2896ORDINANCE NO. 2896 AN ORDINANCE OF THE CITY OF ANAHEIM AMENDING TITLE 17{ CHAPTER 17.08, SECTIONS 17.08.554, 17.08.5551 AND 17.08.556 OF THE ANAHEIM MUNI- CIPAL CODE, RELATING TO ESTABLISHING REGULA- TIONS FOR DEDICATION OF LAND, PAYMENT OF FEES, OR BOTH, FOR PARK AND RECREATIONAL LAND IN TRAILER PARKS AND RESIDENTIAL AREAS NOT IN- CLUDED IN SUBDIVISION (R-0, R-1, R-2, AND R-3) THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. That Title 17, Chapter 17.08, Section 17.08.554 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows; "SECTION 17.08.554 POPULATION DENSITY "Population density for the purpose of Sections 17.08.550 through 17.08.559 shall be determined in accordance with the following schedule of densities by dwelling unit as derived from the 1970 Federal Census, to wit: (a) Single family dwelling units and duplexes = 3.8 persons per dwelling unit; and (b) Multiple family dwelling units = 2.4 persons per dwelling unit; and (c) Mobile homes dwelling unit = 1.9 persons per dwelling unit. The basis for determining the total number of dwelling units shall be the number of such units permitted by the City on the property at the time the building permit is approved by the City Building Department." SECTION 2. That Title 17, Chapter 17.08, Section 17.08.555 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows: "SECTION 17.08.555 AMOUNT OF LAND TO BE DEDICATED (EFFECTIVE JANUARY 1,_1971) "The amount of land required to be dedicated pursuant to this Ordinance shall be: (a) Per single family unit - 248.3 square feet. (b) Per multiple family unit - 156.8 square feet. (c) Per mobile home dwelling unit - 124 square feet. The above listed amounts of land shall be based on the following formula; -1- Amount of land per dwelling unit = ( S ) P (1,000) S = Park standard P = Population density per dwelling unit Values used for determining amounts of land per dwelling unit; S = 1,5 acres or 65,340 square feet per 1,000 population P = 3,8 persons/single dwelling unit P = 2.4 persons/multiple dwelling unit P = 1.9 persons/mobile home dwelling unit." SECTION 3. That Title 17, Chapter 17.08, Section 17.08.556 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows "SECTION 17.08.556 AMOUNT OF FEE IN LIEU OF LAND DEDICATION EFFECTIVE J ARY , 1971) "Where a fee is required to be paid in lieu of land dedication, the amount of such fee shall be: (a) Per single family unit - $300 x 2/3 (b) Per multiple family unit - $187.50 x 2/3 (c) Per mobile home unit - $150 x 2/3 The above listed fees shall be based on the following formula: IN -LIEU FEE FORMULA: FEE _ (L + D) SP x 2/3 L = Acreage land acquisition cost per acre D = Average basic park development cost per acre S = Park standard P = Population density per dwelling unit Values used for determining the recommended in -lieu fees: L = $35,000 per acre D = $17,500 per acre S = 1.5 acres per 1,000 population P = 3,8 persons/single dwelling unit P = 2.4 persons/multiple dwelling unit P = 1.9 persons/mobile home dwelling unit." -2 SECTION 4, This Ordinance is an ordinance for the immediate preservation of the public peace, health, welfare and safety, and the following is a description of the facts constituting the urgency: That to provide uniformity and equality in the levying and enforcement of parks and recreation fees as they apple to all property within the City and to establish such fees for properties not included in subdivisions at the same time as those heretofore established for subdivisions, it is essential that this ordinance take effect immediately. The adoption of this Ordinance as an urgency measure is necessary for the immediate preservation of the public peace, health, safety and general welfare. SECTION 5. The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be published once within fifteen (15) days after its adoption in the Anaheim Bulletin, a newspaper of general circulation, printed, published and circulated in said City, and immediately upon and after its passage it shall take effect and be in full force.
