ORDINANCE NO. 306 AN ORDINANCE PROHIBITING THE SELLING, blUI{NISHIG OR DELIV- ER1NG OP' INDUS,NSPIRITUOUS, :HALT Olt MIXED INTOXICATING LI42t,'ORS S'lT'HIN ANY RESTAU- RArZT IN THE CITY OF ANAHEIEI, THE BOARD OF TRUSTEES OF THE CPI'Y OF ANAHEIM DO ORDAIN AS FOLLOWS- SECTION 1. For the purposes of this Ordinance, a restaurant is defined to be a place where food or victuals, cooked or otherwise prepared for human consump- tion, are sold and served to the public to be consumed upon the premises, where the same is so sold or served, provided that the definition in this sectioncon- tained, shall not apply to any dining - room or cafe connected with or ducted as a part of any hotel containincon- g not less than thirty-five (35) sleeping rooms for the patrons of such hotel, such dining -room or cafe having been regularly licensed to serve such liquors with bona -fide meals, in accordance with the provisions of the ordinances of the City Of Anaheim 2. It shall be unlawful for any person or persons, In any restau- rant within the City of Anaheim, to sell, furnish or deliver to, any patron, guest a other person in any such restaurant any vinous, spirituous, malt or mixed intoxicating liquors, and each act in vi- olation of this section, or of the next two succeeding sections of this ordinance, shall separately, for each day or frac- tional part thereof, of its continuance, constitute a separate offense. SECTION 3. It shall be unlawful for any owner, proprietor, manager or oth- er person in charge of any restaurant within said city or any employee of such Owner, proprietor or manager thereof to suffer or permit any person in such restaurant to sell, furnish or deliver to any other person or persons, any vinous, spirituous, malt or mixed intoxicating liquor in any such restaurant. SECTION 4. It shall be unlawful for any guest or patron within any res- taurant in the City of Anaheim, to drink, furnish, divide or distribute any vinous, spirituous, malt or mixed intoxicating liquors, between the hour o' 10:45 o'clock' P. M. of any Saturday and 6 o'clock A. M. of the next succeeding Monday, or between the hours of 10:45 P. M. of any one day and 6:00 A. M. of the next suc- ceeding day, other than Sunday-. SECTION 5. Any person who shall vi- olate any of the provisions of this or- dinance shall be deemed guilty of a misdemeanor, and upon conviction there- of, shall be punished by a fine of not exceeding Three hundred dollars ($300.00), or by imprisonment in the City Jail oY said City for a period of not exceeding Three (3) months or by both such fine and imprisonment. Section 6. If any section, subsection, sentence, clause or phrase of this ordi- nance shall for any reason, be held to be unconstitutional such decision shall not, effect the validity of the remaining por- tions of this ordinance, and the Board of Trustees of the City of Anaheim here- by declares that it would have passed every section, subsection, sentence, clause, or phrase of this ordinance irrespective of the fact that such section, subsection, sentence, clause or phrase be declared un- constitutional. SECTION 7. All ordinances and parts of ordinances in conflict with the provis- ions of this ordinance are hereby repealed. SECTION 8. The City Clerk of the City of Anaheim shall certify to the pass- age of this ordinance and cause the same to be published once in the 'Anaheim Gazette," a weekly newspaper of gen- eral circulation, published and circulated in said City of Anaheim, and thirty days therefrom and thereafter the same shall take effect and be in full force.
