4176ORDINANCE NO. 4176 AN ORDINANCE OF THE CITY OF ANAHEIM AMEND- ING TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES FIND THAT: WHEREAS, the City Council did adopt its Resolutions No. 73R-248, 74R-209, 73R-477, 74R-200, 74R-524, and 80R- 478 deter- mining that a change or changes in the zone or zones hereinafter mentioned and described should be made as hereinafter set forth, after duly noticed hearings and receipt of the report and recom- mendation of the City Planning Commission; and WHEREAS, certain conditions and requirements were made as conditions precedent to the making of a change or changes of said zone or zones, which conditions have been complied with. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. That Title 18 of the Anaheim Municipal Code relating to Zoning be, and the same is hereby, amended by changing the boundaries of the zones set forth in said Title 18 by adopting a sectional zoning map or maps showing such change or changes as follows: All that certain property situated in the City of Anaheim, County of Orange, State of California, de- scribed as follows: Beginning at the northwest corner of that certain 1.00 acre parcel of land shown on a Record of Survey filed in Book 13, page 40 of Record of Survey, in the office of the County Recorder of Orange County; thence N 890 54' 00" E, 264.20 feet to an intersection with the westerly line of the land described in deed recorded July 18, 1967 in Book 8314, page 249, Official Records; thence S 001 01' 00" E, 330.05 feet along the west line of the land described in said deed to an intersection with the south line of Tract No. 117, as shown on a map recorded in Book 11, page 15, Miscellaneous Maps, rec- ords of said Orange County; thence East 2,564.39 feet along a portion of the south line of said Tract No. 117 to an intersection with the easterly line of the land as shown on a Record of Survey filed in Book 11, page 39, Record of Survey, in the office of said County Recorder, said line is also shown on a Record of Survey filed in Book 92, page 8, Record of Survey, in the -1- 72-73-51 73-74-22 74-75-14 office of said County Recorder; thence following along the line shown on the Record of Survey filed in Book 92, page 8, above mentioned, the following courses and dis- tances: S 120 44' 38" E, 1,210.83 feet; N 770 15' 22" E, 108.91 feet; S 121 44' 38" E, 226.08 feet; S 160 43' 17" E, 659.11 feet; S 590 43' 27" W, 162.16 feet; S 120 44' 38" E, 859.08 feet to an intersection with the line shown on a Record of Survey filed in book 91, page 40, Record of Survey, in the office of said County Recorder; thence following along the line shown in the last men- tioned Record of Survey, the following courses and dis- tances: S 56° 04' 55" W, 1,521.50 feet; S 291 44' 52" E, 84.16 feet; S 550 20' 10" W, 186.60 feet; N 290 44' 35" W, 86.69 feet; S 560 07' 29" W, 267.03 feet to the point of intersection with the easterly boundary of the Anaheim Hills No. 2 Annexation to said City, said point of inter- section being at the southeasterly terminus of that cer- tain course described in said annexation as having a bearing and distance of S 410 13' 00" E, 874.90 feet; thence following along a portion of the last mentioned annexation boundary, the following courses and distances: N 410 13' 00" W, 874.90 feet; N 700 52' 00" W, 149.49 feet; S 740 08' 20" W, 2,264.30 feet; S 650 40' 40" W, 1,689.20 feet to a point in the southeast corner of the Santa Ana Canyon Annexation No. 1 boundary to said City; thence leaving the said Anaheim Hills No. 2 Annexation boundary and following along a portion of the Santa Ana Canyon Annexation No. 1 boundary the following courses and distances: N 10 27' 02" W, 511.71 feet; N 441 34' 40" W,227.15 feet; N 000 53' 40" W, 312.78 feet; S 620 16' 25" W, 235.85 feet; N 470 07' 05" W, 95.81 feet; S 460 02' 38" W, 49.91 feet; S 50 43' 02" E, 372.00 feet; S 830 43' 58" W, 298.91 feet; N 300 32' 17" W, 273.87 feet; N 40 37' 37" W, 763.61 feet; S 470 25' 17" E, 199.92 feet; N 27° 56' 03" E, 282.63 feet; N 470 56' 300 W, 40.35 feet, more or less; N 110 33' 20" E, 659.21 feet, more or less, to the intersection with the northerly right of way line of the 50 -foot wide right of way which was conveyed to Santa Ana Valley Irrigation Co. by deed re- corded in Book 1536, page 484, Official Records; thence Easterly along said northerly line to the southwesterly corner of that parcel of land conveyed to Raymond L. thence leaving said annexation boundary N 00 01' 00" W, 330.41 feet along the easterly line of the land described in deed re- corded July 18, 1967 in Book 8314, page 249, Official Records of said Orange County, to an intersection with the northerly line of the land described in Parcel One in deed recorded April 8, 1960 in Book 5186, page 123, Official Records of said Orange County; thence W, 763.47 feet along a portion of the south line said Tract No. 117, also being a portion of said Mohler Drive Annexation boundary line to the point of beginning, now is "RS -A-43,000" RESIDENTIAL/AGRICULTURAL ZONE and that it be changed to and incorporated in "RS -HS -22,000" RESIDENTIAL, SINGLE- FAMILY HILLSIDE ZONE, subject to the following conditions: -4- 1. That dedication shall be made to the City of Anaheim of all streets within the area, according to the Circulation Element of the General Plan, Highway Rights -of -Way, prior to issuance of building permits. 2. That all engineering requirements of the City of Anaheim such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work shall be complied with as required by the City Engineer and in accordance with speci- fications on file in the Office of the City Engineer, at the time the property is developed. 3. That the owners of subject property shall install street lighting on all streets within the area as required by the Utilities General Manager at the time the property is developed. 4. That electrical utilities shall be placed underground and dedicated to the City of Anaheim in accordance with the requirements of the Utilities General Manager. 5. That drainage of said property shall be disposed of in a manner satisfactory to the City Engineer. That necessary right-of- way for off-site drainage facilities be dedicated to the City, or that all property owners involved have executed written right-of- way dedication to the City, or that the City Council will have initiated condemnation proceedings for the acquisition of the re- quired drainage right-of-way, the cost of which shall be borne by the developer. The required drainage facilities shall be of a size and type sufficient to carry runoff waters originating from higher properties south of Santa Ana Canyon Road through said property to ultimate disposal as approved by the City Engineer. Said drainage facilities shall be the first item of construction when the property is developed and shall be constructed and shall be functional throughout that portion of the property being developed and from the downstream boundary of the property to the point of ultimate point of disposal prior to the issuance of any final building inspection or occupancy permits. Drainage district reimbursement agreements may be made available to the developers of said property upon their request. 6. That fire hydrants shall be installed and charged as re- quired and determined to be necessary by the Chief of the Fire Department prior to the commencement of structural framing. 7. That prior to approval of a final Tract Map, floor plans and elevations for the proposed houses shall be submitted to and approved by the City Planning Commission. In cases where a parcel map is permitted by law, floor plans and elevations for the pro- posed houses shall be submitted to and approved by the Planning Department prior to issuance of a building permit. -5- SECTION 2. The City Zoning Map shall be, and the same is hereby, amended and the property above-described shall be excluded from the zone in which it is now situated and incorporated in and made a part of the zone or zones as above set forth, and said City Zoning Map, as amended, is hereby adopted and the City Engineer is hereby directed to prepare a sectional zoning map to be added to the City Zoning Map showing the changes hereby approved and adopted. SECTION 3. The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be printed once within fifteen (15) days after its adoption in the Anaheim Bulletin, a newspaper of general circulation, printed, published and cir- culated in said City, and thirty (30) days from and after its final passage, it shall take effect and be in full force.
