RES-2009-099RESOLUTION NO. 2009- 099 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM EXTENDING THE PAYMENT OF SALARY AND BENEFITS TO CITY EMPLOYEES RECALLED TO ACTIVE DUTY IN CONNECTION WITH ACTIONS TO COMBAT TERRORISM AGAINST AMERICA AND TO ASSIST WITH RESCUE AND RECOVERY OPERATIONS ARISING FROM NATURAL DISASTERS WHEREAS, the City of Anaheim currently provides fully paid leave of absence and continuation of benefits for a maximum of thirty (30) calendar days per fiscal year to employees who have been in City service for at least one (1) year and who are ordered to report to active duty; and WHEREAS. a number of City of Anaheim employees have been, and other employees may be, called into active military service in connection with actions to combat terrorism against America and to assist with rescue and recovery operations arising from natural disasters; and WHEREAS. on January 28, 2003, the City Council adopted Resolution No. 2003R -14 that provided a supplemental military leave benefit for a period not to exceed two years; and WHEREAS, on November 16. 2004, the City Council adopted Resolution No. 2004R -225 that provided a supplemental military leave benefit for a period not to exceed one year; and WHEREAS, on October 11. 2005. the ('ity Council adopted Resolution No. 2005R -199 that provided the supplemental military leave benefit established in Resolution No. 2004R -225 be extended by thirty -six (36) months; and WHEREAS. the City Council of the City of Anaheim desires to continue to alleviate financial hardships which employees and their families will experience as a result of being called to active duty to serve during such crisis. follows: NOW. THEREFORE. BE 11 RESOLVED by the City Council of the City of Anaheim as 1 That the City shall provide supplemental salary continuance and benefits as established in Resolution 2005R -199 for an additional thirty -six (36) months, effective as of January 1. 2009. That each full time officer or employee of the City who is eligible to receive such paid leave and, who has been, or is in the future, called to involuntary active military service with the Armed Forces oi'the United States to serve in support of the current actions to combat terrorism against America, and to assist with rescue and recovery operations arising from natural disasters, shall be entitled to leave with partial pay pursuant ?o the terms of this Resolution for the period of absence on active duty in excess or the period covered by current paid military leave provisions. 5. That Wage or benefits pursuant to this Resolution are conditioned upon the officer or employee requesting such payment providing satisfactory proof and documentation of eligibility to receive payment in accordance with procedures established by the Human Resources Director. 3 That the amount of pay each employee shall be entitled to receive from the City for said additional period of military leave shall be the difference between the gross pay and allowances actually received by the officer or employee from the United States for such service and the gross wages that said officer or employee would have received from the City of Anaheim if he or she had not been called to active military duty, subject to all required and appropriate deductions and withholdings. 4. That the City shall provide continued health and welfare benefits to such employees' dependents, provided the dependents were covered for such benefits prior to the employee being called to active duty.
