any person, firm or corporation violating any provision of this ordinance or failing to comply with any of its requirements shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punished by a fine not exceeding One Thousand Dollars ($1,000.00) or by imprisonment not exceeding six (6) months, or by both such fine and imprisonment.
