2752ORDINANCE NO. 2752 AN ORDINANCE OF THE CITY OF ANAHEIM APPROVING THE ANNEXATION TO THE CITY OF ANAHEIM OF THE TERRITORY KNOWN AND DESIGNATED AS LA PALMA - FEE ANA ANNEXATION. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. That the City Council of the City of Anaheim did on the 14th3ay of _ October , 19 69 , receive a written petition asking that certain new territory described in said petition be annexed to the City of Anaheim. That prior to the circulation or filing of said peti- tion, notice of intention to annex said territory, containing the specific boundaries of the territory to be annexed, was filed with the Local Agency Formation Commission, and said Local Agency Formation Commission rendered its decision, as provided in Section 54766 of the Government Code, approving said.annexation. That said territory proposed to be annexed to said City of Anaheim is situated in the County of.Orange, State of California, and is contiguous to the City of Anaheim,.,and is uninhabited terri- tory. That said petition contained a description of said terri- tory in words and figures as hereinafter in this ordinance des- cribed. That the City Council duly assembled at a regular meeting of said City Council held on the 14E day of October , 196_, did find that said peti,tion at the time it was filed and received was signed by the owners of not less than one-fourth of the land in the territory by area and by assessed value; as shown on the last preceding equalized assess- ment roll of the County of Orange, State.of.California, in which said territory is situated, and that said territory did not form a part of any municipal corporation, and did find that said territory is contiguous to the City of Anaheim and is uninhabited territory. That on the 14th day of October , 19 69 , a -- regular meeting of said City Council of the City of Anaheim, Resolution No. 6918-5$3 was duly passed and adopted specifically describing the boundaries of the territory so proposed to be annexed to the City of Anaheim and designating such territory as the LA PALMA -FEE ANA ANNEXATION and giving notice of such annexation and fixing the 25th day of November , 19 69 , at the hour of 1:30 o'clock P.M. at the City Council Chamber in the City Hall in` the City of Anaheim, as the day, hour and place for hearing of written protests to said annexation and when and where any person owning real property within such territory so proposed to be annexed and having objections to the proposed annexation might appear before the City Council of the City of Anaheim and present written objections to the annexation of said territory to the City of Anaheim, and directing the City Clerk_to publish or cause to be published a copy of said resolution at least twice, ac but not oftener than once a week, for two successive weeks prior to the date of said hearing, in a newspaper of general circula- tion, published in the City of Anaheim, to wit: The Anaheim Bulletin of Anaheim, Orange County, California, and also in a newspaper of general circulation, published outside of the City of Anaheim, but in the County of Orange, in which is located the territory hereinafter proposed to be annexed to the City of Anaheim, to wit: The Placentia Courier and directing that said publications be completed at least twenty (20) days prior to the date of hearing hereinabove mentioned; and further directing the City Clerk of the City of Anaheim to cause written notice of such proposed annexation to be mailed to each person to whom land within the territory proposed to be annexed is assessed in the last equalized county assessment roll avail- able on the date the proceedings were initiated, at the address shown on said assessment roll or as known to said City Clerk, and to any person who has filed his name and address and the designation of lands in which he has any interest, either legal or equitable, with said City Clerk; and that in the event that land within the territory proposed to be annexed to the City of Anaheim is owned by a County, that the City Clerk shall cause written notice of such proposed annexation to be mailed to the Board of Supervisors of such County, and directing that such notices be given not less than twenty (20) days before the first public hearing on the proposed annexation. Said findings were then duly adopted by Resolution No. 69R-673 on November 25 , 19 69 SECTION 2. That the annexation of the territory included within the boundaries of the ids PAS -FEE ANA ANNEXATION, and more particularly described as follows, to wit: -2- LA PALMA -FEE ANA ANNEXATION TO THE CITY OF ANAHEIM That parcel of land located in the County of Orange, State of California, described as follows: Beginning at a point in the existing City limit line of the City of Anaheim as established by the Northeast Annexation No. 3 to the City of Anaheim, passed by Ordi- nance No. 1542, January 17, 1961, filed with the Secre- tary of State July 10, 1964 and recorded July 13, 1964 in Official Records of Orange County, California, said point of beginning being distant North 890 48' 10" East 30 feet from the centerline intersection of La Palma Avenue (formerly known as Walnut Street) and Fee Ana Street, as said intersection is shown on a Record of Survey Map filed in Book 79, page 1 of Record of Surveys in the office of the County Recorder of said Orange County, California; thence North 00 11' 50" West 398.35 feet along a portion of said existing City limit line of the City of Anaheim, being a line parallel with and 30 feet Easterly of the centerline of said Fee Ana Street, to an intersection with the South line of the North 143.52 feet of Lot 13, Block 36 of the Yorba Linda Tract, as shown on a Map recorded in Book 5, pages 17 and 18 of Miscellaneous Maps, records of Orange County, California; thence North 89° 48' 10" East 617.00 feet continuing along a portion of the said existing City limit line of the City of Anaheim, being a portion of the South line of the North 143.52 feet of Lot 13, Block 36 of said Yorba Linda Tract to an intersection with the Westerly line of the land des- cribed in deed recorded October 14, 1966 in Book 8075, page 782 of Official Records of Orange County, California; thence South 00 11' 50" East 451.35 feet leaving the said existing City limit line of the City of Anaheim, following along the Westerly line of the land described in the last mentioned deed and the Southerly prolongation thereof to -3- La Palma - Fee Ana Annexation To The City of Anaheim (Continued) an intersection with a line parallel with and 53 feet Southerly of the centerline of the aforementioned La Palma Avenue (formerly known as Walnut Street); thence North 89° 48' 10" East 196.13 feet along said parallel line to an intersection with the Westerly line of the parcel of land designated as Parcel 3 shown on a Record of Survey Map filed in Book 79, page 1 of Record of Surveys in the office of the County Recorder of said Orange County, California; thence North 00 11' 50" West 23 feet along a portion of the Westerly line of the last mentioned parcel of land to an intersection with a line parallel with and 30 feet Southerly of the centerline of said La Palma Avenue; thence North 890 48' 10" East 194.00 feet along the last mentioned parallel line to an intersection with the West- erly line of the land described in deed recorded March 30, 1960 in Book 5170, page 107 of Official Records of Orange County, California; thence South 00 11' 50" East 432.00 feet along the Westerly line of the land described in the last mentioned deed to the Southwesterly corner of said land; thence South 890 48' 10" West 1007.13 feet along a line parallel with the centerline of the aforementioned La Palma Avenue to an intersection with a line parallel with and 30 feet Easterly of the centerline of said Fee Ana Street, said point of intersection being a point in the existing City limit line of the City of Anaheim, as estab- lished by the aforementioned Northeast Annexation No. 3; thence North 00 11' 50" West 462.00 feet along the last mentioned parallel line, being a portion of the said exist- ing City of Anaheim City limit line to the point of beginning. -4- is hereby approved and said territory is hereby annexed to and incorporated in the City of Anaheim, County of Orange, State of California, and is hereby designated as the LA PALMA -FEE ANA ANNEXATION to the City of Anaheim. SECTION 3. That from and after the effective date of this ordinance and the filing of a certified copy thereof with the Secretary of State of the State of California, the annexation of the territory herein described shall be deemed to be and shall be complete and thenceforth such annexed territory shall be, to all intents and purposes, a part of the City of Anaheim, and from and after the effective date of such annexation, all property therein shall be subject to taxation equally with the property within the City of Anaheim and shall be taxed to pay its proportionate share of the existing indebtedness and liability of said City of Anaheim con- tracted prior to or existing at the time of such annexation pur- suant to the written consent of the owners of property in said annexed territory filed with the Clerk of the City of Anaheim prior to the adoption of this ordinance. SECTION 4. The City Clerk shall certify to the passage of this ordinance and cause the same to be published once in the Anaheim Bulletin , a newspaper of general circulation, printed, published and circulated in.the City of Anaheim, County of Orange, State of California, and thirty (30) days from and after its final passage it shall be in full force and effect.
