17291 ORDINANCE NO. 1729 AN ORDINANCE OF THE CITY OF ANAHEIM AMENDING TITLE 18 OF THE . ANAa-ti' M MUNICIPAL. CODE RELATING TO ZONING THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES FIND THAT WHEREAS, the City Planning Commission of the City of Anaheim did heretofore duly pass and adopt Resolution No, 2_ 74--- Series 1961-62 in Reclassification No. 61-62-93 , recorrrmending an amendment of Title 18 of the AnaheimIMunicipa Code.and a change or changes in the boundaries of the zone or zones hereinafter mentioned and described, after having held a public. -hearing thereon in the manner and as prescribed in said Title I& of the Anaheim Municipal Code to consider such proposed change or changes of zone .or zones, and after .a T ng received evidence and reports from persons interested therein,, and WHEREAS, said City Planning Commissiondid make findings and sumMaries of its hearings and did recommend a change or changes of zone or zones as set fo-rth Ir said resolution; and WHEREAS, upon receipt of said resolution, report of findings, summary of evidence and recommendation,: of the City Planning Commission., the City Clerk did fix the 8th day of 19 62 , as the time, and the Council -Chamber in the City Ha11 of they of Anaheim. as the place, for a public heairing upon said proposed amendment to Title 18 of the Anaheim Municipal Code" "and change or changes of zone or zones, and did give notice thereof in the manner and as provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place; fixed for said pu2'l-ic hearing. the City Council did hold, and conduct such public ',,-raring, and did! give; all persons interested therein an opportunity to be jbear"d and 'did ,receive evidence and reports, and .d:id thereupon consider the rtcommendation of the City Planning Commission, and d$`6 adopt Resolution (s) No (s)62 R-- L�? , finding. and .determining that Title 1$ of the Anaheim Mu'n*Mpal Code should' DO a.mO►nde'd and that a change or changes in the boundaries of :said . zof'e° ;or zones should be rade as set forth in said reso lut ion s) ; and ki'HEREAS, in accordance with said Resolution '(s) 62R-447 .. ._ , certain conditions and requirements were marc e as conditions precedent to the making of a change or changes of said zone or zones; and all conditions precedent to said change or changes of zone or zones have been complied w-ith; -I- 6162-93 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. That Title 18 of the Anaheim Municipal Code relating to Zoning be, and the same is hereby, amended by changing the boundaries of the zones set forth in said Title 18 by adopting a sectional Zoning Map or Maps showing such change or changes as follows: That all of the area situated in the City of Anaheim, County of Orange, State of California, described as follows, to wit: The Northeast quarter of the Southeast quarter of the Northeast quarter of Section 27, Township 4 South, Range 10 West, S. B. B. & M., estimated to contain 10 acres. now is R-,�,, RESIDENTIAL -AGRICULTURAL, ZONE and that it be changed to and incorporated. in R-3, .MULTIPLE-FIILY RESIDENTIAL, ZONE subject to the following conditions: 1. That subject property shall be developed substantially in accordance with plans marked "Exhibits Nos. l through 1511; PROVIDED, HOWEVER, that the,interior walls of all carports shall be stuccoed or of masonry construction; that a bumper shall be placed at the head of every carport space to protect the interior walls; that the carports shall have enclosed storage cabinets; that no carport shall encroach into the twenty -foot setback area; that the roof construction shall be of cedar shingle or medium shake material on all buildings except garages; and that a six-foot masonry wall shall be constructed on the west side of subject property r o final building inspection. 2. That plans for the devel f subject property shall be submitted to and aPer the Architectural Control Committee. 3. That the owner of subjeC r,2.rty shall pay to the City of Anaheim the sum 00 per dwelling unit, to be used for park and,. -r ~ tion purposes, said amount to be paid at the time tlZ­4 ding permit is issued. 4.. That adequate areas for trash storage accessible to trash -truck pickup shall be provided as determined and required by the Street Maintenance and Sanitation Division of the Public Works Department, which areas shall be enclosed by a solid fence or wall prior to final building inspection. 5• That adequate drainage of subject and abutting properties, as required and approved by the City Engineer, shall be provided prior to final building inspection. 6. That adequate fire hydrants and water supply shall be provided as required by the Chief of the Fire Department prior to final building inspection. -2- SECTION 2. The City Zoning Map shall be, and the same is hereby, amended, and the property above described shall be excluded from the zone in which it is now situated, and incorporated in and made a part of the zone or zones as above set forth, and said City Zoning„Map as amended is hereby adopted and the City Engineer Is hereby directed to prepare a sectional zoning map to be added to the City Zoning Map showing the changes hereby approved and adopted. SECTION 3. The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be printed once within fifteen (15) days after its adoption, in the Anaheim Bulletin, a newspaper of general circulation, printed, published:and. circulated in said City, and thirty (30) days from and,after Its final passage it shall take effect and be in full force.
