2767ORDINANCE NO. 2767 AN ORDINANCE OF THE CITY OF A14AIIEIM AMEND- ING TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES FIND THAT: WHEREAS, the City Council did adopt its Resolution Nos. 62R-335 and 66R-634 determining that a change or changes in a one or zones hereinafter mentioned and described should be made as hereinafter set forth, after duly noticed hearings and receipt of the report and recommendation of the City Planning Commission; and WHEREAS, certain conditions and requirements were made as conditions precedent to the making of a change or changes of said zone or zones, which conditions have been com- plied with, as to the property hereinafter described. NOW, THEREFORE, THE CITY COU14CIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. That Title 18 of the Anaheim Municipal Code relating to Zoning be, and the same is hereby, amended by changing the boundaries of the zones set forth in said Title 18 by adopting a sectional zoning map or maps showing such change or changes as follows: That all of the area situated in the City of Anaheim, County of Orange, State of California, described as follows, to wit: Parcel 1: That portion of the North 154.23 feet of Lot 2 in Section 5 Township 4 South, Range 9 West, San Bernardino Meridian, in the City of Anaheim, County of Orange, State of Califor- nia, lying westerly of the 100.00 foot right of way of the Atchison, Topeka and Santa Fe Railway Company as recorded July 11, 1887 of Deeds of Los Angeles County, described as follows: Beginning at the intersection of the south line of the North 154.23 feet of said Lot 2, with the northwesterly line of the Atchison, Topeka and Santa Fe Railway Company's right of way, 100 feet wide; thence North 150 57' 30" East 83.10 feet to a point in a curve concave southeasterly and having a radius of 947 feet, a radial line through said point having a bearing of North 100 06' 18" West, thence westerly and southerly along said curve, through a central angle of 140 45' 15" an arc distance of 243.86 feet to the intersection with the south line of the North 154.23 feet of said Lot 2, thence South 80 07' 30" East 209.22 feet to the point of beginning. -1- 61-62-69 (36) Said land is included within the area shown on a map filed in the Office of the County Recorder of said Orange County, in Book 1, page 29 of Record of Surveys. Parcel 2: That portion of Lot 2 in Section 5 Township 4 South, Range 9 West, San Bernardino Meridian, in the City of Anaheim, County of Orange, State of California, lying westerly of the 100.00 foot right of way of the Atchison, Topeka and Santa Fe Railway Company as recorded July 11, 1887 of Deeds of Los Angeles County, described as follows: Beginning at a point 872 feet south of the Northwest corner of said Lot 2, and running thence southerly along the westerly line of said Lot 2, 150 feet to the point of intersection of said westerly line with the westerly line of the Atchison, Topeka and Santa Fe Railway Company's right of way; thence northeasterly along said right of way 147 feet; thence westerly 50 feet to the point of beginning. EXCEPTING an undivided one-half of all minerals, oil and hydrocarbons of every kind and character that may now or hereafter be found, located, developed or taken from said land, as reserved in the deed dated April 14, 1958 from Hazel I. Cole. Said land is included within the area shown on a map filed in the Office of the County Recorder of said Orange County, in Book 1, page 29 of Record of Surveys. Parcel 3: That portion of Lot 2 in Section 5 Township 4 South, Range 9 West, San Bernardino Meridian, in the City of Anaheim, County of Orange, State of California, lying westerly of the 100.00 foot right of way of the Atchison, Topeka and Santa Fe Railway Company as recorded July 11, 1887 of deeds of Los Angeles County. EXCEPT a portion thereof described as follows: Beginning at a point 872.00 feet south of the Northwest corner of said Lot 2; thence southerly 150.00 feet along the westerly line of said Lot 2, to the westerly line of the Atchison, Topeka and Santa Fe Railway Company's right of way; thence Northeasterly 147.00 feet along said right of way; thence Westerly 50.00 feet to the point of beginning. ALSO EXCEPT the North 154.23 feet thereof. EXCEPTING one-half of all minerals, oil and hydrocarbons of every kind and character that may now or hereafter be found, located, developed or taken from said land, as reserved in the deed from Anthony F. Struna, recorded April 25, 1958 in Book 42.67, page 376, Official Records. Said land is included within the area shown on a map filed in the Office of the County Recorder of said Orange County, in Book 1, page 29 of Record of Surveys. Parcel 4: That portion of Lot 1 of Orangegrove Acres, in the City of -2- Anaheim, County of Orange, State of California, as per map recorded in Book 6, page 42, Miscellaneous Maps, in the Office of. the County Recorder of said County, lying westerly of the 100 foot right of way of the Atchison, Topeka and Santa Fe Railroad Company, as recorded July 11, 1887 of deeds, Los Angeles County. EXCEPTING THEREFROM that portion lying southerly of a line described as follows: Beginning at the northwesterly corner of the land described in the deed to Fernstrom Storage and Van Company, a corporation, recorded April 12, 1965 in Book 7479, page 324, Official Records of said Orange County, said corner being in the westerly line of said Lot 1, distant thereon North 30 45' 30" West 126.66 feet from the northerly corner of the land described in the deed to the State of California, recorded August 23, 1963 in Book 6687, page 848, Official Records, and running thence North 860 14' 30" last along the northerly line of said land of Fernstrom Storage and Van Company, 228.83 feet to the northwesterly line of said railroad right of way. now is R -A, RESIDENTIAL -AGRICULTURAL ZONE, and that it be changed to and incorporated in M-1, LIGHT INDUSTRIAL ZONE, upon the following conditions: 1. That all engineering requirements of the City of Anaheim, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities or other appurtenant work shall be complied with as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer at the time the property is developed. 2. That the owners of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot for street lighting purposes, said amount to be paid at the time the property is developed. 3. That all plans for development of the property shall be submitted to and approved by the Architectural Control Committee on the basis of compatibility of development, both structurally and architecturally. SECTION 2. The City Zoning Map shall be, and the same is hereby, amended, and the property above described shall be excluded from the zone in which It is now situated, and incorporated in and made a part of the zone or zones as above set forth, and said City Zoning Map as amended is hereby adopted and the City Engineer is hereby directed to prepare a sectional zoning map to be added to the City Zoning Map showing the changes hereby approved and adopted. SECTION 3. The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be printed once within fifteen (15) days after its adoption, in the Anaheim Bulletin -3- a newspaper of general circulation, printed, published and circulated in said City, and thirty (3.0) days from and after its final passage it shall take effect and be in full force.
