AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM REPEALING CHAPTER 15.03 AND ADDING NEW
CHAPTER 15.03 TO TITLE 15 OF THE ANAHEIM MUNICIPAL
CODE PERTAINING TO THE CALIFORNIA BUILDING
STANDARDS CODES
WHEREAS, every three years the California Building Standards Commission compiles
and publishes the adoptions, amendments and repeal of administrative regulations to Title 24 of
the California Code of Regulations, also referred to as the "California Building Standards Code";
and
WHEREAS, the California Building Standards Commission has promulgated the 2019
editions of the California Building Code, the California Residential Code, the California
Plumbing Code, the California Mechanical Code, the California Electrical Code, the California
Green Building Standards Code, the California Energy Code, the California Existing Building
Code, and the California Green Building Standards Code (hereinafter referred to collectively as
"Codes"); and
WHEREAS, the State of California does not adopt the Scope and Administration Section,
Chapter 1, of the International Building Code to allow each local City to do so and modify to
their local conditions; and
WHEREAS, local agencies are mandated toinose essentially the same requirements as
are contained in the Codes; and
WHEREAS, the Codes are designed to be adopted by reference by local agencies as
enforceable regulations with such modifications or changes as local agencies find and determine
are reasonably necessary because of local climatic, geological or topographic conditions; and
WHEREAS, California Health and Safety Code Section 17958.7 requires that the City
Council, before making any modifications or changes to the Codes, shall make an express
finding that such changes or modifications are reasonably necessary because of local climatic,
geological or topographical conditions; and
WHEREAS, the Building Official has recommended that the Codes be adopted by
reference with such changes and modifications thereto as are set forth in this Ordinance, which
are reasonably necessary due to the following local conditions in the City of Anaheim:
A. Climatic Conditions
1. Hot, dry Santa Ana winds are common to all areas within the City of Anaheim. These
winds, which can cause small fires which spread quickly, are a contributing factor to the
high fire danger in the area, and create the need for an increased level of fire protection.
This added protection will supplement normal fire department response available and
provide immediate protection for life and safety of multiple occupancy occupants during
fire occurrences.
2. Orange County and the City of Anaheim are located in a semi-arid Mediterranean type
climate which predisposes all fuels, including wood shingles to rapid ignition and spread
of fire. Therefore, there exists a need for additional fire protection measures.
3. The warm, dry climate is conducive to swimming pools which creates a higher
probability of child drowning where pools are unprotected.
B. Geological Conditions
1. The City of Anaheim and the greater Los Angeles region is a densely populated area
having buildings and structures constructed over and near a vast array of fault systems
capable of producing major earthquakes, including but not limited to the recent 1994
Northridge Earthquake. The proposed modification emphasize that the design concern is
for seismic-force-resisting elements and therefore need to be incorporated into the code to
assure that new buildings and structures and additions or alterations to existing buildings
or structures are designed and constructed in accordance with the scope and objectives of
the International Building Code. Experts predict a major earthquake in our area within
the next 50 years. This situation creates the need for both additional fire protection
measures and automatic on-site fire protection of building occupants since a multitude of
fires may result from breakage of gas and electric lines as a result of an earthquake.
2. Traffic and circulation congestion presently existing in the City of Anaheim often
places fire department response time to fire occurrences at risk. This condition will be
exacerbated by any major disaster, including any earthquake wherein damage to the
highway system will occur. This condition makes the need for additional on-site
protection for property occupants necessary.
3. Placement of multiple occupancy buildings, location of arterial roads, and fire
department staffing constraints due to recent revenue-limiting state legislation have made
it difficult for the fire department to locate additional fire stations and provide manpower
sufficient to concentrate fire companies and personnel to control fires in high density
apartment or condominium buildings. These conditions create the need for built-in onsite
fire protection systems to protect occupants and property until fire-fighting apparatus and
personnel arrive on the scene.
The City of Anaheim is located in an area subject to a climatic condition of high winds
and low humidity. This combination of events creates an environment which is conducive
to rapidly spreading fires. Control of such fires requires rapid response. Obstacles
generated by a strong wind, such as fallen trees, street lights and utility poles will greatly
impact the response time to reach an incident scene.
The City of Anaheim is located in the middle of a seismically active area. The viability of
the public water system would be questionable at best after a major seismic event. This
would leave very large buildings vulnerable to uncontrolled fires due to a lack of

available water and an inability to pump sufficient quantities of any available water to
fight a fire. A severe seismic event has the potential to negatively impact any rescue or
fire suppression activities because it is likely to create obstacles similar to those indicated
under the high wind section above. With the probability of strong aftershocks, there
exists a need to provide increased protection for safety against structure fires.
4. Untreated wood roofs cause or contribute to serious fire hazard and to the rapid spread
of fires when such fires are accompanied by high winds. Pieces of burning wooden roofs
become flying brands and are carried by the wind to other locations and thereby spread
fire quickly.
C. Topographic Conditions
1. The City of Anaheim is in an area with a high percentage of structures on hillsides.
Access for fire or rescue response and staging for firefighting are made difficult due to
the terrain.
Amendments to the 2019 Editions of the California Codes are found reasonably necessary based
on the climatic, geological and topographic conditions cited above and are listed as follows:

Additional amendments made to the Codes, as set forth in this Ordinance, are hereby found to be
either administrative or procedural in nature or concern themselves with subjects not covered in
the Codes. The changes made include provisions making each of the Codes compatible with
other codes enforced by the City.
THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS:
SECTION 1.
Chapter 15.03 of Title 15 of the Anaheim Municipal Code be, and the same is hereby,
repealed.
SECTION 2.
That new Chapter 15.03 of Title 15 of the Anaheim Municipal Code be, and the same is
hereby added,to the Anaheim Municipal Code to read in full as follows:

15.03.010 ADOPTION OF BUILDING STANDARDS CODES.

.010 Pursuant to Section 50022.1 et seq. of the California Government Code and Section
513 of the City Charter, the City Council of the City of Anaheim does hereby adopt, by reference,
the following California Building Codes, subject to the amendments set forth in this chapter:
.0101 The 2019 Edition of the California Building Code (which is based on the
2018 International Building Code as published by the International Code Council, including
Chapter 1, Division II). The provisions of the California Building Code shall apply to all
buildings and structures other than those meeting the scoping limitations contained in the
California Residential Code.
.0102 The 2019 Edition of the California Residential Code (which is based on the
2018 International Residential Code). The provisions of the California Residential Code shall
apply to detached one and two family dwellings and multiple single-family dwellings
(townhomes) not more than three stories above grade plane in height with a separate means of
egress and their accessory structures.
.0103 The 2019 Edition of the California Electrical Code ( which is based on the
2017 National Electrical Code as published by the National Fire Protection Association). The
provisions of the California Electrical Code shall apply to the installation of electrical systems,
including alterations, repairs, replacement, equipment, appliances, fixtures, fittings and
appurtenances thereto.
.0104 The 2019 Edition of the California Mechanical Code (based on the 2018
Uniform Mechanical Code as published by the International Association of Plumbing and
Mechanical Officials). The provisions of the California Mechanical Code shall apply to the
installation, alterations, repairs and replacement of residential and commercial mechanical and
gas systems, including equipment, appliances, fixtures, fittings and for appurtenances, including
ventilating, heating, cooling, air-conditioning and refrigeration systems, incinerators and other
energy-related systems. Where there is a conflict between the California Mechanical Code and
the California Plumbing Code, as related to the chapters pertaining to fuel gases, the provisions
provided in the California Plumbing Code shall prevail.
.0105 The 2019 Edition of the California Plumbing Code (based on the 2018
Uniform Plumbing Code as published by the International Association of Plumbing and Mechanical
Officials). The provisions of the California Plumbing Code shall apply to the installation,
alteration, repair, replacement of plumbing systems and gas delivery systems, including
equipment, appliances, fixtures, fittings and appurtenances, and where connected to a water or
sewage system and all aspects of a medical gas system. The provisions of the California
Plumbing Code shall apply to private sewage disposal systems.
.0106 The 2019 Edition of the California Energy Code. The provisions of the
California Energy Code, Title 24, Part 6 shall apply to all matters governing the design and
construction of buildings for energy efficiency.

.0107 The 2019 Edition of the California Historical Building Code. The provisions
of the California Historical Building Code shall apply to the alteration and repair of recognized
historical buildings.
.0108 The 2019 Edition of the California Existing Building Code(which is based on
the 2018 International Existing Building Code). The provisions of the California Existing
Building Code shall apply to maintenance of existing buildings.
.0109 The 2019 Edition of the California Green Building Standards (which is
known as the CALGreen Code). The mandatory provisions of the California Green Building
Standards Code shall apply to all buildings and structures.
.0110 The 2019 Edition of the California Referenced Standards Code. The
provisions of the California Referenced Standards Code shall apply to all buildings and
structures, as outlined in the Code.
.0111 The 1997 Edition of the Uniform Code for the Abatement of Dangerous
Buildings, as published by the International Conference of Building Officials.
.0112 Scope and Administration Section, Chapter 1, of the 2018 Edition of the
International Building Code will replace all Administration Sections and Chapters of all Codes
and Standards adopted.
.020 The Codes set forth in this section shall be collectively referred to and may be cited
collectively as the "Building Standards Codes," and, individually, as the Anaheim Building
Code, the Anaheim Residential Code, the Anaheim Electrical Code, the Anaheim Mechanical
Code, the Anaheim Plumbing Code, the Anaheim Energy Code, the Anaheim Historical Building
Code, the Anaheim Existing Building Code, the Anaheim Green Building Standards Code, the
Anaheim Referenced Standards Code, the Anaheim Code for the Abatement of Dangerous
Buildings, and the Anaheim Swimming Pool and Spa Code. The provisions of the Building
Standards Codes, as amended by this chapter, shall constitute the building regulations of the City
of Anaheim. Provisions in the appendices of the Building Standards Codes shall not apply
unless specifically adopted.
.030 In accordance with Health & Safety Code § 18942(e)(1), one (1) copy of all of the
above Building Standards Codes shall remain on file in the office of the City of Anaheim Building
Division and are available for public inspection during normal business hours.
.040 The provisions of the Building Standards Codes shall apply to the construction,
alteration, movement, enlargement, replacement, repair, equipment, use, occupancy, height,
location, maintenance, removal, conversion, demolition, and area of every building or structure
or any appurtenances connected or attached to such buildings or structures.
.050 The purpose of the Building Standards Codes is to establish the minimum
requirements to safeguard the public health, safety and general welfare through structural
strength, means of egress facilities, stability, sanitation, adequate light and ventilation, energy
conservation, and safety to life and property from fire and other hazards attributed to the built

environment and to provide safety to firefighters and emergency responders during emergency
operations.
15.03.020 Amendment to Chapter 1 of the International Building Code.
Scope and Administration Section, Chapter 1, of the 2018 Edition of the International
Building Code will replace all Administration Sections and Chapters of all Codes and Standards
adopted. The Administration Section is hereby amended, modified and supplemented by the
addition and application of the provisions of Section 15.03.020 of this Code.
.01 Phase approval. The Building Official may also allow the phased project that may
span a new Code adoption for consistency to retain on the existing Code edition from the first
substantial submission, so that the full project may be completed under one Code edition.
.0107 Definition of terms. Whenever any of the following names or terms are
used in the Building Standards Codes; including all indices and amendments, or in the Anaheim
Municipal Code, such names or terms shall be deemed and construed to have the name ascribed
to it in this section, as follows:
A. "Building Division" means the Building Division of the Planning Department
of the City of Anaheim; and
B. "Health office or Health Department" means the Orange County Department of
Health Services.
.0108 Resolution of conflicts in application. In the event of any conflict or
ambiguity between any provision contained in the California Codes and any amendment or
addition thereto contained in this title, the amendment or addition thereto shall control.
15.03.030 AMENDMENTS TO THE CALIFORNIA BUILDING CODE
The 2019 Edition of the California Building Code is amended as set forth in this section:
.010 Chapter 1, Division II is hereby recommended to be adopted. Chapter 1, Part 1 and
Part II of the 2018 edition of the International Building Code are hereby substituted in its place.
.020 Insert City of Anaheim into the text as the name of the jurisdiction in Section
Paragraph 101.1 of Section 101 of Division II of Chapter 1.
.030 Paragraph 101.4 of Section 101 of Division II of Chapter 1 is deleted in its entirety
(including sections 101.4.1, 101.4.2, 101.4.3, 101.4.4, 101.4.5, 101.4.6 and 101.4.7), and replaced
with the following:
101.4. Referenced Codes. The California Codes listed in Section 1 of this Ordinance
shall be considered part of the requirements of this code to the extent of each such
reference.

.040 Subsection 105.2 of Section 105 of Division II of Chapter 1 is revised by amending
exception 9, and adding 14 as follows:
9. Prefabricated swimming pools accessory to a Group R-3 occupancy that are
less than 18 inches (457.2 mm) deep, do not exceed 5,000 gallons (18,927.059L) and
are installed entirely above ground.
14. Decks not exceeding 200 square feet (18.58 m2) in area, that are not more
than 30 inches (762 mm) above grade at any point, are not attached to a dwelling and
do not serve the exit door required by Section R311.2.
.050 Subsection 105.5 of Section 105 of Division II of Chapter 1 is amended as follows:
105.5 Expiration. Every permit issued shall become invalid unless the work on the
site authorized by such permit is commenced within 12 months after its issuance, or if the work
authorized on the site by such permit is suspended or abandoned for a period of 180 days after the
time the work is commenced. The building official is authorized to grant, in writing, one or more
extensions of time, for periods not more than 180 days each. The extension shall be requested in
writing and justifiable cause demonstrated.
Time limitation for permit expiration as the result of code enforcement shall be as per notice of
violation or as otherwise determined by the Building Official.
.060 Subsection 107.3 of Section 107 of Division II of Chapter 1 is revised to add a
paragraph as follows:
An expedited review and permit issuance process shall be provided for EV Charging
Stations and simplified forms for submittal will be made available on City's website.
.070 Subsection 113.3 of Section 113 of Division II of Chapter 1 is amended to provide
as follows:
Board of Appeals. Board of Appeals when used in the Building Standards
Codes shall mean the City Council {or Planning Commission}. The Board of Appeals is hereby
established for each of the Building Standards Codes. Depending on the subject of the appeal,
specialized expertise maybe solicited for the purpose of providing input to the Appeals Board.
.080 Table 1505.1 of Section 1505 of Chapter 15 is revised to read in full as follows:

foundation walls shall not be used for structures assigned to Seismic Design Category D, E or F.
.110 Subsection Section 3109.2 of Section 3109 of Chapter 31 is amended as follows:
3109.2 Construction permit; safety features required. New or remodel pools
or spas, at a private single-family home, shall have an enclosure complying with the amended
California Residential Code Appendix V
15.03.040 AMENDMENTS TO THE CALIFORNIA RESIDENTIAL CODE
The 2019 Edition of the California Residential Code is amended as set forth in this section:
.010 The Anaheim Residential Code is hereby amended, modified and supplemented by
the addition and application of the provisions of Section 15.03.040 of this Code.

a. Weathering may require a higher strength concrete or grade of masonry than necessary to satisfy the
structural requirements of this code. The weathering column shall be filled in with the weathering index
(i.e., "negligible," "moderate"or"severe")for concrete as determined from the Weathering Probability
Map [Figure R301.2(3)]. The grade of masonry units shall be determined from ASTM C 34, C 55, C 62, C
73, C 90, C 129, C 145, C 216 or C 652.
b. The frost line depth may require deeper footings than indicated in Figure R403.1(1). The jurisdiction shall
fill in the frost line depth column with the minimum depth of footing below finish grade.
c. The jurisdiction shall fill in this part of the table to indicate the need for protection depending on whether
there has been a history of local subterranean termite damage.
d. The jurisdiction shall fill in this part of the table with the wind speed from the basic wind speed map [Figure
R301.2( 4)].Wind exposure category shall be determined on a site-specific basis in accordance with

to buildings due to topographic wind speed-up effects, the jurisdiction shall fill in this part of the table with
"YES." Otherwise, the jurisdiction shall indicate "NO" in this part of the table.
I. In accordance with Figure R301.2(4)A, where there is local historical data documenting unusual wind
conditions, the jurisdiction shall fill in this part of the table with "YES" and identify any specific
requirements. Otherwise, the jurisdiction shall indicate"NO" in this part of the table. rsi;1
m. In accordance with Section R301.2.1.2.1, the jurisdiction shall indicate the wind-borne debris wind
zone(s). Otherwise, the jurisdiction shall indicate "NO" in this part of the table.
n. The jurisdiction shall use the design criteria in Table 1a or 1 b from ACCA Manual J or established criteria
determined by the Authority Having Jurisdiction .
.030 Subsection R902.1 of Section R902 of Chapter 9 is revised to allow only class A
or B roofs as follows:
R902.1 Roofing covering materials. Roofs shall be covered with materials as set forth
in Sections R904 and R905. A minimum Class A or B roofing shall be installed in areas
designated by this section. Classes A or B roofing required by this section to be listed
shall be tested in accordance with UL 790 or ASTM E 108.
Exceptions:
1. Class A roof assemblies include those with coverings of brick, masonry and
exposed concrete roof deck.
2. Class A roof assemblies also include ferrous or copper shingles or sheets, metal
sheets and shingles, clay or concrete roof tile, or slate installed on noncombustible
decks.
.040 Paragraph R902.1.3 of Subsection R902.1 of Section R902 of Chapter 9 is revised
it to require a minimum Class B roof as follows:
R902.1.3 Roof coverings within all other areas. The entire roof covering of every
existing structure where more than 50 percent of the total roof area is replaced within any one-
year period, the entire roof covering of every new structure, and any roof covering applied in the
alteration, repair or replacement of the roof of every existing structure, shall be a fire-retardant
roof covering that is at least Class B.
.050 The first paragraph of Subsection R902.2 of Section R902 of Chapter 9 is revised

to allow only Class A or B treated wood roofs as follows:
R902.2 Fire-retardant-treated shingles and shakes. Fire-retardant-treated wood
shakes and shingles are wood shakes and shingles complying with UBC Standard 15-3 or 15-4
which are impregnated by the full-cell vacuum-pressure process with fire-retardant chemicals,
and which have been qualified by UBC Standard 15-2 for use on Class A or B roofs.
.060 Subsection AV100.2(a) of Section AV100.2 of Appendix V is hereby amended as
follows:
Except as provided in Section AV 100.5, when a building permit is issued for the
construction of a new swimming pool or spa or the remodeling of an existing swimming pool or
spa at a private single-family home, the respective swimming pool or spa shall be equipped with
item#1 below AND at least one additional following seven drowning prevention features.
.070 Paragraph AV 100.2(a)(1) of Subsection AV100.2(a) of Appendix V is amended as
follows:
1. An enclosure that meets the requirements of AV 100.3 and isolates the swimming
pool and spa from the private single-family home. Any walls of the residential structure or
accessory structures used to complete the isolation enclosure must have door openings equipped
with protection as required in AV100.2 (a) #4 or#5. Any such door protection device provided
for this purpose may not be used to comply with the second drowning prevention feature
requirement.
15.03.050 AMENDMENTS TO THE CALIFORNIA ELECTRICAL CODE
The 2019 Edition of the California Electrical Code is amended as set forth in this section:
.010 The Anaheim Electrical Code is hereby amended, modified and supplemented by
the addition and application of the provisions of Section 15.03.050 of this Code.
.020 Paragraph 310.106(B) of Section 310.106 of Article 310 of Chapter 3 is amended
by the addition of a second paragraph to read as follows:
Copper wire shall be used for wiring No. 6 and smaller in all installations.
Consideration for use of aluminum wiring can be made by the Building Official for feeder lines
only on an individual basis where adequate safety measures can be ensured.
.030 Article 310 of Chapter 3 is hereby amended, modified and supplemented by the
addition of a new Section 310.121,to read in full as follows:
310.121 Continuous inspection of aluminum wiring. Aluminum conductors of
No. six (6)or smaller used for branch circuits shall require continuous inspection
by an independent testing agency approved by the Building Official for proper
torque of connections at their termination point.

.040 Section 690.13 of Article 690 of Chapter 6 is hereby amended, modified and
supplemented by the addition of a new Section 690.13(A)to read as follows:
(A)Location. The PV disconnecting means shall be installed at a readily
accessible location either on the outside of a building or structure or inside
nearest the point of entrance of the system conductors. A single,visible-open,
lockable AC disconnect shall be within 3 feet of the meter on the exterior
of the building.
15.03.060 AMENDMENTS TO CALIFORNIA MECHANICAL CODE
The 2019 Edition of the California Mechanical Code is amended as set forth in this section:
.010 Chapter 1 is hereby deleted in its entirety and the provisions of Section 15.03.020
(Administrative Provisions)of this Chapter 15.03 are hereby substituted in its place.

15.03.090 AMENDMENTS TO THE CALIFORNIA EXISTING BUILDING CODE
The 2019 Edition of the California Existing Building Code is amended as set forth in this section.
.010 Chapter 1 is hereby deleted in its entirety and the provisions of Section 15.03.020
(Administrative Provisions) of this Chapter 15.03 are hereby substituted in its place.
15.03.100 AMENDMENTS TO THE CALIFORNIA GREEN BUILDING STANDARDS
CODE
The 2019 Edition of the California Green Building Standards Code is amended as set forth in this
section:

.010 The 2019 Edition of the California Green Buildings Standards Code is amended,
modified and supplemented by the addition and application of the provisions of Section
15.03.020 (Administrative Provisions)of this Chapter 15.03.
15.03.110 AMENDMENTS TO THE CALIFORNIA REFERENCED STANDARDS CODE
The 2019 Edition of the California Referenced Standards Code is amended as set forth in this
section:
.010 Chapter 12-1 is hereby deleted in its entirety and the provisions of Section
15.03.020(Administrative Provisions) of this Chapter 15.03 are hereby substituted in its place.
The 1997 Edition of the Uniform Code for the Abatement of Dangerous Buildings, as published
by the International Conference of Building Official is amended as set forth in this section:
15.03.120 AMENDMENTS TO THE CALIFORNIA ABATEMENT OF
DANGEROUS BUILDINGS CODE.
.010 The 1997 Edition of the Uniform Code for the Abatement of Dangerous Buildings,
as published by the International Conference of Building Official is amended, modified and
supplemented by the addition and application of the provisions of Section 15.03.020
(Administrative Provisions) of this Chapter 15.03.
SECTION 3.
The Building Official shall file copies of this Ordinance with the California Building
Standards Commission, as required by Section 17958.7 of the California Health and Safety Code.
SECTION 4. SEVERABILITY.
The City Council of the City of Anaheim hereby declares that should any section,paragraph,
subsection, sentence, clause,phrase or portion of this ordinance hereby adopted be declared for any
reason invalid or unconstitutional by the final judgment of any court of competent jurisdiction, it is
the intent of the City Council that it would have adopted all other portions of this ordinance
independent of the elimination herefrom of any such portion as may be declared invalid or
unconstitutional. The City Council of the City of Anaheim hereby declares that it would have
adopted this ordinance and each section, subsection, sentence, clause, phrase or portion thereof
irrespective of the fact that any one or more sections, subsection, sentence clause, phrases or
portions be declared valid or unconstitutionally.
SECTION 5. SAVINGS CLAUSE; CONTINUITY.
Neither the adoption of this ordinance nor the repeal of any other ordinance of this City
shall in any manner affect the prosecution for violations of ordinances which violations were
committed prior to the effective date hereof, nor be construed as a waiver of any license or
penalty or the penal provisions applicable to any violation thereof. To the extent the provisions of

this Ordinance are substantially the same as ordinance provisions previously adopted by the City
relating to the same subject matter, the provisions of this ordinance shall be construed as
restatements and continuations of those provisions and not as new enactments or amendments of the
earlier provisions.
SECTION 6. INTENT TO COMPLY WITH LAWS.
The City Council intends this Ordinance to supplement, not to duplicate or contradict,
applicable state and federal law, and this Ordinance shall be construed in light of that intent.
SECTION 7. CERTIFICATION; PUBLICATION BY CLERK.
The City Clerk shall certify to the passage of this ordinance and shall cause this ordinance or
a summary thereof to be printed once within fifteen (15) days after its adoption in the Anaheim
Bulletin,a newspaper of general circulation,published and circulated in the City of Anaheim.
SECTION 8. EFFECTIVE DATE.
This Ordinance shall take effect and be in full force thirty(30) days from and after its final
passage.
