ORDINANCE NO. 5397 <br />AN ORDINANCE OF THE CITY OF ANAHEIM ADDING <br />SUBSECTION .080 TO SECTION 1. 04.730 OF CHAPTER 1.04 <br />OF TITLE 1 OF THE ANAHEIM MUNICIPAL CODE <br />ESTABLISHING A PUBLIC UTILITIES HEARING BOARD. <br />THE CITY COUNCIL OF THE CITY OF ANAHEIM HEREBY ORDAINS <br />AS FOLLOWS: <br />SECTION 1. <br />That new Subsection .080 be and is hereby added to Section 1.04.730 of Chapter <br />1.04 of Title 1 of the Anaheim Municipal Code to read as follows: <br />".080 Establish a Public Utilities Hearing Board composed of <br />three current members of the Public Utilities Board. Such <br />members shall be appointed by the Chairman of the Public Utilities <br />Board and shall serve at the pleasure of the Chairman. The <br />Chairman may also appoint one or more alternates to serve as <br />needed. Alternates shall also be current members of the Public <br />Utilities Board. The Public Utilities Hearing Board shall render <br />final decisions on disputed bills for utility services and shall hear <br />other such matters as may be referred by the Public Utilities <br />Board. The Public Utilities Hearing Board shall hold hearings as <br />may be necessary to render such decisions or hear referred <br />matters. <br />SECTION 2. SEVERABILITY <br />That the City Council of the City of Anaheim hereby declares that should any <br />section, paragraph, sentence or word of this ordinance of the Code, hereby adopted, be declared <br />for any reason to be invalid, it is the intent of the Council that it would have passed all other <br />portions of this ordinance independent of the elimination herefrom of any such portion as may <br />be declared invalid. <br />SECTION 3. SAVINGS CLAUSE <br />Neither the adoption of this ordinance nor the repeal of any other ordinance of <br />the City shall in any manner affect the prosecution for violation of ordinances, which violations <br />were committed prior to the effective date hereof, nor be construed as a waiver of any license <br />or penalty or the penal provisions applicable to any violation thereof. <br />
