5718ORDINANCE NO. 5718
AN UNCODIFIED ORDINANCE OF THE CITY OF ANAHEIM
CONSENTING TO THE TRANSFER OF A FRANCHISE FOR
CABLE TELEVISION
WHEREAS, the City Council of the City of Anaheim did enact
Ordinance No. 4087, which ordinance did award a cable television
franchise to Storer Cable T. V. Inc. (Storer); and,
WHEREAS, said ordinance has heretofore been amended and the
franchise awarded to Storer been transferred, ultimately to
Century - TCI California, L.P.; and,
WHEREAS, Century - TCI California, L. P. has requested the
City Council to consent to the transfer of said cable television
franchise from Century -TCI California L.P. to Adelphia
Communications Corporation (hereinafter the Transferee.
NOW THEREFOR, THE CITY COUNCIL OF THE CITY OF ANAHEIM
DOES ORDAIN AS FOLLOWS:
1. The City Council does hereby consent, as said
consent is contemplated by the provisions of Section
1403 of the Charter of the City of Anaheim, to the
assignment of the cable television franchise from
Century -TCI California L. P. to Adelphia Communications
Corporation.
2. The City Council does hereby approve the terms
and conditions of that certain "Agreement Relating
To The Consent Of The City Of Anaheim To The
Transfer Of Control Of The Franchise Agreement Held
By Century - TCI California".
3. The City Council does hereby approve the terms and
conditions of the "Memorandum of Understanding between
and Among the City of Anaheim, California, Century
Valley Cable Corp. and Adelphia Communications
Corporation Relating to Approval of Change of Control
of Century Communications Corp. to Adelphia
Communications and Terms and Conditions Upon Which the
Existing Cable Television Franchise Will Be Renewed".
THE FOREGOING ORDINANCE is approved and adopted by the City
Council of the City of Anaheim this 11th d o Janua y , 2000
