5131FOLLOWS: a ORDINANCE NO. 5131 AN ORDINANCE OF THE CITY OF ANAHEIM ADDING NEW SECTION 1.12.095 TO CHAPTER 1.12 OF TITLE 1 OF THE ANAHEIM MUNICIPAL CODE RELATING TO PROCE- DURAL MATTERS. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS SECTION 1. That new Section 1.12.095 be, and the same is hereby, added to Chapter 1.12 of Title 1 of the Anaheim Municipal Code to read as follows: "1.12.095 TIME LIMITS FOR PREPARATION OF ENVIRONMENTAL IMPACT REPORTS AND NEGATIVE DECLARATIONS. .010 Where an environmental impact report is required pursuant to the California Environmental Quality Act prior to the approval by the City of Anaheim of any lease, permit, license, certificate or other entitlement for use, such environmental impact report shall be completed and certified within one year from the date on which the application requesting such approval is received and accepted as complete by the City of Anaheim. .020 Where a negative declaration is required pursuant to the California Environmental Quality Act prior to the approval by the City of Anaheim of any lease, permit, license, certificate or other entitlement for use other than a tentative map or parcel map for the subdivision of property, such negative declaration shall be completed within 105 days from the date on which the application requesting such approval is received and accepted as complete by the City of Anaheim. .030 Where a negative declaration is required pursuant to the California Environmental Quality Act prior to the approval by the City of Anaheim of any tentative map or parcel map for the subdivision of property, such negative declaration shall be completed within 50 days from the date in which the application requesting such approval is received and accepted as complete by the City of Anaheim. .040 The time limits set forth in this Section shall apply only to those circumstances where the City of Anaheim is a lead agency with regard to such approval or project as defined in the California Environmental Quality Act. i .050 The time limits specified in this Section may be extended for additional reasonable periods of time upon consent of the project applicant to such extension or extensions. .060 Where any provision of this Code estab- lishes a time limit within which a public hearing must be set for any matter for which an environmental impact report or negative declaration is required, calculation of such time limit shall be deemed to commence upon the date of completion of such draft environmental impact report or negative declaration notwithstanding any other provision of this Code to the contrary." SECTION 2. SAVINGS CLAUSE Neither the adoption of this ordinance nor the repeal hereby of any other ordinance of this City shall in any manner affect the prosecution for violations of ordinances, which viola- tions were committed prior to the effective date hereof, nor be construed as a waiver of any license or penalty or the penal pro- visions applicable to any violation thereof. The provisions of this ordinance, insofar as they are substantially the same as or- dinance provisions previously adopted by the City relating to the same subject matter, shall be construed as restatements and con- tinuations, and not as new enactments. SECTION 3. SEVERABILITY The City Council of the City of Anaheim hereby declares that should any section, paragraph, sentence or word of this ordinance, hereby adopted, be declared for any reason to be invalid, it is the intent of the Council that it would have passed all other portions of this ordinance independent of the elim- ination herefrom of any such portion as may be declared invalid. SECTION 4. CERTIFICATION The City Clerk shall certify to the passage of this or- dinance and shall cause the same to be printed once within fifteen (15) days after its adoption in the Anaheim Bulletin, a newspaper of general circulation, printed, published and circulated in said City, and thirty (30) days from and after its final passage, it shall take effect and be in full force.
