2891ORDINANCE NO., 2891 AN ORDINANCE OF THE CITY OF ANAHEIM AMEND- ING TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING. THE CITY COUNCIL OF THE CITY OF A14AHLIM DOES FII4D THAT: WHEREAS, the City Council did adopt its Resolution 140a 6ga-621 and 70R-598 determining that a change or cfianges in the zone or zonesZereinafter mentioned and described should be made as hereinafter set forth, after duly noticed hearings and receipt of the report and recommendation of the City Planning Commission; and WHEREAS, certain conditions and requirements were made as conditions precedent to the making of a change or changes of said zone or zones, which conditions have been com- plied with. NOW, THEREFORE, THE CITY COU14CIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. That Title 18 of the Anaheim Municipal Code relating to Zoning be, and the same is hereby, amended by changing the boundaries of the zones set forth in said Title 18 by adopting a sectional zoning map or maps showing such change or changes as follows: That all of the area situated in the City of Anaheim, County of Orange, State of California, described as follows, to wit: PARCEL NO. 1 That portion of allotments in Decree of Partition of the Rancho Canon De Santa Ana in the County of Orange, State of California, rendered in Case No. 1978 of the 17th Judicial District Court of California, a certified copy of which was recorded February 8, 1874 in Book 28, page 158 of Deeds in the office of the County Recorder of Los Angeles County, California, described as follows: Beginning at the northeasterly corner of the land described in the deed to the State of California recorded October 30, 1956 in Book 3693, page 374 of Official Records in the office of the County Recorder of said Orange County; thence along the easterly and southerly lines of said land the following courses, South 5° 37' 27" West 322.42 feet and North 880 37' 00" West 15.00 feet to a point in the easterly line of the land described in the deed to the State of California, recorded October 14, 1952 in Book 2395, page 522 of Official Records in the office of the County Recorder of said Orange County; thence South 10 23' 00" West 420.00 feet along last -1- 69-70-18 mentioned easterly line; thence South 88° 37' 00" East 690.00 feet; thence South 1° 23' 00" West 352.03 feet to a point in a non -tangent curve concave northerly, a radial line through a point bears South 120 32' 08" West and having a radius of 1400.00 feet; thence southeasterly along said curve through a central angle of 60 54' 54" an arc distance of 168.97 feet to a point in a non -tangent line, a radial line through said point bears South 5° 37' 14" West; thence North 1° 23' 00" East 1157.09 feet to a point in a non -tangent curve concave northerly, a radial line through said point bears South 1° 47' 21" East and having a radius of 5779.65 feet, being also a point in the southerly line of a strip of land 100.00 feet wide, as described in a deed to the Riverside, Santa Ana, and Los Angeles Railway Company, recorded July 7, 1886 in Book 164, page 508 of Deeds, records of said Los Angeles County; thence along last mentioned southerly line the follow- ing courses, westerly along said curve through a central angle of 00 19' 02" an arc distance of 32.00 feet and South 880 31' 41" West 787.52 feet to the point of beginning. That Parcel 2, hereinbefore described, shall be changed to and incorporated in CITY C-1, GENERAL COMMERCIAL ZONE. That Parcel 3, hereinbefore described, shall be changed to and incorporated in CITY R -A, AGRICULTURAL ZONE. 1. That trash storage areas shall be provided in accord- ance with approved plans on file with the office of the Director of Public Works. 2. That fire hydrants shall be installed as required and determined to be necessary by the Chief of the Fire Department. 3. That a 6 -foot masonry wall shall be constructed along the west, north, and east property lines of Parcel 1; and along the west, north and east property lines of Parcel 2. 4. That a 6 -foot masonry wall or chainlink fence be constructed along the south property line of Parcels 2 and 3, in accordance with Orange County Flood Control District requirements. 5. That subject property shall be served by underground utilities. 6. That drainage of subject property shall be disposed of in a manner that is satisfactory with the City Engineer and the Orange County Flood Control District. 7. That all air-conditioning facilities shall be properly shielded from view, and the sound buffered from adjacent residential homes. 8. That any parking area lighting proposed shall be down - lighting a maximum height of 6 -feet, which lighting shall be directed away from the property lines to protect the residential integrity of the area, on Parcel 2. 9. That Conditions Nos. 1, 2, 3, 4, 5, 6, 7, and 8, above- mentioned, shall be complied with prior to final building and zoning inspections. 10. That the owner of subject property shall pay to the City of Anaheim the sum of $75.00 per multiple -family unit, to be used for park and recreation purposes, said amount to be paid at the time the building permit is issued. -4- SECTION 2. The City Zoning Map shall be, and the same is hereby, amendedf and the property above described shall be excluded from the zone in which it is now situated, and incorporated in and made a part of the zone or zones as above set forth, and said City Zoning Map as amended is hereby adopted and the Citv Engineer is hereby directed to prepare a sectional zoning map to be added to the City Zoning Map showing the changes hereby approved and adopted. SECTION 3. The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be printed once within fifteen (15) days after its adoption, in the Anaheim Bulletin, a newspaper of general circulation, printed, published and circu- lated in said City, and thirty (30) days from and after its final passage it shall take effect and be in full force.
