1566Planning Dept ORDINANCE NO. 1566 AN ORDINANCE OF THE CITY OF ANAHEIM AMENDING TITLE 1, CHAPTER 1.04 OF THE ANAHEIM MUNICIPAL CODE BY AMENDING SECTIONS 1.04.350, 1.04.360 AND 1.04.370 THEREOF, AND BY ADDING THERETO SECTION 1.04.361. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. That Title 1, Chapter 1.04 of the Anaheim Municipal Code be and the same are hereby amended by amending Sections 1.04.350 1.04.360 and 1.04.370 thereof, and by adding thereto Section ..04.361, said amended sections and new section to read as follows: "TITLE 1 ADMINISTRATION "CHAPTER 1.04 OFFICES AND DEPARTMENTS "SECTION 1.04.350 PLANNING COMMISSION CREATED. That there be and is hereby created a Planning Commission for the City of Anaheim, which Planning Commission shall consist of nine (9) members appointed by the City Council of the City of Anaheim. "SECTION 1.04.360 PLANNING COMMISSION -- MEMBERSHIP. Members of the Commission ma be persons who hold an office or position with the City, who shall be designated ex -officio members, provided, however, that the ex - officio members shall not exceed three (3) in number. Ex -officio members shall be entitled to vote upon all matters coming before the Planning Commission. "SECTION 1.04.361 PLANNING COMMISSION -- ADVISORY MEMBERS. By resolution of the City Council, advisory members, who shall be city officers or employees, or members of the City Council, may be appointed to the Planning Commission. The advisory members shall have no vote. "SECTION 1.04.370 PLANNING COMMISSION -- POWERS AND DUTIES -- OFFICERS -- MEETINGS -- FUNDS. (a) That said Planning Commission shall have the powers and perform the duties as provided in Title 7, Chapters 3 and 4 of the Government Code of the State of California. -1- (b) The Planning Commission shall elect its chairman from among the appointed members for a term of one year at the first regular meeting in March of each year, and subject to the other"provisions of the law, may create and fAl such other offices as it may determine. (c) The Planning Commission shall hold at least one regular meeting each month and such addi- tional meetings as it deems advisable and shall keep a record of its resolutions transactions, findings and determinations, which record shall be a public record. Five (5) members of the Planning Commission shall constitute a quorum for the transaction of business, provided, however, that the adop- tion, amendment, extension or addition to a master or general plan, or the recommendation of, or any amendment to, any precise plan or regulation, shall be by resolution of the Commission carried by the affirmative vote of not less than a majority of its total vot- ing members. (d) The City Council shall provide the funds, equipment and accommodations necessary for the work of the Planning Commission. Such funds may be levied and collected, but shall not exceed in any fiscal year the sum of two (2) mills of a dollar of assessed valuation. (e) Any appointed member of the Planning Commission may be removed by a majority vote of the City Council. (f) It is expected that appointed members to the Planning Commission should be able to attend all regular meetings each month and non- attendance at three (3) consecutive regular meetings would subject the member to replace- ment, subject to the approval of the City Council. (g) The members of the Planning Commission, other than ex -officio and advisory members, shall be appointed for a period aE four (4) years, the terms of two members expiring each year. The term of an ex -officio and advisory member shall correspond to his official tenure. If a vacancy shall occur otherwise than by the expiration of term, it shall be filled by appointment for the unexpired portion of the term.' SECTION 2. The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be printed once within fifteen (15) days after its adoption, in the Anaheim Bulletin, -2- a newspaper of general circulation, printed, published and circulated in said City, and thirty (30) days from and after its final passage it shall take effect and be in full force.
