2834ORDINANCE NO. 2834 AN ORDINANCE OF THE CITY OF A14AIlEIM AMEND- ING TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING. THAT: THE CITY COUNCIL OF THE CITY OF A14AHLIM DOES FIND WHEREAS, the City Council did adopt its Resolution No- 70R-30 determining that a change or changes in the zone or zones ereinafter mentioned and described should be made as hereinafter set forth, after duly noticed hearings and receipt of the report and recommendation of the City Planning Commission; and WHEREAS, certain conditions and requirements were made as conditions precedent to the making of a change or changes of said zone or zones, which conditions have been com- plied with. NOW, THEREFORE, THE CITY COU14CIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. That Title 18 of the Anaheim Municipal Code relating to Zoning be, and the same is hereby, amended by changing the boundaries of the zones set forth in said Title 18 by adopting a sectional zoning map or maps showing such change or changes as follows: That all of the area situated in the City of Anaheim, County of Orange, State of California, described as follows, to wit: PORTION "A" That portion of the Northeast quarter of the Northwest quarter of the Northwest quarter of Section 24, Township 4 South, Range 10 West, in the Rancho San Juan Cajon de Santa Ana, as shown on a Map thereof recorded in Book 51, page 10 of Miscellaneous Maps, records of said County, lying Westerly of the following described line: Beginning at a point in the Northerly line of said North- east quarter, distant Easterly thereon 343.00 feet from the Northwest corner of said Northeast quarter; thence Southerly parallel with the Westerly line of the North- east quarter of the Northwest quarter of the Northwest quarter of said Section 24, a distance of 73.00 feet; thence Westerly parallel with the Northerly line of said Northeast quarter 33.00 feet; thence Southerly parallel with said Westerly line 200.00 feet; thence Easterly parallel with said Northerly line 33.00 feet; thence Southerly parallel with said Westerly line 387.00 feet to the Southerly line of the Northeast quarter of the North- west quarter of said Northwest quarter. -1- 69-70-29 PORTION "B" That portion of the Northeast quarter of the Northwest quarter of the Northwest quarter of Section 24, Township 4 South, Range 10 West, in the Rancho San Juan Cajon de Santa Ana, as shown on a Map thereof recorded in Book 51, page 10 of Miscellaneous Maps, records of said County, lying Easterly of the following described line; Beginning at a point in the Northerly line of said North- east quarter, distant Easterly thereon 343.00 feet from the Northwest corner of said Northeast quarter; thence Southerly parallel with the Westerly line of the North- east quarter of the Northwest quarter of the Northwest quarter of said Section 24, a distance of 73.00 feet; thence Westerly parallel with the Northerly line of said Northeast quarter 33.00 feet; thence Southerly parallel with said Westerly line 200.00 feet; thence Easterly parallel with said Northerly line 33.00 feet; thence Southerly parallel with said Westerly line 387.00 feet to the Southerly line of the Northeast quarter of the Northwest quarter of said Northwest quarter. EXCEPT THEREFROM the North 203.00 feet of the East 130.00 feet thereof. now is R -A, AGRICULTURAL ZONE, and that it be changed to and incorporated in R-3, MULTIPLE -FAMILY RESIDENTIAL ZONE, upon the following conditions: , 1. That trash storage areas shall be provided in accord- ance with approved plans on file with the Office of the Director of Public Works. 2. That fire hydrants shall be installed as required and determined to be necessary by the Chief of the Fire Department. 3. That subject property shall be served by underground utilities. 4. That drainage of subject property shall be disposed of in a manner that is satisfactory to the City Engineer. 5. That a parcel map to record the approved division of subject property be submitted to and approved by the City of Anaheim and then be recorded in the Office of the Orange County Recorder. 6. That the owner of subject property shall acquire access to Belhaven Street. 7. That mutual ingress and egress easements shall be provided for the common driveway separating Portion A and Portion B, and that said common driveway shall be constructed to a full 25 -foot width by the first portion of subject property to develop. 8. That a 6 -foot masonry wall shall be constructed along the south property line of subject property and reasonable landscaping with 15 -gallon trees, including irrigation -2- facilities, shall be installed in a 10 -foot wide planter strip along and adjacent to the full length of said wall. 9. That all air-conditioning facilities shall be properly shielded from view. 10. That the owner of subject property shall construct a modified knuckle at the intersection of Belhaven Street and Omega Avenue, including modification of the existing drainage structure as required by the City Engineer. 11. That Conditions Nos. 1, 2, 3, 4, 5, 6, 7, 8, 9 and 10, above-mentioned, shall be complied with prior to final building and zoning inspections. 12. That the owner of subject property shall deliver to the City of Anaheim an executed quit claim deed for all interest that they may now have or may later acquire in the City -owned property upon which Fire Station No. 7 is located. 13. That the owner of subject property shall pay to the City of Anaheim the sum of $75.00 per multiple -family unit to be used for park and recreation purposes, said amount to be paid at the time the Building Permit is issued. 14. That ordinances reclassifying the property shall be adopted as each parcel is ready to comply with conditions pertaining to such parcel, provided, however, that the word "parcel" shall mean presently existing parcels of record or any parcel or parcels approved by the City Council for a lot split. SECTION 2. The City Zoning Map shall be, and the same is hereby, amended, and the property above described shall be excluded from the zone in which it is now situated, and incorporated in and made a part of the zone or zones as above set forth, and said City Zoning Map as amended is hereby adopted and the City Engineer is hereby directed to prepare a sectional zoning map to be added to the City Zoning Map showing the changes hereby approved and adopted. SECTION 3. The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be printed once within fifteen (15) days after its adoption, in the Anaheim Bulletin, a newspaper of general circulation, printed, published and circu- lated in said City, and thirty (30) days from and after its final passage it shall take effect and be in full force.
