AN ORDINANCE OF THE CITY OF ANAHEIM
ADDING SUBSECTION .120 TO SECTION
18.70.020 OF CHAPTER 18.70 OF TITLE
18 OF THE ANAHEIM MUNICIPAL CODE
RELATING TO ZONING (SP87-1)
WHEREAS, pursuant to the procedures set forth in
Chapter 18.93 of the Anaheim Municipal Code, the City Council of
the City of Anaheim has heretofore adopted its Resolution No.
87R-253 approving Specific Plan No. 87-1; and
WHEREAS, the City Council has heretofore adopted
Ordinance No. 4860 adding Chapter 18.70 to the Anaheim Municipal
Code establishing Zoning and Development Standards for the SP87-1
Zone; and
WHEREAS, the City Council has heretofore adopted its
Resolution No. 90R- 384 amending Resolution No. 87R-253 and
making certain findings in conjunction therewith pursuant to
Chapter 18.93 of the Anaheim Municipal Code; and
WHEREAS, the City Council desires to amend Section
18.70.020 of the Anaheim Municipal Code in the manner hereinafter
set forth.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM
DOES ORDAIN AS FOLLOWS:
SECTION 1.
That subsection .120 be, and the same is hereby, added
to Section 18.70.020 of Chapter 18.70 of Title 18 of the Anaheim
Municipal Code, to read as follows:
11.120 Public Park Site. Notwithstanding any other
provision of this Chapter to the contrary, Specific Plan No. 87-
1, including but not limited to all applicable Exhibits thereto,
is hereby amended to the extent and wherever required to provide
that the public park site identified in Section 4.2 of the
Specific Plan shall be a minimum 6 -acre "level" or "flat" site in
lieu of the 5 -acre site otherwise specified therein. The
location and configuration of said 6 -acre park site shall be as
generally described on Exhibit A of Resolution No. 90R- 384 . The
term "level" or "flat" as used herein shall continue to mean as
set forth in Section 4.2 of said Specific Plan."

SECTION 3. SEVERABILITY
The City Council of the City of Anaheim hereby declares
that should any section, paragraph, sentence or word of this
ordinance of the Code, hereby adopted, be declared for any reason
to be invalid, it is the intent of the Council that it would have
passed all other portions of this ordinance independent of the
elimination herefrom of any such portion as may be declared
invalid.
SECTION 4. SAVINGS CLAUSE
Neither the adoption of this ordinance nor the repeal
of any other ordinance of this City shall in any manner affect
the prosecution for violations of ordinances, which violations
were committed prior to the effective date hereof, nor be
construed as a waiver of any license or penalty or the penal
provisions applicable to any violation thereof. The provisions
of this ordinance, insofar as they are substantially the same as
ordinance provisions previously adopted by the City relating to
the same subject matter, shall be construed as restatements and
continuations, and not as new enactments.
THE FOREGOING ORDINANCE is approved and adopted by the
City Council of the City of Anaheim this day of , 1990.
