5345FOLLOWS: i ORDINANCE NO. 5345 AN ORDINANCE OF THE CITY OF ANAHEIM REPEALING CHAPTER 4.60 OF TITLE 4 OF THE ANAHEIM MUNICIPAL CODE AND ADDING NEW CHAPTER 4.60 OF TITLE 4 PERTAINING TO PRIVATE PATROLS THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS SECTION 1. That Chapter 4.60 of Title 4 of the Anaheim Municipal Code be, and the same is hereby repealed. SECTION 2. 4 That new Chapter 4.60 of Title 4 be, and the same is hereby, added to the Anaheim Municipal Code, to read as follows: "4.60 PRIVATE PATROLS 4.60.010 DEFINITIONS .010 Person As used in this Chapter, "person" includes any individual, firm, company, association, organization, partnership, and corporation. .020 Licensee As used in this Chapter, "licensee" -'� means a person licensed under the California Private Investigator Act (California Business and Professions Code Section 7512 et seq.) and includes, but is not limited to, private investigator, private patrol operator, protection dog operator, and armored contract carrier (referred to collectively in this Chapter as "security services"). .030 Employee As used in this Chapter, "employee" means an individual who works for an employer, is listed on the employer's payroll records, and is under the employer's direction and control. W 4.60.020 LICENSEE UNIFORMS & VEHICLES For purposes of this section, uniforms shall be deemed to be clearly distinguishable if the (1) color thereof is different from uniforms of the Anaheim Police Department; or (2) either the color of the trousers or the color of the shirt is different from uniform trousers and shirts used by the Anaheim Police Department. For purposes of this section, vehicles shall be deemed to be clearly distinguishable if such vehicles are different in color or do not contain logos, insignia or other markings which are approximately the same size, shape, and color of those used on vehicles by the Anaheim Police Department. For purposes of this section, the term 'different' as used herein shall mean readily distinguishable by a person of normal visual acuity. 4.60.030 REGISTRATION REQUIRED All licensees and employees thereof performing services within the City of Anaheim shall register with the City of Anaheim by providing the following information to the Anaheim Police Chief or designee: (1) Name of person operating as a licensee including management and ownership information; (2) Employees names; (3) File copies of state identification cards, licenses, and/or certificates." SECTION 3. SEVERABILITY The City Council of the City of Anaheim hereby declares that should any section, paragraph, sentence or word of this ordinance of the Code, hereby adopted, be declared for any reason to be invalid, it is the intent of the Council that it would have passed all other portions of this ordinance independent of the elimination herefrom of any such portion as may be declared invalid. SECTION 4. SAVINGS CLAUSE Neither the adoption of this ordinance nor the repeal of any other ordinance of this City shall in any manner affect the prosecution for violations of ordinances, which violations were committed prior to the effective date hereof, nor be construed as a waiver of any license or penalty or the penal K provisions applicable to any violation thereof. The provisions of this ordinance, insofar as they are substantially the same as ordinance provisions previously adopted by the City relating to the same subject matter, shall be construed as restatements and continuations, and not as new enactments.
