5890ORDINANCE NO. 5890 AN ORDIINi3NCE OF THE CITY OF ANAHEIM REPEALING AND ADDING CERTAIN SECTIONS TO CHAPTER 1.04 Of TITLE 1 OF THE ANAHEEM NFJ?�ICTPAL CODE RELATING TO CITY BOARDS AND COMMISSIONS THE CITY COUNCIL OF THE CITY OF A;NAHELM DOES ORDAIN AS FOLLOWS: SECTION 1. That Sections 1.04.500, 1.04.510, 1.04.520, 1.04.530, 1.0,1.540, 1.64.550 and 1.04.560 of Chapter 1.04 of Title 1 of the Anaheim Municipal Code be, and the sane are hereby, repealed. SECTION 2. That new Sections 1.04.500, 1.04.510, 1.04.520, 1.04.530, 1.+34.540, 1.04.550 and 1.04.560 be, and the same are hereby, added to Chapter 1.04 of Title 1 of the Aiialieim Municipal Code to read as follows: "1.04.500 HOUSING AND COMMUNITY DEVELOPMENT CON.NI SSIO . There is hereby established the Housing and Commcnity Commission in accordance with the applicable provisions of the Housing _ u'dn : ri ies (commencing with Section 34200 of the Health and Safety Code) of the State of C'",liAio vnia and subject to the applicable restrictions contained therein. The Hol.ising and C',»nn-►urity Developinent Commission shall not be deemed the commission referred to and b,, Part 1.? of Division 24 (comfnencing with Section 341.00) of the Health and Safety Code, of the State of California. 1.04.51.0 COMMISSION MEMB RSHIP AND TER.NIS. .010 The Housing and Community Development Cominussion shall c>`nsist of seven members, at least two of whom shalt be tenant met.nbers consistent -,v.titn the Authorities Law, and none of whom shall hold any paid office or c uiploy_ milt, ir, the ('ity govcrntnernt and each of whom shall comply wiih the applicable pri0visicn_ of tl:e Housing Authorities Law. .020 The members of tlic Housing and Community l)cvelopmcrit ( omni scion shall be appointed by the City Council frorn the qualified electors of the City and siaall be subject to removal by motion of the City Cour_cii duly adopted by the affirmative vo'es of a, majority of the total membershin thereof. The members of the Com-niission shall be appointed as follows: .0201 One member who is a resident of the West Anaheim Neighborhood Council area shall be appointed; .0202 One member who is a resident of the East Anaheim Neighborhood Council area shall be appointed; .0203 One member who is a resident of the Central Anaheim Neighborhood Council area shall be appointed; .0204 One member who is a resident of the South Anaheim. Neighborhood Council area shall be appointed; and 0205 Three at -large members shall be appointed. Boundaries, membership qualifications and governance of the Neighborhood Councils referred to herein shall be as set forth in the Citizen Participation Plan approved by the City Council in accordance with applicable regulations of the United States Department of Housing and Urban Development, or as may otherwise be determined from time to time 0y the City Council. .030 Each member of the Commission shall serve for a term of four Years and until his or her successor is appointed and qualified. Terms of members shall be staggered so that the terms of two members shall expire on the thirtieth day of June of each yeaj: except f'or each fourth year when the terms of one mernbcr shall expire or. the thirtieth day of June of :_>uch year. .040 A vacancy occurring before expiration of the term of a C 'on"imission member shall be filled by appointinent by the City Council, in the salve manner as provided in subsection .020 above, for the remainder of the unexpired tern. 1.04.520 ORGANIZATION AND MEETINGS. The Commission shall, at its first regular meeting on or after .fuly 1st of each year, elect a Chair and Vice -Chair in accordance with the provisions of Section 904 of the City Charter. The Conunission shall meet at least four times each calendar year. A regular meeting time may be established by the Commission through its bylaws. A majority of the rnembers of the Commission shall constitute a quorum. A majority of the quorum present and qualified to vote shall be required to approve any action or motion of the Commission. 1.04.530 POWERS AND DUTIES. The Housing and Community Development Commission shall have, the power and duty to: .010 Conduct and carry out such functions as are prescribed by the Housing Authorities Law. N .020 Perform such functions and duties as prescribed in the Citizen Participation Plan adopted by the City Council pursuant to regulations promulgated by the United States Department of Housing and urban Development. .030 Conduct and carry out such advisory functions as assigned by, and make recommendations to, the City Council relating to matters of community development. .040 Perform such other advisory functions, if any, as may be assigned from time to time by the City Council. 1.04.540 COMPENSATION AND REIMBURSEMENT OFEXPENSES. Members of the Housing and Community Development Commission shall serve with compensation commensurate with the compensation of the member„ of the Anaheim Planning Commission and shall be reimbursed for travel and subsistence expenses incurred in the performance of their duties while away from the City of Anaheim in accordance with Council policy and to the extent that appropriations for such compensation and travel allowance have beedorovided by the City Council 1.04.550 APPROPRIATIONS. The City Council shall annually, or from time to tHne, (appropriate to the Commission such sum or sums of money as, in the opinion of tbFe C'i'ty Coan d, a; -e necessary to carry out the purposes of the Commission.. 1.04.560 RULES AND BYLAWS. The Commission may adopt rules of order ardicr bylaws relating to, its meetings provided that any such rules or bylaws shall require the approval of rhe 'City Council." SECTION 4. OPERATIVE DATE; APPOINTMENT OF MEMBERS. This ordinance shall become operative on December 1, 2003. The members of the Redevelopment and Housing Commission serving on the date this ordinance is adopted shall continue to serve in such capacity through November 30, 2003, E.nless prior removed by any other action of the City Council. The Redevelopment and Housing Commission shall be deemed dissolved without further action of the City Council effective upon the operative date of this ordinance. The City Council shall appoint seven members of the Housing and Community Development Commission to confonn to the requirements of this ordinance who shall begin service on tl;e operative date hereof, or upon the date of their respective appointments and qualification, whichever date is later. 3 7' SECTION 4. SEVERABILITY The City Council of the City of Anaheim declares that should any section, paragraph, sentence or, word of this ordinance hereby adopted be declared for any reason to be invalid, it is the intent of the Council this it would have passed all other portions of this ordinance: independent of the elimination herefrorn of any such portion as may be declared invalid. SECTION 3. SAVINGS CLAUSE Neither the adoption of this ordinance nor the repeal or amendment of any other ordinance of this City shall in any manner affect the prosecution kir violations of ordinances, wlZich violations were committed prior to the effective date thereof, nor be construed as a waiver of any tax, license or penalty or of the penal provisions applicable to any violations thereof. The provisions of the ordinance, insofar as they are substantially the same as ordinance provisions previously adopted by the City relating to the same subject matter, shall be construed as restatements and continuations, and not as new enactments.
