1775P� • ORDINANCE NO � 1775 AN ORDINANCE OF THE CITY OF ANAHEIM AMENDING TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES FIND THAT. - WHEREAS, the City Planning Commission of the City of Anaheim did heretofore duly pass and adopt Resolution No. 434, Series 1962-63 in Reclassification No. 62-63-5 recommending an amendment of Title 18 of the Anaheim ILunicipa Code and a change or changes in the boundaries of the zone or zones hereinafter mentioned and described, after having held a public hearing thereon in the manner and as prescribed in said Title 18 of the Anaheim Municipal Code to consider such proposed change or changes of zone or zones, and after having received evidence and reports from persons interested therein; and WHEREAS, said City Planning Commission did mare findings and summaries of its hearings and did recommend a change or changes of zone or zones as set forth in said resolutions and WHEREAS, upon receipt of said resolutions report of findi.ngsg summary of evidence and recommendation of the City Planning Commission,, the City Clerk did fix the 4th day of September 9 19 62 g as the time, and the Council Chamber in the City all of the City of Anaheim as the place., for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code and change or changes of zone or zones, and did give notice thereof in the manner and as provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the. time and place fixed for said public hearing, the City Council did hold and conduct such public hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports, and did thereupon consider the recommendation of the City Planning Commission, and did adopt Resolution (s) No. (s) 62R-801 , finding and determining that Title 18 of the Anaheim Municipal Code should be amended and that a change or changes in the boundaries of said zone or zones should be made as set forth in said resolution(s).- and esolution(s);and WHEREAS, in accordance with said Resolution (s) 62R-801 9 certain conditions and requirements were made as conditions precedent to the making of a change or changes of said zone or zones; and WHEREAS, all conditions precedent to said change or changes of zone or zones have been complied with; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS. - SECTION 1� That Title 18 of the Anaheim Municipal Code relating to Zoning be, and the same is hereby,, amended by changing the boundaries of the zones set forth in said Title 18 by adopting a sectional Zoning Map or Maps showing such change or changes as follows*. 62-63-5 That all of the area situated in the City of Anaheim, County of Orange, State of California, described as follows, to wit: now is R -A, RESIDENTIAL -AGRICULTURAL ZONE, and that it be changed to and incorporated in R-3, MULTIPLE -FAMILY RESIDENTIAL ZONE, upon the following conditions: 1. That the owner of subject property shall pay to the City of Anaheim the sum of $25.00 per dwelling unit, to be used for park and recreation purposes, said amount to be paid at the time the building permit for the new unit is issued. 2. That adequate areas for trash storage, accessible to trash -truck pickup, shall be provided as determined and required by the Street Maintenance and Sanitation Division of the Public Works Department, which areas shall be enclosed with a solid fence or wall prior to final building inspection. 3. That subject property shall be developed substantially in accordance with plans marked "Exhibit 1, Revised," signed by Mayor Coons, approved by the City Council on September 4, 1962, and on file with the City of Anaheim. 4. (a) That a 6 -foot masonry wall shall be constructed along the southerly line of subject property, said wall to be reduced to 42 inches in height commencing at the front yard setback of the adjoining lot to the South; or--- -2- The Northerly 129 feet, measured along the Easterly line of that portion of Lots 9 and 10 of the Miles Rancho, as shown on a map thereof recorded in Book 4, page 7 of Miscellaneous Maps, records of Orange County, California, bounded and described as follows: Beginning at a point in the center line of the unnamed road shown on said map adjoining said Lots 9 and 10 on the North and known as Romneya Drive, distant thereon South 890 43' 20" West 328.98 feet from the intersection of said center line with the Northerly prolongation of .the Easterly line of said Lot 10, said point of beginning being the intersection of said center line with the Easterly line or the Northerly prolongation thereof, of the tract of land described in the deed executed by Bank of America National Trust and Savings Association, in favor of David Corderman and wife, recorded July 29, 1942 in Book 1156, page 18 of Official Records; thence South 00 24' 00" East along said Easterly line of the Corderman tract of land, 238 feet; thence South 890 43' 20" West parallel with said center line of Romneya Drive, 363.58 feet to the center line of the unnamed road shown on said map adjoining said Lots 9 and 10 on the West and known as West Street; thence North 00 29' 10" West along said center line of West Street, 238 feet to said center line of Romneya Drive; thence North 890 43' 20" East along center line of Romneya Drive 363.94 feet to the point of beginning; Excepting from said Northerly 129 feet, the Easterly 263 feet measured along said center line of Romneya Drive. now is R -A, RESIDENTIAL -AGRICULTURAL ZONE, and that it be changed to and incorporated in R-3, MULTIPLE -FAMILY RESIDENTIAL ZONE, upon the following conditions: 1. SECTI0W 2. The City Zoning Map shall be, and the same is hereby, amended, and the property above described shall be excluded from the zone in which it is now situated, and incorporated in and made a part of the zone or zones as above set forth, and said City Zoning Map as amended is hereby adopted and the City Engineer is hereby directed to prepare a sectional zoning map to be added to the City Zoning Map showing the changes hereby approved and adopted. SECTION 3. The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be printed once within fifteen (15) days after its adoption, in the Anaheim Bulletin , a newspaper of general circulation, printed, publishe -a circulated in said City, and thirty (30) days from and after its final passage it s all take effect and be in full force. me this THE FOREGOING ORDINANCE is approved and signed by 7th day of November , 19 62.
