2846ORDINANCE NO. 2846 AN ORDINANCE OF THE CITY OF A14AHEIM AMEND- ING TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING. THE CITY COUNCIL OF THE CITY OF A14AHEIM DOES FIND THAT: WHEREAS, the City Council did adopt its Resolution No. 70R-390 determining that a change or changes in the zone or zones hereinafter mentioned and described should be made as hereinafter set forth, after duly noticed hearings and receipt of the report and recommendation of the City Planning Commission; and WHEREAS, certain conditions and requirements were made as conditions precedent to the making of a change or changes of said zone or zones, which conditions have been com- plied with. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. That Title 18 of the Anaheim Municipal Code relating to Zoning be, and the same is hereby, amended by changing the boundaries of the zones set forth in said Title 18 by adopting a sectional zoning map or maps showing such change or changes as follows: That all of the area situated in the City of Anaheim, County of Orange, State of California, described as follows, to wit: That portion of the Southeast quarter of the Northeast quarter of Section 17, Township 4 South, Range 10 West, in the Rancho Los Coyotes, in the City of Anaheim, as per map recorded in Book 51, page 10, Miscellaneous Maps in the Office of the County Recorder of said County, described as follows: Beginning at the intersection of the Easterly prolongation of the Southerly line of Lot 76 of Tract No. 2402, as per Map recorded in Book 79, pages 37, 38 and 39, Miscellaneous Maps, in the Office of the County Recorder of said County, with the centerline of Euclid Avenue as shown on said Map and running thence Southerly along said centerline 166 feet to a point; thence Westerly parallel with the Southerly line of said Lot 76 to a point in the Easterly line of said Tract 2402; thence Northerly along said Easterly line to the Southwesterly corner of said Lot 76; thence Easterly along the Southerly line of said lot and the Easterly pro- longation thereof to the point of beginning. EXCEPT the Southerly 66 feet. -1- 70-71-3 be excluded from R -A, RESIDENTIAL -AGRICULTURAL ZONE, and that it be changed to and incorporated in C-1, GENERAL COMMERCIAL ZONE, -- upon the following conditions: 1. That the owners of subject property shall provide a 20 -foot wide vehicular accessway along the westerly boundary and a 10 -foot wide vehicular accessway along the northerly boundary of the property upon demand by the City, said vehicular accessways shall be paved in accordance with the requirements of the Dirctor of Public Works. 2. That mutual easement rights to and over the required private vehicular accessways shall be granted to all other property owners included in Area Development Plan No. 95 upon demand by the City; said easement rights shall be submitted to and approved by the City Attorney and then be recorded with the Orange County Recorder. 3. That trash storage areas shall be provided in accord- ance with approved plans on file with the office of the Director of Public Works. 4. That a 6 -foot masonry wall shall be constructed along the west property line. 5. That the existing structure shall be brought up to the minimum standards of the City of Anaheim, including the Uniform Building, Plumbing, Electrical, Housing, Mechanical and Fire Codes as adopted by the City of Anaheim. 6. That a parcel map to record the approved division of subject property be submitted to and approved by the City of Anaheim and then be recorded in the office of the Orange County Recorder. 7. That subject property be developed in accordance with Area Development Plan No. 95. 8. That fire hydrants shall be installed as required and determined to be necessary by the Chief of the Fire Department. 9. That all air-conditioning facilities shall be properly shielded from view and the sound buffered from adjacent residences. 10. That any parking area lighting proposed shall be down - lighting of a maximum height of 6 feet, which lighting shall be directed away from the property lines to pro- tect the residential integrity of the area. 11. That the final parking plans shall be approved by the Development Services Department, and any landscaped areas in the parking area shall be protected with 6 -inch high concrete curbs, and concrete wheel stops shall be provided for parking spaces as required by the Development Services Department. -2- 12. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim, marked Exhibits Nos. 1 and 2, provided that necessary revisions are made to comply with Area Development Plan No. 95. 13. That Conditions Nos. 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11 and 12, above mentioned, shall be complied with prior to final building and zoning inspections. SECTION 2. The City Zoning Map shall be, and the same is hereby, amended, and the property above-described shall be excluded from the zone in which it is now situated, and ifuorporated in and made a part of the zone or zones as above set forth, and said City Zoning Map as amended is hereby adopted and the City Engineer is hereby directed to prepare a sectional zoning map to be added to the City Zoning Map showing the changes hereby approved and adopted. SECTION 3. The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be printed once within fifteen (15) days after its adoption, in the Anaheim Bulletin, a newspaper of general circulation, printed, published and circu- lated in said City, and thirty (30) days from and after its final passage it shall take effect and be in full force.
