5851ORDINANCE NO. 5851 AN ORDINANCE OF THE CITY OF ANAHEIM ADDING NEW SECTION 1.04.395 TO CHAPTER 1.04 OF TITLE 1 OF THE ANAHEIM MUNICIPAL CODE RELATING TO LIMITATIONS ON BOARD AND COMMISSION SERVICE THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. That new Section 1.04.395 be, and the same is hereby, added to Chapter 1.04 of Title 1 of the Anaheim Municipal Code to read as follows: "1.04.395 LIMITATIONS ON CITY BOARD AND COMMISSION SERVICE. .010 Statement of Purpose. .0101 City boards and commissions perform a valuable service to the City of Anaheim by providing a means by which the City Council can obtain the advice, opinions and recommendations of City residents and other members of the community. The City has an abundant number of talented and qualified individuals who are capable of serving as board and commission members. The City is best able to draw upon the talents and abilities of its people by the periodic, systematic and continual infusion of new members to serve upon the City's appointed boards and commissions. .0102 For the above reasons, it is the desire of the City Council to encourage and solicit service on its boards and commissions by those who have not previously or recently served in such capacity. Neither the establishment of the limitations on board and commission service set forth in this section nor the failure of the City Council to reappoint any board or commission member eligible for reappointment should be viewed as a criticism of any person's performance or service but as a desire to encourage and facilitate public service by the greatest number of qualified individuals. .020 Limitation on Length of Service. .0201 No person shall serve more than two consecutive terms as a member of any City board or commission. .0202 Any person who has served two consecutive terms on a City board or commission shall not be eligible for reappointment to such board or commission until expiration of a 1 period of two years from the date of such person's most recent service on such board or commission. .0203 Any period of service which is equal to at least one-half of the length of a complete term shall be considered a term of service for purposes of this section. .0204 Any person who serves less than one-half of a complete term and, within a period of less than two years thereafter, is reappointed to such board or commission to fill an unexpired term shall be deemed to have served a full term provided the total period of service for both such partial terms equals at least one-half of a full term of service. .0205 The board or commission seat of any member whose current period of consecutive service on such board or commission exceeds two terms, as defined herein, shall be deemed vacant, and such member shall be deemed hereby removed from such board or commission without further action of the City Council being required, on the ninetieth day following the date of adoption of this section. 030 Prohibition on Concurrent Service. .0301 No person shall concurrently serve as a member of two or more City boards or commissions. .0302 Any person appointed by the City Council to serve as a member of any City board or commission who is then currently serving as a member of another City board or commission shall be deemed to have vacated the prior position upon acceptance of the new appointment. .0303 With regard to any person currently serving on two or more City boards or commissions and whose current period of consecutive service on at least two of such boards or commissions does not exceed two terms, as defined herein, the seat(s) on the board(s) or commission(s) on which such person has the longest current consecutive period(s) of service shall be deemed vacant so as to reduce such person's current service to not more than one board or commission, and such person shall be deemed hereby removed from such board(s) or commission(s) without further action of the City Council being required, on the ninetieth day following the date of adoption of this section. .040 Any person serving as an ex -officio member, or non- voting emeritus member, of any City board or commission shall not be deemed a member of such board or commission for purposes of the limitations imposed by this section. F .050 Any City board or commission for which a term of service is not otherwise specified shall be deemed to have a term of service of four years. The number of terms of service of any member of any such board or commission shall be calculated from the date such member was first appointed. The City Council shall designate a term expiration date for each seat on any such board or commission and, to create staggered terms, some or all of the terms initially so designated may be less than four years. .060 Nothing contained in this section shall be deemed to limit the power of the City Council to remove any member of any City board or commission at any time, with or without cause. .070 For purposes of this section, the term `City board or commission, shall mean and include any board or commission of the City of Anaheim whose members are appointed by the City Council as specified in Article IX of the City Charter or as otherwise created by formal action of the City Council, including the members of any board created by a joint exercise of powers agreement to which the City is a party and pursuant to which the City Council has the power to appoint at least a majority of the board members." SECTION 2. FILLING OF UNSCHEDULED VACANCIES. Any vacancy on any City board or commission which occurs as a result of the adoption of this ordinance, or for any other reason, and which occurs prior to expiration of the prescribed term of appointment, shall be filled by the City Council and the person so appointed shall serve the unexpired portion of such term. SECTION 3. SEVERABILITY The City Council of the City of Anaheim hereby declares that should any section, paragraph, sentence, clause, phrase or word of this ordinance of the Code, hereby adopted, be declared for any reason to be invalid, it is the intent of the Council that it would have passed all other portions of this ordinance independent of the elimination herefrom of any such portion as may be declared invalid.
