5340ORDINANCE NO. 5340 AN ORDINANCE OF THE CITY OF ANAHEIM AMENDING SUBSECTIONS .012 AND .013 OF SECTION 18.06.050 OF CHAPTER 18.06 OF TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO PARKING REQUIREMENTS. THE CITY COUNCIL OF THE CITY OF ANAHEIM HEREBY ORDAINS AS FOLLOWS: SECTION 1. That Paragraph .0121 of Subsection 18.06.050.012 of Section 18.06.050 of Chapter 18.06 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows: 11.0121 For each unit there shall be provided not less than one and one quarter (1.25) off-street parking spaces for each bachelor unit, not less than two (2) parking spaces for each one -bedroom unit, not less than two and one quarter (2.25) for each two- bedroom unit, not less than three (3) parking spaces for each three-bedroom unit, and not less than three and one half (3.5) parking spaces for each four-bedroom or larger unit. At least two (2) parking spaces per unit shall be covered, except that only one (1) required space for each bachelor and one - bedroom unit need be covered. Of the number of required parking spaces, one-quarter (.25) space per dwelling unit shall be reserved and clearly marked for guest parking only and shall be readily accessible to motorists from contiguous streets and/or accessways. SECTION 2. That Paragraph .0123 of Subsection 18.06.050.012 of Section 18.06.050 of Chapter 18.06 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows: 11.0123 Tandem parking of not more than two (2) vehicles deep shall be permitted for required covered but not fully enclosed parking when the two (2) spaces are assigned to the same dwelling unit. Required open 1 ri spaces shall be permitted in tandem to covered spaces and shall be provided in a driveway having minimum dimensions of sixteen (16) feet wide and twenty (20) feet long. Notwithstanding the foregoing, not more than twenty-five percent (25%) of the required number of covered off-street parking spaces shall be permitted to be tandem parking spaces in multiple -family dwelling projects. The term "tandem parking space" as used in this section shall mean any off-street parking space designed in such a manner that a vehicle properly parked in such space may, by design, have its ingress to or egress from such parking space blocked by a vehicle properly parked in a contiguous parking space." SECTION 3. That Subsection 18.06.050.013 and Paragraph .0131 thereto of Section 18.06.050 of Chapter 18.06 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended to insert a subsection number and read as follows: 11.013 Retirement Dwelling: .0131 Senior citizens' apartment project: not less than one (1) parking space for each bachelor unit and one bedroom unit, and not less than two (2) parking spaces for each two bedroom unit. All parking spaces shall be located so as to minimize walking distance from the living area to the parking facility. Parking spaces may be covered or open and shall be unassigned and equally available to all residents, guests or employees. Tandem spaces shall not be permitted." SECTION 4. That Paragraph .0133 of Subsection 18.06.050.013 of Section 18.06.050 of Chapter 18.06 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows: 11.0133 Senior Citizen Housing Development: not less than one and one quarter (1.25) parking spaces for the initial bachelor or one bed -room unit plus one (1) space for each additional bedroom in the project. Parking E F1 spaces shall be covered or open and shall be unassigned and equally available to all residents, guests, and employees. Tandem spaces shall not be permitted. Parking spaces shall be located so as to minimize walking distance from the living area to the parking facility." SECTION 5. SEVERABILITY The City Council of the City of Anaheim hereby declares that should any section, paragraph, sentence or word of this ordinance of the Code, hereby adopted, be declared for any reason to be invalid, it is the intent of the Council that it would have passed all other portions of this ordinance independent of the elimination herefrom of any such portion as may be declared invalid. SECTION 6. SAVINGS CLAUSE Neither the adoption of this ordinance nor the repeal of any other ordinance of this City shall in any manner affect the prosecution for violations of ordinances, which violations were committed prior to the effective date hereof, nor be construed as a waiver of any license or penalty or the penal provisions applicable to any violation thereof. The provisions of this ordinance, insofar as they are substantially the same as ordinance provisions previously adopted by the City relating to the same subject matter, shall be construed as restatements and continuations, and not as new enactments. SECTION 7. PENALTY It shall be unlawful for any person, firm or corporation to violate any provision or to fail to comply with any of the requirements of this ordinance. Any person, firm or corporation violating any provision of this ordinance or failing to comply with any of its requirements shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punished by a fine not exceeding Five Hundred Dollars ($500.00) or by imprisonment not exceeding six (6) months, or by both such fine and imprisonment.
