AN ORDINANCE OF THE CITY OF ANAHEIM AMENDING
SUBSECTIONS 18.84.030.040, 18.84.030.053 AND
18.84.030.060 OF SECTION 18.84.030 OF CHAPTER
18.84 OF TITLE 18 OF THE ANAHEIM MUNICIPAL CODE
RELATING TO SPECIMEN TREE REMOVAL
THE CITY COUNCIL OF THE CITY OF ANAHEIM HEREBY ORDAINS
AS FOLLOWS:
SECTION 1.
That subsection 18.84.030.040 of Section 18.84.030 of
Chapter 18.84 of Title 18 of the Anaheim Municipal Code be, and the
same is hereby, amended to read as follows:
11.040 Application to Cut Down, Destroy or Remove Specimen
Trees. Application for authority to cut down, destroy or
remove Specimen Trees (other than those described in
subsection .030 above) shall be filed with the Planning
Department on forms provided for such purposes together
with a filing fee as established by resolution of the
City Council. The application shall show clearly by
diagram, plot plan or photograph, the location and
identity of the trees sought to be removed, the location
and identity of the replacement trees, the name and
address of the owner and such information as indicated on
the form provided. Applications shall be referred
directly to the Planning Commission for determination."
SECTION 2.
That subsection 18.84.030.053 of Section 18.84.030 of
Chapter 18.84 of Title 18 of the Anaheim Municipal Code be, and the
same is hereby, amended to read as follows:
11.053 That the character of the immediate
neighborhood in respect to forestation will not be
materially affected by the proposed removal;"
SECTION 3.
That subsection 18.84.030.060 of Section 18.84.030 of
Chapter 18.84 of Title 18 of the Anaheim Municipal Code be, and
the same is hereby, amended to read as follows:
11.060 Replacement of Trees. Any Specimen Trees
removed pursuant to a permit obtained hereunder shall be
replaced with the planting on the same parcel of a number
of trees twice that which were removed. Said replacement
trees shall be minimum fifteen (15) gallon in size, shall
be properly nurtured through maturity and shall be chosen
from the following specified list:

SECTION 3.
SEVERABILITY
The City Council of the City of Anaheim hereby declares
that should any section, paragraph, sentence or word of this
ordinance of the Code, hereby adopted, be declared for any reason
to be invalid, it is the intent of the Council that it would have
passed all other portions of this ordinance independent of the
elimination herefrom of any such portion as may be declared
invalid.
SECTION 4.
SAVINGS CLAUSE
Neither the adoption of this ordinance nor the repeal of
any other ordinance of this City shall in any manner affect the
prosecution for violations of ordinances, which violations were
committed prior to the effective date hereof, nor be construed as a
waiver of any license or penalty or the penal provisions applicable
to any violation thereof. The provisions of this ordinance,
insofar as they are substantially the same as ordinance provisions
previously adopted by the City relating to the same subject matter,

SECTION 3.

THE FOREGOING ORDINANCE is approved and adopted by the
City Council of the City of Anaheim this 28th day of July , 1992.
