acter, having a bona fide subscription list of paying subscribers; that at all
said times said newspaper had been established, printed and published in the
said City of Anaheim, in said County and State at regular intervals for more

ORDINANCE NO. 598.
AN ORDINANCE OF THE CITY OF ANAHEIM! PROHIBITING THE SALE, DISPLAY AND
ADVERTISING OF CONTRACEPTIVE DEVICES, PROPHYLACTIC RUBBER GOODS AND
ARTICLES FOR THE PREVENTION OF VENEREAL AND OTHER DISEASES AND INFEC-
TIONS, EXCE?T BY REGISTERED PHARMACISTS OR. LICTNSFD PHYSICIANS, AND
PROVIDICX A PENALTY FOR THE VIOLATION THEREOF.
THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOT:LOWS:
SECTION 1. It shall be unlawful for any person, firm, corporation,
co -partnership or association, other than a duly registered pharmacist
in a licensed pharmacy, to sell, offer for sale or give away, contra-
ceptive devices or any prophylactic rubber goods, or any other articles
for the prevention of venereal and other diseases and infections, in the
City of Anaheim, except that the foregoing provisions shall not apply
to wholesale druggists, jobbers or manufacturers who sell to retail drug
steres, or to duly licensed physicians in their professional practice.
SECTION 2. The use of any vending machine or automatic device for
the sale or disposition of articles specified in tris act is unlawful.
SECTION 3. It shall be unlawful for any person, firm, corporation,
co -partnership or association to display or expose for sale any of the
above described articles or any containers or packages containing the
same. It shall be unlawful to advertise the sale of the same on any
placards, billboards, newspapers, periodicals, radios, signs or any
other printed matter.
SECTION 4. Any person, firm, corporation, co -partnership or
association violating any of the provisions of this ordinance shall be
punished by a fine of not more than Three Hundred ($300.00) Dollars,
or by imprisonment not more than ninety (90) days, or both such fine and
imprisonment at the discretion of the Court.
SECTION 5. That all ordinances and parts of ordi_ances in conflict
with the provisions of this ordinance are hereby repealed, and the City
Clerk of the City of Anaheim shall cause this ordinance to be published
once in the Anaheim Gazette, a newspaper published and circulated in the
City of Anaheim, and shall take effect thirty (30) days after its final
passage..}'
