RESOLUTION NO. 2018- 0 9 7 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />ANAHEIM, CALIFORNIA SETTING PRIORITIES FOR <br />FILING WRITTEN ARGUMENTS REGARDING A <br />REFERENDUM MEASURE TO BE SUBMITTED TO THE <br />QUALIFIED ELECTORS OF THE CITY OF ANAHEIM AT <br />THE GENERAL MUNICIPAL ELECTION TO BE HELD IN <br />THE CITY ON TUESDAY, NOVEMBER 6, 2018, AND <br />DIRECTING THE CITY ATTORNEY TO PREPARE AN <br />IMPARTIAL ANALYSIS OF SUCH MEASURE <br />(REFERENDUM MEASURE ADOPTING ORDINANCE 6376 <br />APPROVING A DEVELOPMENT AGREEMENT <br />PROVIDING VESTED RIGHTS FOR CONSTRUCTION OF A <br />HOTEL AT 1700 S. HARBOR BLVD.) <br />WHEREAS, a General Municipal Election is to be held in the City of Anaheim, California, on <br />November 6, 2018, at which election there will be submitted to the electors of the City a referendum <br />measure in substantially the following form pursuant to the provisions of Section 1303 of the Anaheim City <br />Charter and Section 9215 of the Elections Code of the State of California: <br />MEASURE <br />YES <br />REFERENDUM MEASURE APPROVING <br />DEVELOPMENT AGREEMENT NO. 2016-00001 — <br />Shall Anaheim City Council Ordinance No. 6376, which <br />would approve a Development Agreement and provide a <br />vested right to develop a Four Diamond 580 -room, eight- NO <br />story hotel on property located at 1700 S. Harbor Blvd. <br />during the five-year term of that Development Agreement <br />in accordance with governmental approvals and <br />entitlements granted by the City, be adopted? <br />WHEREAS, Section 1302 of the Charter of the City of Anaheim and Section 9282 of the Elections <br />Code of the State of California authorize the filing of arguments for and against the adoption of a <br />referendum measure and for the City elections official to enclose a printed copy of such arguments with the <br />sample ballot provided to the electors of the City; and <br />WHEREAS, the City Council hereby desires to authorize the filing of written arguments against <br />the adoption of the above -referenced referendum measure by the Mayor and other member (s) of the City <br />Council in accordance with Section 9282 of the Elections Code of the State of California. <br />
