ZONE) OF SECTION 18.20.040 (DEVELOPMENT
DISTRICTS) OF CHAPTER 18.20 OF TITLE 18 OF THE
ANAHEIM MUNICIPAL CODE, NUNC PRO TUNC, TO
CORRECT INADVERTENT AND CLERICAL DRAFTING
ERRORS IN ORDINANCE NO. 6309, PREVIOUSLY
ADOPTED.
WHEREAS, on November 18, 2014, the City Council of the City of Anaheim (the "City
Council ") adopted its Ordinance No. 6309, which had the effect of amending "Table 20 -D
(Development Intensities: Platinum Triangle Mixed Use (PTMU) Overlay Zone)" (herein
referred to as "Table 20 -D ") of Section 18.20.040 (Development Districts) of Chapter 18.20 of
Title 18 of the Anaheim Municipal Code to be consistent with General Plan Amendment No.
2014 - 00495. General Plan Amendment No. 2014 -00495 was adopted by the City Council on
October 21, 2014 to permit the increase in the number of dwelling units on that certain real
property consisting of approximately 4.13 acres commonly known as 1005 -1105 East Katella
Avenue in the City of Anaheim, County of Orange, State of California (the "Property") from 350
to 389 residential apartment units; and
WHEREAS, it has been discovered that inadvertent and clerical errors were made in the
drafting of Table 20 -D, as set forth in Ordinance No. 6309. Specifically, the maximum square
footage for commercial uses within the Katella District, as described in Table 20 -D, was shown
as 634,643 square feet when it should have been shown as 658,043 square feet, which means that
the total maximum square footage for commercial uses within the Platinum Triangle Overlay
Zone area was incorrectly stated. In addition, another clerical error was discovered in the
identification of the maximum number of housing units in Table 20 -D; that is, instead of 18,999
housing units, the maximum number of housing units within the Platinum Triangle Overlay Zone
depicted in Table 20 -D should have been stated as 19,027; and
WHEREAS, the City Council now desires and intends to amend Ordinance No. 6309,
nunc pro tune, that is, to correct said inadvertent and clerical drafting errors that, upon adoption
of this Ordinance, will have the same legal force and effect as if made at the time when they
should have been made, i.e., upon the adoption of Ordinance No. 6309 on November 18, 2014;
and
WHEREAS, the City Council has inherent authority to amend its ordinances under these
circumstances, which will have retroactive legal effect upon the adoption of this Ordinance.
THE CITY COUNCIL OF THE CITY OF ANAHEIM HEREBY ORDAINS AS
FOLLOWS:
SECTION 1
That Table 20 -D (DEVELOPMENT INTENSITIES: PLATINUM TRIANGLE
MIXED USE (PTMU) OVERLAY ZONE) of Section 18.20.040 (DEVELOPMENT
DISTRICTS) of Chapter 18.20 (PLATINUM TRIANGLE MIXED USE (PTMU) OVERLAY
ZONE) of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and
restated to read as follows:

SECTION 2
All references to "Table 20 -D (Development Intensities: Platinum Triangle Mixed Use
(PTMU) Overlay Zone)" of Section 18.20.040 (Development Districts) of Chapter 18.20
(Platinum Triangle Mixed Use (PTMU) Overlay Zone) of Title 18 of the Anaheim Municipal
Code shall be to the revised "Table 20 -D (Development Intensities: Platinum Triangle Mixed
Use (PTMU) Overlay Zone)" set forth in this Ordinance, nunc pro tunc; that is, having
retroactive legal effect as of November 18, 2014.
SECTION 3
Except as expressly amended herein, the provisions of Ordinance No. 6309 shall remain
in full force and effect.
SECTION 4 . SEVERABILITY.
The City Council of the City of Anaheim hereby declares that should any section,
subsection, paragraph, sentence, clause or word of this ordinance hereby adopted be declared for
any reason invalid by the final judgment of any court of competent jurisdiction, it is the intent of
the City Council that it would have adopted all other portions of this ordinance independent of
the elimination herefrom of any such portion as may be declared invalid.
SECTION 5 . SAVINGS CLAUSE.
Neither the adoption of this ordinance nor the repeal of any other ordinance of this City
shall in any manner affect the prosecution for violations of ordinances which violations were
committed prior to the effective date hereof, nor be construed as a waiver of any license or
penalty or the penal provisions applicable to any violation thereof. The provisions of this
ordinance, insofar as they are substantially the same as ordinance provisions previously adopted
by the City relating to the same subject matter, shall be construed as restatements and
continuations, and not as new enactments.
THE FOREGOING ORDINANCE was introduced at a regular meeting of the City
Council of the City of Anaheim held on the 17th day of March , 2015, and thereafter
passed and adopted at a regular meeting of said City Council held on the 7th day of
April , 2015, by the following roll call vote:
