6313ORDINANCE NO. 6313 AN ORDINANCE OF THE CITY OF ANAHEIM REPEALING CHAPTER 1.25 OF THE ANAHEIM MUNICIPAL CODE RELATING TO THE ESTABLISHMENT AND IMPLEMENTATION OF RESIDENCY DISTRICTS FOR CITY COUNCIL MEMBERS WHEREAS, on July 23, 2013, the City Council of the City of Anaheim adopted Ordinance No. 6280, which added Chapter 1.25 to the Anaheim Municipal Code, sections 1.25.010 through 1.25.050, inclusive, to establish residency districts and require that City Council Members (other than the Mayor) be from residency districts and elected at large; and WHEREAS, on February 18, 2014, the City Council adopted Ordinance No. 6294 amending and restating Chapter 1.25 of the Anaheim Municipal Code to alter the timeline for implementation of the provisions of Ordinance No. 6280; and WHEREAS, on November 4, 2014, the voters of the City of Anaheim approved Measure L. Measure L amends the City Charter to change the method of electing Anaheim City Council Members (other than the Mayor) from an at -large electoral system to a by -district electoral system; and WHEREAS, the passage of Measure L obviates Chapter 1.25 and, pursuant to a settlement reached in the case of Moreno, et al., v. City of Anaheim, Orange County Superior Court Case No. 30-2012-00579998-CU-CR-CXC, necessitates the repeal of that Chapter; and WHEREAS, by this ordinance, the City Council desires to repeal Chapter 1.25 of the Anaheim Municipal Code. THE CITY COUNCIL OF THE CITY OF ANAHEIM HEREBY ORDAINS AS FOLLOWS: SECTION 1. REPEAL OF MUNICIPAL CODE CHAPTER 1.25 That Chapter 1.25 of the Anaheim Municipal Code be, and the same hereby is, repealed in its entirety. SECTION 2. CERTIFICATION; EFFECTIVE DATE OF ORDINANCE The City Clerk shall certify to the passage of this ordinance and shall cause the same to be printed once within fifteen (15) days after its adoption in the Anaheim Bulletin, a newspaper of general circulation, published and circulated in the City of Anaheim, and thirty (30) days from and after its final passage, it shall take effect and be in full force. SECTION 3. SEVERABILITY The City Council of the City of Anaheim hereby declares that should any section, paragraph, sentence or word of this ordinance of the Code, hereby adopted, be declared for any reason to be invalid, it is the intent of the Council that it would have passed all other portions of this ordinance independent of the elimination herefrom of any such portion as may be declared invalid.
