ORDINANCE NO. 5691
AN ORDINANCE OF THE CITY OF ANAHEIM
EXEMPTION CERTAIN CONDITIONAL USE PERMIT
APPLICATIONS FROM THE PROVISIONS OF
ORDINANCE NO. 5677
THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS
SECTION 1.
To the extent any provision of Ordinance No. 5677
heretofore adopted by the City of Anaheim on April 6, 1999,
creating the Brookhurst Commercial Corridor Overlay Zone (the
"new regulations"), would otherwise apply to the use of property
and said new regulations contain restrictions or limitations on
the use of property greater than the provisions which existed and
were applicable to the use of property immediately prior to the
date said new regulations became effective (the `prior
regulations"), said prior regulations shall continue to apply
(and said new regulations shall not apply) to any project or use
for which (i) a conditional use permit application was filed with
and accepted by the City of Anaheim prior to April 6, 1999, (ii)
a conditional use permit was finally approved by the City on or
before July 1, 1999, and (iii) the use authorized by said
conditional use permit is conducted in strict conformance with
the terms and conditions of said conditional use permit.
SECTION 2.
The City Council of the City of Anaheim hereby declares
that should any section, paragraph, sentence or word of this
ordinance hereby adopted be declared for any reason to be invalid
or unenforceable, it is the intent of the City Council that it
would have adopted all other provisions of this ordinance
independent of the elimination herefrom of any such portion as
may be declared invalid or unenforceable.
SECTION 3.
Neither the adoption of this ordinance nor the repeal
of any other ordinance of this City Council shall in any manner
affect the prosecution for violations of ordinances, which
violations were committed prior to the effective date hereof, nor
be construed as a waiver of any license or penalty or the penal
provisions applicable to any violation thereof. The provisions
of this ordinance, insofar as they are substantially the same as

ordinance provisions previously adopted by the City relating to
the same subject matter, shall be construed as restatements and
continuations, and not as new enactments.
