6471ORDINANCE NO. 6471 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AMENDING SECTION 1.04.970 OF CHAPTER 1.04 OF TITLE 1 OF THE ANAHEIM MUNICIPAL CODE AMENDING THE STRUCTURE AND TERM, INCLUDING THE ALLOWANCE OF A "COMMITTEE OF THE WHOLE" IN THE ABSENCE OF A QUORUM NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1: That section 1.04.970 of Chapter 1.04 be amended to read in full as follows: 1.04.970 ANAHEIM YOUTH COMMISSION. .010 Establishment. The Anaheim Youth Commission is hereby established pursuant to Section 900 of the Charter of the City of Anaheim. .020 Composition. The Anaheim Youth Commission shall consist of fourteen (14) members appointed by the City Council. Individuals appointed shall be between the ages of 14 and 21. .030 Appointment. The Mayor and each City Council member shall directly nominate two (2) members to the Youth Advisory Commission. Once nominated, individuals shall be selected for appointment by a majority vote of the City Council. .040 Qualifications. Each member of the Youth Commission shall be between the ages of 14 and 21, be a resident of the City of Anaheim at the time of appointment and during the entire tenure of service on the Commission, and shall not hold any paid office or employment in the City government. Members who are high school students must have and maintain a grade point average of 2.0 or higher. All prospective members of the Commission under the age of eighteen (18) shall provide, as part of their application materials, written proof of parental or guardian permission to qualify for appointment. .050 Term of Office. Each member of the Youth Commission shall serve a term of two (2) years, or until his or her respective successor is appointed, beginning September 1 st of year one; provided however that each Commission member's term shall automatically expire on his or her twenty second birthday. .060 Unscheduled Vacancies. Any vacancy occurring before the expiration of the term of a Commission member shall be filled by appointment for the remainder of such term. The vacancy shall be filled by the nomination of the elected official who nominated the member at a public meeting. Once nominated, individuals shall be selected for appointment by a majority vote of the City Council. .070 Organization, Meetings and Procedures. .0701 The Youth Commission shall elect one of its members as a chairperson, which chairperson shall preside at meetings of the Commission and shall serve at the pleasure of the Commission. The Commission shall also elect one.of its members as a vice-chairperson on an annual basis, which vice-chairperson shall preside at meetings from which the chairperson is absent. .0702 The Youth Commission shall meet regularly at least on a monthly basis during the months of September through June and shall hold such other meetings as from time to time shall be called in the manner and form required by law. Meetings shall be conducted in accordance with Section 904 of the Anaheim City Charter. Regular meeting dates and times shall be established by the Commission. A majority of the total number of members of the Commission then in office shall constitute a quorum. .0703. A majority of the total authorized membership of the Commission constitutes a quorum for the transaction of business. All acts of the body shall require either the affirmative vote of a majority of its total authorized membership or the affirmative vote of the majority of the members present so long as a quorum is present. At any regularly called meeting not held because of the lack of a quorum, the members present may constitute themselves a "committee of the whole" for the purposes of discussing matters on the agenda. The committee of the whole shall automatically cease to exist if a quorum is present at the meeting. .0704 The meetings and procedures of the Youth Commission shall be subject to and governed by the resolutions and ordinances of the City Council establishing rules and regulations for City boards and commissions. .080 Powers and Duties. The Youth Commission shall act in an advisory capacity and shall have the power and duty to: .0801 Advise the City Council on the needs, assessments, priorities, and interests of the children and youth of Anaheim; .0802 On an annual basis, provide the City Council with recommendations on: (i) events, programs, policies initiatives and projects that would further the goals of the Commission and/or the interests of the children and youth of Anaheim; and (ii) actively promote and participate in youth-related programs and events and provide policy priorities for youth- related initiatives to guide the City's annual budget process; and .0803 Perform such additional functions as may be delegated or required by the City Council from time to time. .090 No Compensation. Members of the Anaheim Youth Commission shall serve without compensation. SECTION 2. The City Clerk shall certify to the passage of this ordinance and shall cause the same to be printed once within fifteen (15) days after its adoption in the Anaheim Bulletin, a newspaper of general circulation, published and circulated in the City of Anaheim, and thirty (30) days from and after its final passage, it shall take effect and be in full force. SECTION 3. The City Council of the City of Anaheim hereby declares that should any section, paragraph, sentence or word of this ordinance of the Code, hereby adopted, be declared for any reason to be invalid, it is the intent of the Council that it would have passed all other portions of this ordinance independent of the elimination herefrom of any such portion as may be declared invalid.
