4178ORDINANCE NO. 4178 AN ORDINANCE OF THE CITY OF ANAHEIM AMEND- ING THE CONDITIONS OF APPROVAL AS SET FORTH IN ORDINANCE NO. 4069 RELATING TO ZONING. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES FIND THAT: WHEREAS, the City Council did adopt its Resolution No. 79R-50 and 79R-607 determining that a change or changes in the zone or zones therein mentioned and described should be made after duly noticed hearings and receipt of the report and recommendation of the City Planning Commission; and WHEREAS, said Resolution did impose certain conditions and requirements precedent to the adoption of an ordinance chang- ing said zone or zones, which conditions and requirements have been satisfied; and WHEREAS, the City Council has heretofore adopted Ordinance No. 4069 changing said zone or zones on the real property therein described subject to those certain conditions as set forth in said Ordinance; and WHEREAS, the City Council did thereinafter adopt Resolution No. 80R-481 amending the conditions of approval as theretofore imposed in Resolution No. 79R-607 (amending Resolution No. 79R-50) relating to said zone change; and WHEREAS, said Resolution No. 80R-481 authorizes an amend- ment to Ordinance No. 4069 relating to said conditions of approval. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. That conditions of approval Numbers 1, 3, 4, 13, 16 and 17 as set forth in Ordinance No. 4068 be, and the same are hereby, amended, respectively, to read as follows: CONDITION NO. 1 - Amend first paragraph to read: That prior to the issuance of a building permit or prior to recordation of a final parcel map, whichever occurs first, and in accordance with the provisions of the "PC" Planned Community Zone, there shall be submitted to the City Planning Commission for review and approval final specific plans of development. 77-78-64(:2) -1- CONDITION NO. 3 - Amend to read: That dedication of vehicu- lar access rights except at approved access points to Santa Ana Canyon Road and Weir Canyon Road shall be made to the City of Anaheim following the approval of final specific development plans for each parcel and prior to the issuance of any building permit or prior to recordation of any final parcel map, whichever occurs first. CONDITION NO. 4 - Amend to read: That dedication of eques- trian and hiking trails easements shall be made in accordance with the adopted Equestrian and Hiking Trails Element of the Anaheim General Plan following the approval of final specific development plans for each parcel and prior to the issuance of any building permit or prior to recordation of any final parcel map, whichever occurs first. Said trails shall be improved in accordance with plan and specifications on file in the Office of the City Engineer. CONDITION NO. 13 - Amend to read: The drainage of said prop- erty shall be disposed of in a manner satisfactory to the City Engineer. If in the preparation of the site, sufficient grading is required to necessitate a grading permit, work on grading will be permitted between October 15 and April 15 provided that adequate interim offsite drainage facilities are operational and satisfactory to the City Engineer. Bonds in an amount and form satisfactory to the City Engineer and City Attorney shall be posted to (a) guarantee completion of the required offsite drainage facilities prior to the issuance of any building permits and (b) guarantee the maintenance of the interim offsite drainage facility until such time as the ultimate drainage facilities are constructed and operational. Necessary rights of way for the offsite drainage facility shall be dedicated to the City, or the City Council shall have initiated condemnation proceedings therefor (the cost of which shall be borne by developer) prior to issuance of building permits. CONDITION NO. 16 - Delete entire condition and replace with a new one reading: That in conjunction with submittal of any grading plan, the developer shall indicate proposed access points to Santa Ana Canyon Road and Weir Canyon Road and also the location and width of any required equestrian and hiking trails easements. The access points shall be approved by the City Traffic Engineer and the eques- trian and hiking trails easements shall be approved by the Public Works and Planning Departments. Dedication of vehicular access rights except at approved access points and dedication of approved trails easements shall be complied with prior to issuance of a building permit or recordation of a final parcel map, whichever occurs first. CONDITION NO. 17 - Amend to read: That Condition Nos. 1, 2, 3, 4 and 14, above mentioned, shall be complied with prior to the time a building permit is issued or prior to the recordation of any final parcel map, whichever occurs first. -2- SECTION 2. That new Condition Number 19 be, and the same is hereby, added to Ordinance No. 4069 to read as follows: CONDITION NO. 19 - Notwithstanding any of the foregoing condi- tions, no grading of the residential portion of any parcels other than for the purpose of providing offsite utility services, public rights of way, and drainage facilities shall take place prior to a tentative map approval covering the area being graded. SECTION 3. That, except as expressly amended herein, Ordinance No. 4068 shall remain in full force and effect. SECTION 4. The City Clerk shall certify to the passage of this or- dinance and shall cause the same to be printed once within fifteen (15) days after its adoption in the Anaheim Bulletin, a newspaper of general circulation, printed, published and circulated in said City, and thirty (30) days from and after its final passage, it shall take effect and be in full force.
