2779ORDINANCE NO. 2779 AN ORDINANCE OF THE CITY OF ANAHEIM, CALIFORNIA, ORDERING, CALLING, PRO- VIDING FOR AND GIVING NOTICE OF A SPECIAL MUNICIPAL ELECTION TO BE HELD IN SAID CITY ON APRIL 14, 1970, FOR THE PURPOSE OF SUBMITTING TO THE QUALIFIED VOTERS OF SAID CITY PROPO- SITIONS TO INCUR BONDED INDEBTEDNESS BY SAID CITY FOR CERTAIN MUNICIPAL IMPROVEMENTS, AND CONSOLIDATING SAID ELEC`T'ION WITH THE GENERAL MUNICIPAL ELECTION TO BE HELD ON SAID DATE. WHEREAS, at a meeting held prior to the meeting at which this ordinance is adopted the City Council, by a vote of at least two-thirds of the members thereof, adopted a resolution determining that the public interest and neces- sity demand the acquisition and construction of certain municipal improvements, and making findings relating thereto; NOW, THEREFORE, the City Council of the City of Anaheim, California, DOES ORDAIN as follows: Section 1. That a special municipal election be held and the same is hereby called to be held in said city on April 14, 1970, for the purpose of submitting to the qualified voters of said city the propositions hereinafter set forth of incurring indebtedness and issuing bonds of said city therefor, in the respective principal amounts stated in the respective ballot propositions hereinafter set forth in said resolution and in said ballot propositions. Section 2. That the respective estimated costs of the respective municipal improvements described in the ballot propositions hereinafter set forth are as follows: Proposition City Hall Storm Drain Library Park Estimated Cost $8,,,0000000 4,500,000 "850,000 3,,68.5,000 That in each case the estimated cost of said munici- pal improvement includes the following: (a) legal or other fees incidental to or connected with the authorization, issu- ance and sale of the bonds, and (b) the costs of printing the bonds and other costs and expenses incidental to or connected with the authorization, issuance and sale of the bonds. Section 3. That the maximum rate of interest to be paid on each said indebtedness shall not exceed the maximum rate permitted by law, to wit, seven per cent (7%) per annum, the actual rate or rates of interest on said bonds to be deter- mined at or prior to the time of the sale or sales thereof. Said interest shall be payable semiannually except that interest for the first year may be made payable at the end of said year. Section 4. That the manner of holding said elec- tion (including, without limitation, the time when the polls shall remain open) shall be the manner provided by law for the holding of the general municipal election to be held in said City on April 14, 1970, and the procedure for voting for or against said proposition and for counting said votes shall be the procedure provided by law in said City for voting upon measures at said general municipal election. Section 5. That on the ballots to be used at said special election, in addition to any other matters required by law, there shall be printed substantially the following: PROPOSITION C (CITY HALL) : For the acquisition and construction : of a City Hall (location unspecified), : the planting and landscaping of grounds : YES . : and provision for vehicle parking there- : : for and including furniture, furnishings,: : apparatus, equipment and other property : necessary therefor, shall the City of : Anaheim incur a bonded indebtedness in NO : the principal amount of eightmillion dollars? , PROPOSITION D (STORM DRAIN BONDS) : To acquire and construct storm drains YES . : with appurtenances and appurtenant : works, shall the City of Anaheim incur : a bonded indebtedness in the principal : amount of four million five hundred NO : thousand dollars? PROPOSITION L (LIBRARY BONDS) For the acquisition and construction of two branch public libraries and additions: and improvements to the existing branch public library, including the planting and landscaping of the library grounds, provision for vehicle parking, initial book stock, furniture, fixtures, equip- ment and other property necessary there- for, and for the acquisition of real property for two additional branch libraries, shall the City of Anaheim incur a bonded indebtedness in the principal amount of eight.:. hundred fifty , thousand dollars? That if any proposition for the incurring of bonded indebtedness so submitted receives approval by the applicable majority required by the Constitution of the State of California and the Charter of the City, bonds of said city, in not exceeding the principal amount stated in such proposition, may be issued and sold for the object and purpose set forth in such proposition. Section 7. That the special municipal election hereby called shall be and is hereby ordered consolidated with the general municipal election to be held in said city on said date and such elections shall be held in all respects as if there were only one election and only one form of ballot shall be used thereat. The precincts, polling places and officers of election for this special municipal election shall be the same as those provided for said general municipal election and are set forth in the resolution providing for said general municipal election, to wit: Resolution No. 70R-72 adopted February 3 1970 Section 8. That except as otherwise provided in this ordinance, the election called hereby shall be conducted as provided by law for other municipal elec- tions in said city. Section 9. That the City Clerk shall cause this ordinance to be published, within 15 days of its adoption and once a day for at least seven days in THE BULLETIN, a newspaper of general circulation published at least six days a week in the city. No other notice of such election need be given. Section 10. This ordinance shall take effect upon its passage.
