1763• • ORDINANCE NO. 1763 AN ORDINANCE OF THE CITY OF. ANAHEIM AMENDING TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING. THE CITY COUNCIL OF THE CIiY'.OF ANAHEIM DOES FIND THAT o WHEREAS, the City Planning commission of the City of Anaheim did heretofore duly pass and adopt Resolution No, 392-- 1962-6 3 92-- 1962=63 Series in Reclassification No. 61-62-125 , recon :ending an amendment of Title 18 of the Anaheim MUnilipg Code.and a change or changes in the boundaries of the zone or zones hereinafter mentioned and described, after having held a public hearing thereon in the manner and as prescribed in said Title l.& of the Anaheim Municipal Code to consider such proposed change or changes of zone or zones, and after ra�r-'ng received evidence and reports from persons interested therein; and WHEREAS, said City Planning Commission -did make findings and sumMa ries of its hearings and did recommend a change or changes of zone or zones as set forth fr. 3aid resolution; and WHEREAS, upon receipt of said resolution, report of findings, summary of evidence and.recommendation:of the City Planning Commission, the City Clerk did fix the 7th day of August , 19 62 as the time, and theCounc i 1 -Chamber in the City Hall of the�City of Anaheim.as the place, for a public hearing upon said proposed amendment to Tile 18 of the Anaheim Municipal Code and change or changes of zone or .zones, and did" give notice thereof in the manner and as provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place: fixed for Said pub"l-ic hearing, the City Council did hold and conduct such public :.aringz and did give all persons interested therein an opportunity to be ,,bear. and 'did :receive evidence and reports, and.did thereupon consider the recommendation of the City Planning Commission, and d;id adopt Resolution (s) No. (s) 62R-730 , finding, and determining that Title 18 of the Anaheim; Municipal Cade should' lid i*' dndid and that a change or, changes in the boundaries of :said zoie.or zones should be made as set forth in said resolution(s); and ViHEREAS, in &Iccordance with said Resolution (s) 62R-730 , certain conditions and requirements were made as conditions precedent to the making of a change or changes of said zone or zones; and riiz.C_� E.4S, all conditions precedent to said change or changes of zone or zones have been complied with;' -1- 61-62-125 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. That Title 18 of the Anaheim Municipal Code relating to It Zoning be, and the same is hereby, amended by changing the boundaries of the zones set forth in said Title 18 by adopting a sectional Zoning Map or Maps showing such change or changes as follows: That all of the area situated in the City of Anaheim, County of Orange, State of California, described as follows, to wit: .PARCEL 1; The North 5 acres of the East 10 acres of the South half of the Southeast quarter of the Northeast quarter of Section 14, in Township 4 South, Range 11 West, in the Rancho Los Coyotes, as shown on a map thereof recorded in book 51, page Ill Miscellaneous Maps, records of said Orange County; EXCEPTING the East 40 feet of said land as deeded to the county of Orange, by deed recorded May 10, 1951, Torrens document No. 23057, in the office of the County Recorder of said Orange County, ALSO EXCEPTING THEREFROM that portion deeded to the Orange County Flood Control District, by deed recorded June 8, 1961, in book 5747, page 158, Official Records, in the office of the County Recorder of said Orange County, PARCEL 2: The South 5 acres of the East 10 acres of the South half of the Southeast quarter of the Northeast quarter of Section 14, in Township 4 South, Range 11 West, in the Rancho Los Coyotes, as shown on a map thereof recorded in book 51, page 1l, Miscellaneous Maps, records of said Orange County; EXCEPTING the East 40,00 feet and the most triangular portion of :said land as deeded to the county of Orange for road purposes by deed recorded June 18, 19512 as Torrens document No. T-23423 in the office of the County Recorder of said Orange County, now is R -A, RESIDENTIAL -AGRICULTURAL ZONE, and that it be changed to and incorporate in C-1, NEIGHBORHOOD -COMMERCIAL ZONE, upon the following conditions: 1. That adequate areas for trash storage, accessible to trash -truck pickup, shall be provided as determined and required by the Street Maintenance and Sanitation Division of the .Public Works Department, which areas shall be enclosed with a solid fence or wall prior to final building inspection. 2. That the completion of these reclassification proceedings is contingent upon the granting of Conditional Use Permit No. 260. -2- 3. That subject property shall be developed substantially in accordance with plans marked "Exhibits Nos. 1, 2, 3 and 4" on file with the City of Anaheim, including the installation of landscaping along the Orange Avenue and Beach Boulevard frontages as indicated on Exhibit No. 1. 4. That all necessary air conditioning equipment shall be provided and installed in such manner as not to destroy the esthetic qualities of of the renderings of the elevations presented on Exhibits Nos. 3 and 4- 5. That written approval of the State of California, Department of Public Health, shall be secured prior to the issuance of a business license for the hospital and/or convalescent home. SECTION 22. The City Zoning Map shall be, and the same is hereby, amended, and the property above described shall be excluded from the zone in which it is now situated, and incorporated in and made a part of the zone or zones as above set forth, and said City Zoning Map as amended is hereby adopted and the City Engineer is hereby directed to prepare a sectional zoning map to be added to the City Zoning Map showing the changes hereby approved and adopted. SECTION 3. The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be printed once within fifteen ( 15) days after its adoption, in the Anaheim Bulletin, a newspaper of general circulation, printed, published and circulated in said City, and thirty (30) days from and after its final passage it shall take effect and be in full force.
