OF ANAHEIMANDTHEREIN M- LATING THE USE OF' D<, HEICTHT OF BUILDINGS AND YARD SPACES3 ADOPTING A MAP SHOWING THE BOUNDARIES OF SAID ZONES DEFINING THE TERMS USED THEREIN; PROVIDING FOR ADJUSTMENT,AMEND- MENT AND MWORCEFMf PRESCRIBING PENALTIES FOR VIOLATION AND REPEALING ALL SECTIONS OR PARTS OF SECTIONS IN CONFLICT 'THEREWITH. !"HE.CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: WHE1 S9 the City Planning Commission of the City of Anaheim did heretofore duly pass and adopt a resolution declaring Its intention to change the boundaries of the zone or zanes herein- after mentioned and described and did fix a time and place for the holding of a. public hearing .thereara In the manner and as prescribed In Article IX, Chapter 2 of the Anaheim Municipal Code and did duly hold and conduct said public hearing to consider such proposed change of zone or zones, and did receive evidence and reports from persons interested therein, and did recommend a change or changes of zones as set, forth in Resolution No. - 153-Seri.ed 1958®59 of the City Planning Commission; and WHEREAS, upon receipt of the report and recommendation of the City Planning Comm£ssi,on, the City Council did fix the 3rd day of March , 19q as the 'time, and the Council. Chamber° int e C y of the City of Anaheim as the place, for a public hearing upon said proposed change or changes of zone; and did give notice thereof in the manner and as provided in said Article IX, Chapter 2 of the Anaheim Municipal Code; and - .WHEREAS, at the time and place fixed .for said public hearing the City Council did hold and conduct such public hearing and did give all persons Interested therein an opportunity -to be heard and did receive evidence and reports,,and did thereupon consider the recommendations of the City Planning Commission, and did kbmompm adopt Resolution No.o 5117 finding and determining that a change or c angel of Zone s ou d e made as set forth in said resolution. NOW, THEREFORE9 THE CITY COUNCIL OF THZ CITY OF ANAHEIM TOES ORDAIN AS FOLLOWS.- SECTION OLLOWSa SECTION 10 That Article IX, Chapter 2 of the Anaheim Municipal Code establishing zones in the City of Anaheim and therein regulating the use of land, height of buildings and yard spaces- adopting a map showing the boundaries of said zone, defining the terms used in said Article and Chapter* providing for amendment and enforce ment thereof; prescribing penalties for violation and repealing all sections or parts of sections in conflict therewith' be,. and the same is hereby, amended by changing the boundaries of the zones • set forth in said Article IXC Chtpter° 2 by adopting a sectional Zoning Map or Maps showing such change or changes as folloars8 That all of the area, situated In the City of Anaheim, County of Orange, State of Cal ifor°nia$ described as follows, to ,wito -la LV -XP -5--5P,s--? A Mg; excepting therefrom that portion lying North of a line parallel with and distant 666.00 feet South of the North line of said East-! of the Northeast 4 of the Southeast 4 of Section 12. Excepting therefrom a strip of land described as follows: Commencing at a point of the South line of the East a of' the Northeast 4 of the Southeast 4 of said Section 12, distant 210 feet West from the East line . of said Section 12; running thence North parallel with the East line of said Section 12, 22 feet; thence West at right angles 60 feet; thence South parallel with the East line of said Section 12,-22 feet; thence East 60 feet to the point of beginning, now is Zone R -A RESIDENTIAL -AGRICULTURE ZONE, and that it be changed to and incorporatdd'.in_ :3 MULTIPLE= -FAMILY RESIDENTIAL ZONE, UPON THE FOLLOWING CON- DITIONS: 1. That the owners of subject property place of record Standard City of Anaheim R-3 Deed Restrictions, approved by the City Attorneys which restrictions shall limit all dwellings erected on the subject property to one story in height. 2. That the owners of subject property pay to the City of Anaheim the sum of $2 per front foot for street lighting purposes. 3. That the owners of subject property pay to the City of Anaheim the sum of $25 per family unit for the acquisi- tion of park and recreational sites. 4. That the owners of subject property deed to the City of Anaheim a strip of land 53 feet in width from the center line of the street, along Magnolia Avenue, for street widening purposes. 5. That all engineering requirements of the City of Ana- heim, along Magnolia Avenue, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other pertinent work, be complied with as required by the City Engineer and in accordance with standard plans and specifications on file in the office of said- City aidCity Engineer. 6. That all buildings erected on subject property be con- structed substantially in accordance with the plans on file with the City of Anaheim; and that car ports with 9 -fob parking spaces be permitted. 7. That the requirement of an alley along the west boun- dary of the proposed development be waived. • SECTION 2 The City Zoning Map shall be, and the same is hereby, amended, and the pro- perty above described shall be excluded from the zone in which it is now sit- uated, and incorporated in and made a part of the zone or zones- as above set forth and said City Zoning Map as amended is hereby adopted and the City -2- Engineer is hereby directed to prepare a sect ionAl°.mouingi.nap' to' be--add8W to the City Zoning Map and inserted in the Anaheim Municipal Code showing the changes hereby approved and. adopted. SECTION 3 The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be printed once within fifteen (15) days after its adoptions in the Anaheim Gazette, a newspaper of general circulation, printed, published and circulated in said City, and thirty (30) days from and after its final passage it shall take effect and be in full force.
