The complete operation of treating and/o^ disposing of the accumulation of garbage, rubbish and waste material and the product or residue arising from such treat- ment. CITY. The incorporated City of Anaheim, California, acting through its City Council or its City Manager. CITY MANAGER. The regularly appointed and qualified City Manager of the City of Anaheim or his designated repre- sentative,. The word PERSON shall include firms, associations and corporations. CONTRACTOR. The person, persons, firm or corporation entering into a contract with the City for the collection and disposal of garbage, rubbish and waste material. "Section 6.21.020 CONTRACT FOR COLLECTION OF GARBAGE, RUBBISH, WASTE MATERIAL. The City and its duly authorized agents, servants and employees, or any contractor or contractors with whom the City may at any time enter into a contract therefor, and the agents, servants and employees of such contractor or con- tractors, while any such contract shall be in force, shall have the exclusive right to gather, collect and remove garbage, rubbish and waste material from all premises in the City; and no person other than those above specified shall gather, collect or remove any garbage, rubbish or waste materia, or convey or transport any garbage, rubbish or waste material in, along, or over any public street, alley, or highway in the City, or take any garbage, rubbish or waste material from any receptacle in which the same may be placed for collection or removal, or interfere with or disturb any such receptacle, or remove any such receptacle from any location where the same is placed by the owner thereof. 'Section 6.21.030 SPECIFICATIONS FOR COLLECTION VEHICLE BODIES. All vehicles used in collecting and conveying garbage in said City shall be provided with metal bodies which shall be kept water -tight at all times and thorough"y cleansed daily. All vehicles used in collecting and conveying rubbish and waste material shall be provided with bodies so constructed as to prevent the loss of any contents thereof upon the streets, alleys, or highways of said City. "Section 6.21.040 GARBAGE TO BE PLACED IN CANS. At all locations where commercial and industrial premises exist, garbage shall be drained to remove the liqu"d --ontent and, after drainage, wrapped tightly in paper in such manner as will eliminate odor, and may then be placed in the rubbish and waste material containers, as hereinafter provided, for removal and disposition in the same manner as rubbish and waste material. If the person or persons having charge or control of any premises where commercial and industrial units exist chooses not to drain and wrap said garbage in the aforementioned and des- cribed manner, then such person or persons shall place and keep all garbage which accumulates on such premises in galvanized -2- metal receptacles, each of which shall be water tight and shall have a tight fitting galvanized metal cover and suitable handles on the outside thereof for lifting the receptacle and its contents. Such metal cover shall be kept upon each of said receptacles at all times except when such receptacle is being filled or while said receptacle is being emptied. Each such garbage receptacle shall have a maximum weight of sixty-five (65) pounds when filled. 'Section 6.21.050 RUBBISH AND WASTE MATERIAL CONTAINERS - REQUIRED. Every person occupying or having charge or control of any commercial or industrial premises in the City of Anaheim shall provide a type of container or receptacle suitable for the accumulation and collection of rubbish and waste material, said type of container or receptacle to be in conformity with the provisions of this chapter. "Section 6.21.060 RUBBISH AND WASTE MATERIAL CONTAINERS - FREQUENCY OF EMPTYING. Such person shall cause said containers or receptacles to be emptied and all rubbish and waste material removed from said premises and disposed of in some lawful manner, such removal and disposal to be accomplished at least once each calendar week in the case of rubbish and at least once each calendar month in the case of waste material, except as provided in Section 6.21.080 hereof. "Section 6.21.070 RUBBISH AND WASTE MATERIAL CONTAINERS SPECIFICATIONS. All containers or receptacles for the accumulation and collection of rubbish and waste material from commercial, or industrial premises sha.11 conform to the following min- imum specifications: (a) Each such container or receptacle shall weigh. not more than one hundred (100) pounds when filled and set out for collection. (b) Each such container or receptacle shall be con- structed of metal, plastic, fibre board, composi- tion board, or cardboard of sufficient quality to serve as such a container or receptacle, provided, that no corrugated cardboard box shall be permitted to serve as such container or receptacle except as provided in this chapter. No other type of container or receptacle shall be per- mitted for the accumulation and collection of rubbish and waste material from commercial and industrial premises except certain bulk rubbish and waste material containers approved by the Public Works Department and supplied to the ccmmercial and industrial premises .uy a contractor, as the term 'con- tractor' is defined by this Chapter. Such bulk rubbish and waste material containers shall be kept in a clean and sani- tary condition by the contractor supplying said bulk rubbish and waste material containers. Such bulk rubbish and waste material containers shall be provided with lids which shall be kept tightly closed at all times except during the process of filling or emptying such bulk containers. °-3- "Section 6.21.080 REMOVAL OF OTHER WASTE AND DEBRIS, Every person occupying or having charge or control of any premises in the City of Anaheim shall, at least once in each calendar month, collect and dispose of all waste material and debris such as discarded automobile bodies and similar heavy or bulky objects, and all other waste not included in the meaning of 'waste material" as defined in Section 6.210010 hereof, which may.have accumulated on his premises, provided that building or construction waste and debris need be rentuved only upon completion of construction operations. All such waste and debris in this section defined shall be removed to such dump grounds as may be provided or designated by the City, "Section 6.21.090 ASHES AND VACUUM CLEANER DUST OR SWEEPINGS- COLLECTION AND REMOVAL. Every person occupying or having charge or control of any commercial and industrial premises in the City of Anaheim who desires the collection and disposal of ashes or other residue from combustion, or vacuum cleaner dust, or sweepings shall place said ashes or residue or vacuum dust or sweepings in disposable containers or receptacles which containers or receptacles shall be tightly closed. "Section 6,21.100 THROWING GARBAGE, RUBBISH, WASTE MATERIAL ON STREETS --ON LAND SO IT MAY BECOME A NTU I SANCE--PROHIBITED No person shall throw, place, scatter, or deposit any garbage, rubbish or waste material in or upon any public alley, street, or highway, park, or other public place in the City except as herein expressly authorized, nor throw, place, scatter, or deposit any garbage, rubbish, or waste material upon or below the, surface of any premises in such a manner that the same is or may become a nuisance or endanger the public health. "Section 6.21.110 THROWING RUBBISH, WASTE MATERIAL, FILTH ONTO PUBLIC PLACE --THROWING ICE, SALT ON PAVED STREET OR SIDEWALK --PROHIBITED. It shall be unlawful for any person or persons, firms or corporation to throw or deposit, or permit to be thrown or de- posited into or upon any public street, sidewalk, park or common within the City of Anaheim any broken glass, broken wire, rubbish, garbage, dead animal, offal or filth of any kind, or to throw or deposit, or cause to be thrown or de- posited in or upon any cement sidewalk or paved street within the City of Anaheim any broken or cracked ice, salt or other similar substance, "Section 6,21,120 DEPOSITING WASTE MATERIAL, RUBBISH, HEAVY BULKY OBJECTS ON STREETS OR ALLEYS PROHIBITED, It shall be unlawful for any firm, person or corporation to dump, deposit, place or leave,.or cause to be dumped, deposited, placed or left, any waste material, debris, rubbish, scrap iron, discarded automobiles or automobile bodies, and similar heavy, It bulky objects, or any other waste within any streets or alleys within the City of Anaheim. A violation of this provision is hereby declared to be a misdemeanor and each day or part of a day during which such violation continues shall be a separate misdemeanor and shall 4- be punishable as provided In Section 1.01-370 hereof. "Section 6.21.130 PLACING TRASH, RUBBISH, GARBAGE THAT MAY DECAY ON LAND OF ANOTHER --PROHIBITED. No person shall place or deposit upon the land of another any tin cans, trash, refuse, rubbish, garbage, offal, nauseous substance., tree trimmings, grass cuttings, animal or vegetable matter, muck, or any material which may become decayed or putrid. "Section 6,,21.140 RUBBISH ANE WASTE MATERIALS —COMMERCIAL AND INDUSTRIAL ESTABLISHMENTS --CHARGES FOR COLLECTION AND DISPOSAL. For the collection, removal and disposal of rubbish and/or waste from commercial and industrial establishments within the City of Anaheim, the following charges shall be made for the following services-. CLASS I. For three times a week collection for 50 gallons or less of rubbish and/or waste material, the sum of Two Dollars and Fifty Cents ($2.50) per month, plus Two Dollars and Fifty Cents ($2.50) per month for each additional 50 gallons of rubbish and/or waste material, CLASS 11. For six times a week collection for 50 gallons or less of rubbish and/or waste material, the sum of Four Dol- lars ($4-00) per month, plus Four Dollars ($4.00) per month for each additional 50 gallons of rubbish and/or waste material. CLASS III. Special and/or irregular collection of rubbish and/or waste material, Five Dollars ($5.00) per cubic yard. CLASS IV. For the collection, removal, and disposal of rubbish and/or waste materials from industrial establishments, public and parochial schools, and certain commercial estab- lishments within the City of Anaheim which by virtue of the character and quantity of the rubbish or waste materials to be removed and disposed of, the charges shall be the reason- able cost of the removal thereof to be determined in each In- dividual case by said character, and quantity of the rubbish or waste materials to be removed and disposed of. "Section 6.21,150 LARGE BOXES AND CRATES-_ COLLECTION AND REMOVAL. Every person occupying or having charge or control of' any commercial and industrial premises in the City of Ana - helm who desires the collection and disposal of large appliance cartons, shipping crates or similar large boxes or containers or small non -bulky items of furniture shall disassemble such boxes or containers prior to placement for collection and disposal. "Section 6.21.160 At any time after thirty (30) days after the effective date of this ordinance, all rubbish and waste material recep- tacles and containers which do not conform to the specifica- tions contained In this chapter shall become illegal for the collection and disposal of rubbish and waste material from all commercial and industrial Premises. Every person Occupying or having charge or control of any commercial and industrial premises in the City of Anaheim may request that such nonconforming rubbish and waste material containers and receptacles be removed by the City at no expense to said owner or occupier of said commercial or industrial premises.' SECTION 2. The City Clerk shall certify to the passage of this ordinance and shall cause the same to be published once within fifteen (15) days from and after its adoption in the Anaheim Bulletin, a newspaper of general circt+lation, printed, published, and circulated in the City of Anaheim, and thirty (30) days from and after its final passage, it shall be in full force and effect.
