5863FOLLOWS: ORDINANCE NO. 5863 AN ORDINANCE OF THE CITY OF ANAHEIM ADDING NEW SECTION 1.04.857 TO CHAPTER 1.04 OF TITLE 1 OF THE ANAHEIM MUNICIPAL CODE RELATING TO THE SESQUICENTENNIAL COMMISSION THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS SECTION 1. That new Section 1.04.857 be, and the same is hereby, added to Chapter 1.04 of Title 1 of the Anaheim Municipal Code to read as follows: "1.04.857 SESQUICENTENNIAL COMMISSION. .010 Establishment. The Sesquicentennial Commission is hereby established pursuant to Section 900 of the Charter of the City of Anaheim. .020 Membership. The Sesquicentennial Commission shall consist of eleven members, none of whom shall hold any paid office or employment in the City government and at least eight of whom shall be residents of the City of Anaheim. .030 Appointment and Removal. The members of the Sesquicentennial Commission shall be appointed by the City Council and shall be subject to removal at any time by motion of the City Council adopted by the affirmative votes of a majority of the entire City Council. .040 Term of Appointment. Notwithstanding any other provision of this Code to the contrary, each member of the Commission shall serve for a term which shall expire at the end of the business day on December 31, 2007. .050 Vacancies. Any vacancy occurring before expiration of the term of a Commission member shall be filled by appointment by the City Council for the remainder of such term. 060 Organization, Meetings and Procedures. .0601 The Commission shall, not later than fifteen days following the effective date of this section or the date of completion of appointment of the members of such Commission, whichever occurs later, and annually at its first regular meeting following the first day of July in each year thereafter, hold a meeting duly called and noticed by the City Clerk as may be required by law to elect a Chair and Vice -Chair and to conduct such other business as may be necessary. 1 .0602 The Commission shall hold regularly scheduled meetings at dates and times as established by the Commission, and shall hold such other meetings as from time to time shall be called in the manner and form required by law. Meetings shall be conducted in accordance with Section 904 of the City Charter. A majority of the total number of members of the Commission then in office shall constitute a quorum. .0603 The meetings and procedures of the Commission shall be subject to and governed by the ordinances and resolutions of the City Council establishing rules and regulations for City boards and commissions. The Commission may adopt rules of order and/or bylaws relating to its meetings provided that any such rules or bylaws shall require approval of the City Council. .0604 The Commission shall have the power to appoint subcommittees of less than a quorum of the Commission to perform tasks within the scope of the Commission's responsibility and to make reports and recommendations for consideration by the Commission. .070 Appropriations. The City Council shall include in its annual budget such appropriations of funds as, in its opinion, shall be sufficient for the efficient and proper functioning of the Commission. .080 No Compensation. Members of the Commission shall serve without compensation. 090 Powers and Duties. The Sesquicentennial Commission shall have the power and duty to: .0901 Provide advice and recommendations to the City Council concerning the City Council's consideration and approval of specific City programs, projects and events to be held, performed or conducted as part of the Sesquicentennial and any necessary funding therefor. .0902 Perform such additional duties and functions relating to the Sesquicentennial as may be delegated or required by the City Council from time to time. .100 Sunset of Commission. The Sesquicentennial Commission shall be deemed dissolved, and this Section shall be of no further force or effect, at the end of the business day on December 31, 2007." SECTION 2. SEVERABILITY The City Council of the City of Anaheim declares that should any section, paragraph, sentence or word of this ordinance hereby adopted be declared for any reason to be invalid, it is the intent of the Council this it would have passed all other portions of this ordinance independent of the elimination herefrom of any such portion as may be declared invalid. 14 THE FOREGOING ORDINANCE is approved and adopted by the City Council of the City of Anaheim this 10 day of June , 2003.
