1220 ORDINANCE NO. 1220 • AN ORDINANCE OF THE CITY OF ANAHEIM AMEND- ING ARTICLE VI, CHAPTER 1, SECTION 6100.52 OF THE. ANAHEIM MUNICIPAL CODE. . THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1 . That Article VI, Chapter 1, Section 6100.52 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows : SECTION 6100.52. SOLICITORS, LICENSE REQUIRED. Every individual engaged in the business of solicit- ing in person, by telephone or by any other means of communication, the retail sale of any goods, wares, merchandise, services, or other things of value for future delivery, not otherwise licensed under the provisions of this Code and not having a regularly established place of business within the City, shall first procure a license and pay a license fee as follows : A. INDIVIDUAL SOLICITOR'S LICENSE. ( 1 ) Fifty Dollars ($50) per year unless the person or persons for whom he is solicit- ing have a principalis solicitor 's license as provided in Subdivision "B." (2) Two Dollars ($2) per year if the person, persons, firms or corporations for whom he is soliciting have a principal 's solicitor 's license as provided in Sub- division UB" hereof. B. PRINCIPAL'S SOLICITOR'S LICENSE. Every person, firm or corporation, either em- ploying or contracting with one or more individuals to have such individuals solicit the retail sale of any goods, wares, merchan- dise, services, or other things of value for future delivery, not otherwise licensed under the provisions of this Code and not having a regularly established place of business within the City, shall obtain a principal 's solici- tor 's license and pay a license fee of $250 4110 annually, in advance. -1- The City Treasurer shall not issue such license until the, applicant files with the City Treasurer a list of all solicitors employed by theappli- cant or with whom the applicant has contracted, ® and a signed agreement that the applicant, within five (5) days thereafter , will notify the City Treasurer in writing of every change in personnel of those soliciting for him. C. CLASSIFICATION OF SOLICITORS. The classification herein whereby a different license fee is exacted for a solicitor having no established place of business within the City and not otherwise licensed under any other pro- vision of this Code is hereby found and de- termined to be a fair and reasonable distinction and not oppressive or unreasonable for the follow- ing reasons: (1 ) The solicitor without an established place of business within the City is not required to pay property taxes or other costs of municipal government which are borne by local businesses. (2) The expense of policing and regulating so- licitors from without the City is proportion- ately greater than that for local businesses. (3) Retail Sales Taxes are normally lost to the City on sales of solicitors from without the City and, therefore, result in a considerable loss of revenue to the City from that source. SECTION 2. A. violation of any of the terms orprovisions of the foregoing section is hereby declared to be a misdemeanor , and each day the terms or provisions hereof are violated shall constitute a separate offense. Each person, firm or corpora- tion violating the terms or provisions of the foregoing section shall be fined not less than $10 for each day of violation nor more than $500, or imprisonedfor not more than 90 days, or may be punished by both such fine and imprisonment; and the license issued to such person, firm or corporation may, at the discre- tion of the Court, be forfeited or suspended for such period of time as the Court shall determine to be reasonable and proper. SECTION 3® This ordinance i's;hereby declared to be an urgency ordinance and its enactment as an urgency ordinance is neces- sary for the protection of the public welfare and the prompt, efficient and expeditious performance of the functions of the City Government, and it shall take effect immediately upon its final passage. • The facts constituting such urgency are as follows : Section 6100.52 of the Anaheim Municipal Code, which has been inforce for many years, has been found to be im- practicable for the regulation and control of solicitors within the City of Anaheim; that owing to the rapid growth of the City -2- and the increase in population, the requests for licenses to solicit for the sale of merchandise, services and other things of value within the City have greatly increased and have imposed an undue burden upon the office of the City Treasurer of the City of Anaheim and upon various other ® officers of the City; that the amendment to said . section providing for annual license fees, as herein provided, will greatly facilitate the regulation of solicitors and the enforcement of provisions of the Municipal Code relating thereto and will promote the general welfare. SECTION �� The City Clerk shall certify to the passage of this ordinance and shall cause the same to be printed once with- in fifteen ( 15) days after its adoption in the Anaheim Bulletin, a newspaper of general circulation, printed, published and circulated in said City, and immediately upon and after its final passage it shall take effect and be in full force.
