RES-2018-088RESOLUTION NO. 2018- 0 8 8 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM, CALIFORNIA REGARDING PRIORITIES FOR FILING WRITTEN ARGUMENTS REGARDING AN INITIATIVE MEASURE TO BE SUBMITTED TO THE QUALIFIED ELECTORS OF THE CITY OF ANAHEIM AT THE GENERAL MUNICIPAL ELECTION TO BE HELD IN THE CITY ON TUESDAY, NOVEMBER 6, 2018, AND DIRECTING THE CITY ATTORNEY TO PREPARE AN IMPARTIAL ANALYSIS OF SUCH INITIATIVE MEASURE (INITIATIVE ORDINANCE TO INCREASE MINIMUM WAGE PAYABLE BY HOSPITALITY INDUSTRY EMPLOYERS LOCATED IN THE ANAHEIM OR DISNEYLAND RESORT SPECIFIC PLAN ZONES THAT HAVE TAX REBATE AGREEMENTS WITH THE CITY AND REQUIRING THAT SERVICE CHARGES IMPOSED BY SUCH EMPLOYERS BE PAID ENTIRELY TO EMPLOYEES) WHEREAS, a General Municipal Election is to be held in the City of Anaheim, California, on November 6, 2018, at which election there will be submitted to the electors of the City an initiative measure in substantially the following form pursuant to the provisions of Section 1303 of the Anaheim City Charter and Section 9215 of the Elections Code of the State of California: MEASURE YES INITIATIVE ORDINANCE TO INCREASE MINIMUM WAGE PAYABLE BY CERTAIN HOSPITALITY INDUSTRY EMPLOYERS -- Shall the initiative ordinance to increase the minimum wage payable by hospitality industry employers located in the NO Anaheim or Disneyland Resort Specific Plan Zones that have tax rebate agreements with the City, and to require that service charges imposed by such employers be paid entirely to employees, be adopted? WHEREAS, Section 1302 of the Charter of the City of Anaheim and Section 9282 of the Elections Code of the State of California authorize the filing of arguments for and against the adoption of initiative measures and for the City elections official to enclose a printed copy of such arguments with the sample ballot provided to the electors of the City; and WHEREAS, the City Council hereby desires to authorize the filing of written arguments for and against the adoption of the above -referenced initiative measure by the Mayor and other member (s) of the City Council in accordance with Section 9282 of the Elections Code of the State of California. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That, pursuant to Section 9282 of the Elections Code, the persons filing an initiative petition may file a written argument in favor of the ordinance proposed by the initiative measure and the City Council may submit an argument against that ordinance. In addition, to the extent permitted by law, the City Council authorizes the Mayor and any member(s) of the City Council of the City of Anaheim to prepare and file written arguments relating to the initiative measure. Arguments for or against the measure may be withdrawn or changed until 5:00 p.m. on August 10, 2018, after which time no arguments for or against the measure shall be filed with the City Clerk. SECTION 2. That, in accordance with Section 9283 of the Elections C ode of the State of California, the printed names and signatures of not more than five authors shall appear with any argument submitted in accordance with this resolution. The authors of any argument submitted for or against the initiative measure may include, but need not be limited to, the Mayor and other members of the City Council. SFCTION 3 That the City Council directs the City Clerk to transmit a copy of the initiative measure to the City Attorney who shall prepare an impartial analysis of such measure. The impartial analysis shall be filed with the City Clerk not later than 5:00 p.m. on August 10, 2018. SECTION 4. That the City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.
