5861FOLLOWS: ORDINANCE NO. 5861 AN ORDINANCE OF THE CITY OF ANAHEIM AMENDING SECTION 13.04.010 OF CHAPTER 13.04 OF TITLE 13 OF THE ANAHEIM MUNICIPAL CODE RELATING TO THE PARKS AND RECREATION COMMISSION THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS SECTION 1. That Section l 3.04.010 of Chapter 13.04 of Title 13 of the Anaheim Municipal Code be, and the same are hereby, amended in its entirety to read as follows: "13.04.010 PARKS AND RECREATION COMMISSION; MEMBERSHIP AND TERMS. .010 A Parks and Recreation Commission consisting of seven members hereby exists in the City of Anaheim pursuant to Section 907 of the Charter of the City of Anaheim. .020 Members of the Parks and Recreation Commission shall be appointed by the City Council and shall serve for a term of four years and until their respective successors are appointed and qualified. .030 Terms of members shall be staggered so that the terms of two members shall expire on the thirtieth day of June of each year except for each fourth year when the term of one of the members shall expire on the thirtieth day of June of such year. .040 At the expiration of each of the terms so provided for, a successor shall be appointed by the City Council for a term of four years. Vacancies in said Commission occurring otherwise than by expiration of term shall be filled by appointment by the City Council for the remainder of the unexpired term. .050 The City Council may appoint up to seven ex officio, non-voting, members, each of whom shall be a member of the board of trustees of a separate public school district serving the City of Anaheim. Ex -officio members, if any, shall serve for a term of four years from the date of appointment." SECTION 2. OPERATIVE DATE OF ORDINANCE; APPOINTMENT OF NEW COMMISSION MEMBERS. This ordinance shall become effective and operative on the thirty-first day following the date of its adoption. The members of the Parks and Recreation Commission on the date this ordinance is adopted shall continue to serve in such capacity until the effective date hereof, except for any member whose term expires or who is removed by any other action of the City Council prior to such date. All seats on the current Parks and Recreation Commission shall be deemed vacant on the effective date of this ordinance without further action of the City Council. The City Council shall appoint or reappoint members of the Parks and Recreation Commission to conform to this ordinance who shall begin service on the effective date hereof or upon the date of their appointments, whichever is later. Any period of service on such commission by any reappointed member immediately prior to such reappointment shall be counted in determining the maximum length of consecutive service permitted pursuant to Section l .04.395 of the Anaheim Municipal Code. SECTION 3. SEVERABILITY The City Council of the City of Anaheim declares that should any section, paragraph, sentence or word of this ordinance hereby adopted be declared for any reason to be invalid, it is the intent of the Council this it would have passed all other portions of this ordinance independent of the elimination herefrom of any such portion as may be declared invalid. SECTION 4. SAVINGS CLAUSE Neither the adoption of this ordinance nor the repeal or amendment of any other ordinance of this City shall in any manner affect the prosecution for violations of ordinances, which violations were committed prior to the effective date thereof, nor be construed as a waiver of any tax, license or penalty or of the penal provisions applicable to any violations thereof. The provisions of the ordinance, insofar as they are substantially the same as ordinance provisions previously adopted by the City relating to the same subject matter, shall be construed as restatements and continuations, and not as new enactments.
