1300ORDINANCE NO. 1?C� All ORDINANCE OF THE CITY OF ANAHE IIVI ESTABLISH- ING A PARK AND RECREATION COD&IISS ION AND THE OFFICES OF THE MEIUIBERS THEREOF; DEFINING ORGA1NIZATION AND DUTIES THEREOF; CREATING THE POSITION OF PARK AND RECREATION DIRECTOR; AND ESTABLISHING A RECREATION FUND. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORD IAN AS FOLL01%4S : SECTION 1. PARK AND RECREATION CO!�,,7ZISS ION. There is hereby created a Pari: and Recreation Com- mission consisting of seven (7) members. The Par's and R.3creation Commission members shall be appointed as follows: a. Two members to be recom.,iended by the ?Mayor for appointment by the City Council. b. One member to be recommmended from the City Council for appointment by the City Council. c. One member to be recommended from the High School District Board of Trustees for ap- pointment by the City Council. d. One member to be recommended from the City School District Board of Trustees for ap- pointment by the City Council. e. One member to be recommended from the Magnolia School District Board of Trustees for appoint- ment by the City Council. f. One member to be recommended from the City Planning Commission for appointment by the City Council. g. E�:-officio members, without vote, may be ap- pointed by the City Council as follows: The Superintendent of the High School District; the Superintendent of the City School District; the Superintendent of the Miagnolia Elementary School District, and the City �.Ianager. Members of the Commission shall serve for a period Of three (3) years. The first Commission to be appointed shall, at its first meeting, so classify its members by lot that two (2) shall serve for one (1) year; two (2) shall serve for two (2) years, and three (3) shall serve for three (3) years. At, the expiration of each of the terms so provided for, a successor shall be appointed by the City Council for a termof three (3) years. Vacancies in said Commission occur- ring otherwise than by e:,piration of term shall be filled in the manner herein set forth for the unexpired term of the Commissioner leavinc the Commission. -1- SECTION 2.- ORGANIZATION 0' COi�-,'PAISSION * Within fifteen (15) days after their appoint.riient, the members of the Commission shall meet In regular session and elect from their members a Chairman and Vice -Chairman. Their duties shall be respectively such as usually carried by such officers. Officers shall hold office for one (1) year, or until their successors are elected. The Com- mis -,ion shall adopt rules and regulations to govern procedure and shall, by vote, set a time for regular meetings, which shall be held at least once each month, anr, shall determine the manner in which special meetings may be held and the notice given members. A majority of members shall constitute a quorum. Absence fro.,,,i three (3) consecutive !meetings with- out fori:ial consent of the Coirmission shall be deemed to constitute the retirement of such member and declare the position vacant.',,Minutes of the Commission shall be filed with the City Clerk, the City 1,fanacer and the Superintendent of Schools. Act in an advisory capacity to the City Council, the Boards of Trustees of the School Districts and the Park and Rf3creation Director in all matters pertaining to parts and recreation, and to cooperate with other governmental agencies and civic groups in the advaric,-rient of sound Par!-, anC Recrea- tion Planning and Programiming. Recommend policies on recreation service for approval ofthe City c3uncil. Advise with the Par'.;. and Recrcation Director on problems of'devclopmant of recreation areas., facilities, programs and improved recreation services. The functions of this departmcnt arc to provide opportunities for wholesome year-round recreation services for each age group and to develop and maintain, in an at- tractive manner, the park and recreation areas and facilities of the City of Anaheim, and to insure that such facilities are suitable for a wide variety of recreation purPoses. The City Manager shall appoint, subject to the prior review and approval of the City Council, a Parr" and R3creation Director to administer the Park and ,creation Program. 2. The Park and R ccreation -Director s iall : a. Be rc5ponsiblc for the administration and op<,ration of th:s Parr: and Recreation Depart- ment, in accordance with the policies recom- mended by talc Park and i;ecreation Commission as ap )rove:d by the City ivianager and the City Council, and shall perform th3 following specific functions within the budgetary limits as ap roved annually by the City Council and other taxing agencies furnishing money to the Recreation Fund, and provided that all ex- penditures shall be approved by the City :Jlanager and/or the City Council: b. Recommend for employment required personnel according to the standard procedures as set forth by the City of Anaheim and, upon employment, shall supervise them in the per- formance of their various duties. c. Administer, operate and maintain existing Park and Recreation areas and facilities and plan for the acquisition, dcvelopm�nt and operation of proposed facilities in accordance with the policies recommended by the Park. and Recreation Commission and as approved by the City Manager and the City Council. d. Inform the general public of the services and facilities being provided by the Pari-" and Recreation -Depart.ment. C . Solicit suggestions from the general public to improve or increase the effectiv3ness of the services. m" f. Cooprate with governmental and voluntary organizations and agencies in the furtherance of recreation opportunities. g. Prepare manuals, bulletins and reviews on Parks and Recreation Problems. h. Provide upon request assistance of technical nature to community agencies and organizations having problems relating to Parts and Recrea- tion areas, facilities and programs. i. Council with officials of public and private organizations and other interested groups concerning community recreation and leisure activities and assist them in promotion of recreation services. j. Conduct studies of local conditions and needs for Parr: and Recreation services and assist with recruitment and training of recreational personnel. k. Prepare a budget request for the review of the Part: and Recreation Commission and present this request to the City Manager and the City Council. Said budget shall provide for recrea- tion services and operating costs for the ensuing fiscal year. SECTION 6. RECREATION FUND. There is hereby established a Recreation Fund. All monies accrued to said fund stall be deposited with the City Treasurer of the City of Anaheim. It is agreed that all con- tributions to saie Recreation Bund shall be made for the promotion of recreation activities and programs in the follow- ing proportions, to wit: 601 by the City of Anaheim; 1"% by the Anaheim City School District; 20% by the Anah0 m Union High School District, and 51 by the Magnolia Elementary School District. Nothing in this section contained shall prohibit or in any way restrict the acceptance of donations from individuals to said Fund. All fees collected and/or fines levied at recrea- tion activities shall be deposited in the said Recreation Fund with. the City Treasurer. The City Treasurer shall be the custodian of all monies b longing to said Recreation Fund and no money shall be drawn except by warrant by the City Finance Director in accordance with laws governing the City of Anaheim. SECTICN j. All Ordinances and parts of Ordinances in conflict herewith are hereby repealed. SECT ION 8 . If any section, sentence, clause or phrase of this ordinance is for any reason held unconstitutional, such un- constitutionality shall not affect the validity of the re- maining portions of this Ordinance. The City Council 'hereby declares that it would have passed this Ordinance and each section, sentence, clause or phrase thereof irrespective of the fact that any one or more sections, sentences, clauses or phrases should be declared unconstitutional. SECT ICN 9. The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be published once within fifteen (1) days from and after its adoption, in tha Anaheim Gazette, a newspaper of general circulation, printed, published and circulcted in the City of Anaheim, and thirty (3C) days froi.q. and after its final passage it shall be in full fore and effect.
