THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1: That the owner of the property situated in Anaheim, Orange County, California, and bounded and described as follows; Beginning at the intersection of the monumented center line of North Palm Street with the center line of La Verne Street; thence westerly, along the center line of La Verne Street 734.95 feet; thence northerly, parallel to said center line of North Palen Street, as it exists between West forth Street and West La Palma Avenue, 242.05 feet, more or less, to the westerly prolongation of the southerly line of the parcel of real property conveyed to Anaheim School District of Orange County, California, by deed filed in the office of the Regis- trar of Titles of Orange County, California, under Certifi- cate of Title No. 4151; thence easterly along said southerly line and its prolongations easterly and westerly 736.45 feet, to said monumented center line of North Pala Street; thence southerly along said center line of North Palm Street to the point of beginning. having dedicated certain streets and alleys to the City of Anaheim, finds that due to existing conditions, lots of less area than is required by ordinance are necessary to make economic use of said property. That the owner of the above described property filed a petition with the City Planning Commission requesting a conditional variance. permitting said property to be divided into lots of less area than is required by ordinance on said property, and said Commission has made an investigation of the facts and made its findings in respect to the same, and has determined that existing facts warrant the granting of such conditional variance or exception and has recommended to said City Council that such variance be granted.. SECTION 2. That said City Council hereby, finds from consideration and investigation of the facts and the report of said Planning Commission: (1) Special circumstances do exist in the area described causing pract- ical difficulties in carrying out the lot area provisions of an existing ordinance, (2) A variance or a=ept ion is necessary for the preservation of a sub- stantial property right of the petitioner, (3) The granting of such conditional variance will not be materially trimental to the public welfare or injurious to the property or improvements in the district wherein said property is located.
