5316U ORDINANCE NO. 5316 AN ORDINANCE OF THE CITY OF ANAHEIM DELETING SUBSECTION 17.08.039.040 OF SECTION 17.08.039 OF CHAPTER 17.08 AND ADDING NEW CHAPTER 17.10 TO TITLE 17 OF THE ANAHEIM MUNICIPAL CODE RELATING TO LOT LINE ADJUSTMENTS THE CITY COUNCIL OF THE CITY OF ANAHEIM HEREBY ORDAINS AS FOLLOWS: SECTION 1. That Section 17.08.039 of Chapter 17.08 of Title 17 of the Anaheim Municipal Code be, and the same is hereby, deleted in its entirety. SECTION 2. That new Chapter 17.10 be, and the same is hereby, added to Title 17 of the Anaheim Municipal Code to read as follows: "CHAPTER 17.10 LOT LINE ADJUSTMENTS 17.10.100 PURPOSE OF CHAPTER The purpose of this Chapter is to establish procedures for property owner(s) obtaining a lot line adjustment to make minor adjustments to the property lines between two or more adjacent parcels or to consolidate two or more adjacent parcels. No tentative map, parcel map, or final map shall be required as a condition to the approval of a lot line adjustment. 17.10.110 CRITERIA An owner or owners of two (2) or more existing adjacent parcels proposing to adjust the boundaries of said parcels so that the land taken from one parcel is added to an adjacent parcel and a greater number of parcels than originally existed is not thereby created may apply for a lot line adjustment. 17.10.120 APPLICATION AND REVIEW .010 Application for a lot line adjustment and review thereof shall conform to such requirements i as to form, content, and processing as may be specified by the City Engineer in documents on file in the Public Works - Engineering Department. .020 The application for a lot line adjustment shall be prepared by a person authorized to practice land surveying pursuant to Sections 8700 through 8806 of the State of California Business and Professions Code. Notwithstanding the foregoing, no record of survey shall be required for a lot line adjustment unless required by Section 8762 of the California Business and Professions Code. .030 The lot line adjustment shall conform with requirements set forth in Title 15 (Building) and Title 18 (Zoning) of the Anaheim Municipal Code and shall not interfere with or, when applicable, shall facilitate relocation of existing utilities, infrastructure, or easements. 17.10.130 DECISION OF CITY ENGINEER FINAL The City Engineer shall approve or deny the lot line adjustment. Any decision of the City Engineer made pursuant to this Chapter shall be final and conclusive. 17.10.140 RECORDATION After a lot line adjustment has been approved by the City Engineer, the lot line adjustment shall be reflected in a deed or deeds. The lot line adjustment and deed(s) shall be recorded in the Office of the Orange County Recorder. The lot line adjustment shall be recorded within one calendar year from the date of approval. A copy of the recorded lot line adjustment and deed(s) shall be submitted to the City Clerk." SECTION 3. SEVERABILITY The City Council of the City of Anaheim hereby declares that should any section, paragraph, sentence or word of this ordinance of the Code, hereby adopted, be declared for any reason to be invalid, it is the intent of the Council that it would have passed all other portions of this ordinance independent of the elimination herefrom of any such portion as may be declared invalid. - 2 - A SECTION 4. SAVINGS CLAUSE Neither the adoption of this ordinance nor the repeal of any other ordinance of this City shall in any manner affect the prosecution for violations of ordinances, which violations were committed prior to the effective date hereof, nor be construed as a waiver of any license or penalty or the penal provisions applicable to any violation thereof. The provisions of this ordinance, insofar as they are substantially the same as ordinance provisions previously adopted by the City relating to the same subject matter, shall be construed as restatements and continuations, and not as new enactments.
