4233ORDINANCE NO. 4233 AN ORDINANCE OF THE CITY OF ANAHEIM AMEND- ING TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES FIND THAT: WHEREAS, the City Council did adopt its Resolution No. 80R-551 determining that a change or changes in the zone or zones hereinafter mentioned and described should be made as hereinafter set forth after duly noticed hearings and receipt of the report and recommendation of the City Planning Commission; and WHEREAS, said Resolution did impose certain conditions and requirements precedent to the adoption of an ordinance chang- ing said zone or zones, which conditions and requirements have been satisfied. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. That Title 18 of the Anaheim Municipal Code relating to Zoning be, and the same is hereby, amended by changing the boundaries of the zones set forth in said Title 18 by adopting a sectional zoning map or maps showing such change or changes as follows: That all of the area situated in the City of Anaheim, County of Orange, State of California, described as follows, to wit: Lots 9, 11, 13 and 15 of Stueckle Subdivison, as per map thereof recorded in Book 81, Page 43 of Miscellaneous Maps, records of Orange County, California, now is "PD -C" PARKING DISTRICT -COMMERCIAL ZONE and that it be changed to and incorporated in "RM -3000" RESIDENTIAL, MULTIPLE -FAMILY ZONE subject to the following conditions: 1. That trash storage areas shall be provided in accordance with approved plans on file with the Office of the Executive Director of Public Works. 2. That fire hydrants shall be installed and charged as re- quired and determined to be necessary by the Chief of the Fire Department prior to commencement of structural framing. -1- ATTY-50 80-81-12 3. That drainage of subject property shall be disposed of in a manner satisfactory to the City Engineer. 4. That the owner of subject property shall pay to the City of Anaheim the appropriate park and recreation in -lieu fees as de- termined to be appropriate by the City Council, said fees to be paid at the time the building permit is issued. 5. That the owners of subject property shall pay the traffic signal assessment fee (Ordinance No. 3$96) in an amount as determined by the City Council, for each. new dwelling unit prior to the issuance of a building permit. 6. That subject property shall be served by underground utilities. 7. That an ordinance rezoning the subject property shall in no event become effective except upon or following the recordation of Final Tract Map No. 11256 within the time specified in Government Code Section 66463.5 or such further time as the advisory agency or City Council may grant. 8. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked Exhibit Nos. 1 through 4. 9. That Condition Nos. 1, 31 6 and 8, above-mentioned shall be complied with prior to final building and zoning inspections. 10. That, plus, there will be no windows on the westerly side of the second -story of the structure. SECTION 2. The City Zoning Map shall be, and the same is hereby, amended and the property above-described shall be excluded from the zone in. which it is now situated and incorporated in and made a part of the zone or zones as above set forth, and said City Zoning Map, as amended, is hereby adopted and the City Engineer is hereby directed to prepare a. sectional zoning man to be added to the City 'Zoning Map showing the changes hereby approved and adopted. SECTION 3. The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be printed once within fifteen (15) days after its adoption in the Anaheim Bulletin, a newspaper of general circulation, printed, published and cir- culated in said City, and thirty (30) days from and after its final passage, it shall take effect and be in full force. -2- THE FOREGOING ORDINANCE is approved and adopted by the City Council of the City of Anaheim this 2nd day of June, 1981.
