1789ORDINANCE NO. 1789 AN ORDINANCE OF THE CTY OF ANAHEIM AMENDING TITLE 18 OF THE ANAM Ilii MUNICIPAL CODE RELATING TC ZONING. THE CITY COUNCIL OF THE CITI OF ANAHEIM DOES FIND THAT-. WHEREAS, the City Planning Commission of the City of Anaheim did heretofore duly pass and adopt Resolution Nos 22 - SERIES 19611-62 in Reclassification Noo_�_p , redo0yiending an amendment of Titie 18 of the Anaheim Municipal Code,and a change or changes in the boundaries of the zone or zones hereinafter mentioned and described, after having held a public -hearing thereon in the manner and as prescribed in sad d Title I& of the Anaheim Municipal Code to consider such proposed change or changes of zone or zones, and after "a'r ng received evidence and reports from persons interested therein; and WHEREAS, said City Planning Commission.did make findings and sumMa ries of its hearings and did recommend a change or changes of zone or zones as set forth fr. said resolution; and WHEREAS, upon receipt of said resolution, report of findiligs, summary of evidence and.recommendation=:of the City Planning Commission, the City Clerk did fix the 12t_h_ day of - Ulm .919 62 , as the time, and the Cou�ne i 1 . Chamber in the City Rall of the�GiC of Anaheim as the place, for a public hearing.upon said proposed amendment to rifle 19 of the Anaheim Municipal Code,and change or changes of zone or zones, and did° give notice thereof in the manner- and as provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said put'lic hearJAV. the City Council did hold and conduct such public: ,-raring, and.did give; all persons interested therein an opportunity to be i lbear and 'did .receive evidence and reports, and .did there`u,pon consider; the recommendation of the City Planning Coiamission, and dIA adopt. Resolution (s) No. (s) ..r finding, and, determining that Title 18 of the Anaheim Municipal Code should- 04 exa'ended and that a change or -Changes in the boundaries of said zoffe:or zones should be made as set forth in said resolution(s); and WHEREAS, in &:-cordance with said Resolution '(s) 62,p._;E , certain conditions and equir`ements were mane as conditions precedent to the making of a change or changes of said zone or zones; and .wEAS, all conditions precedent to said change or changes of zone or zones have been complied with; -I - 61-62-103 NOWT, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. That Title 18 of the Anaheim Municipal Code relating to Zoning be, and the same is hereby, amended by changing the boundaries of the zones set forth in said Title 18 by adopting a sectional Zoning Map or Maps showing such change or changes as follows: That all of the area situated in the City of Anaheim, County of Orange, State of California, described as follows, to wi.t: The South one-half of the Southeast quarter of the Northeast quarter of the Northeast quarter of Section 27, in Township 4 South, Range 10 West, in the Rancho San Juan Cajon de Santa Ana, in the City of Anaheim, as shown on a map thereof recorded in book 51, page 7 et seq., Miscellaneous Maps, records of said Orange County; EXCEPTING the North half of the following: Beginning at a point on the North line of the Southeast quarter of the Northeast quarter of Section 273 in Township 4 South, Range 10 West of said rancho, said point of beginning being 35 feet West of the Northeast corner of the Southeast quarter of the Northeast quarter of said section; thence South parallel to the East line of said section, 10 feet; thence Fest parallel to the North line of the Southeast quarter of the Northeast quarter of said section, 20 feet; thence North parallel to the East line of said section, 20 feet; thence East parallel to the North line of the Southeast quarter of the Northeast quarter of said section, 20 feet; thence South .parallel to the East line of said section, 10 feet to the point of beginning. now is R A, RESIDENTIAL -AGRICULTURAL ZONE, and that it be changed to and incorporated in R--3, MULTIPLE -FAMILY RESIDENTIAL ZONE, upon the following conditions: 1. That subject property shall be developed substantially in accordance with plans marked "Exhibit No. 1 (Revised)." on file with the City of Anaheim, except as amended herein. 2. That the owners of subject property shall pay to the City of Anaheim the sum of .$25.00 per dwelling unit, to be used for park and recreation purposes, said amount to be paid at the time the building permit isissued. 3. That fire hydrants shall be installed as and when required by the Chief of the Fire Department of the City of Anaheim. 4. That adequate areas for trash storage, accessible to trash -truck pickup, shall be provided as determined and required by the Street Maintenance and Sanitation Division of the Public Forks Department, which areas shall be enclosed with a solid fence or wall prior to final building inspection. -2- 5. That the interior walls of the carports proposed to be constructed on subject property shall be completed with stucco; that proper bumper guards shall be installed to protect the interior walls from damage; and that enclosed storage cabinets shall be installed in the carport areas. 6. That landscaping shall be installed and maintained in the parkway portion of the Haster Street right of way; that 'plans for said landscaping shall be submitted to and approved by the Superintendent of Parkway Maintenance; and that said landscaping shall be installed prior to final building inspection. 7. That subject property shall be developed with a minimum of five different elevations, subject to the approval of the Architectural Control Committee; provided, however, that the three buildings fronting on Haster Street shall be constructed with three different elevations. SECTION 2. The City Zoning Map shall be, and the same is hereby, amended, and the property above described shall be excluded from the zone in which it is now situated, and incorporated in and made a part of the zone or zones as above set forth, and said City Zoning Map as amended is hereby adopted and the City Engineer is hereby directed to prepare a sectional zoning map to be added to the City Zoning Map showing the changes hereby approved and adopted. SECTION 3. The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be printed once within fifteen (15) days after its adoption, in the Anaheim Bulletin, a newspaper of general circulation, printed, published and circulated in said City, and thirty (30) days from and after its final passage it shall take effect and be in full force.
