A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM AMENDING RATES, RULES AND REGULATIONS
FOR THE SALE AND DISTRIBUTION OF ELECTRICITY AS
ORIGINALLY ADOPTED BY RESOLUTION NO. 71R-478 AND
MOST RECENTLY AMENDED BY RESOLUTION NO. 2009-001.
WHEREAS, beginning on November 15, 2008, through November 17, 2008,
conditions of extreme peril to the safety of persons and property arose within the City of Anaheim
Nnaheim caused by fire and high winds "Freeway Complex Fire and
WHEREAS, the City Council issued a proclamation of the existence of a local
emergency pursuant to California Government Code Section 8630 and Anaheim Municipal Code
Section 6.04.060 as a result of the Freeway Complex Fire; and
WHEREAS, as a result of the Freeway Complex Fire, a number of residential
structures have been completely destroyed or partially damaged; and
WHEREAS, it is important to clean up properties as soon as possible to minimize
airborne debris. safety hazards and unsightly conditions; and
WHEREAS. it is in the best interests of Anaheim to facilitate the prompt repair and
construction of structures damaged or destroyed as a result of the Freeway Complex Fire in order
to bring the same into compliance with all applicable building and fire codes as soon as possible; and
WHEREAS. on March 10. 2009 the City Council adopted Resolution 2009 -043 to
waive the payment of building plan check and permit fees, demolition permit fees, grading plan
check and permit fees, sewer connection fees. and other permit- related fees including inspection fees
applicable to the repair or reconstruction of structures damaged as a result of the Freeway Complex
Fire with the waiver of those fees expiring on March 10, 2011; and
WHEREAS. it is the desire of the City Council that similar design, inspection, and
connection fees for Anaheim Public Utilities fees applicable to the repair or reconstruction of
structures damaged as a result of the Freeway Complex Fire also be waived with the waiver of those
fees expiring on March 10, 2011: and
WHEREAS. Anaheim maintains an electric transmission and distribution system for
the furnishing of electricity to residents and inhabitants of Anaheim and has adopted Electric Rates,
Rules, and Regulations for the sale and distribution of electricity; and
WHEREAS. the Anaheim Municipal Code authorized the City Council to approve
reasonable Electric Rates, Rules, and Regulations governing electric services and fees for providing
electric services: and
WHEREAS, Anaheim established Rules 13, 16, and 24 of the Electric Rates, Rules
and Regulations when it completely revised its Rates, Rules and Regulations for the sale and
distribution of electricity by Resolution 71R -478; and
WHEREAS, the proposed modification to Rules 13, 16, and 24 of the Electric Rates,
Rules and Regulations are consistent with Resolution 2009 -043 adopted by City Council on March
10. i. 2009 to waive the payment of certain specified fees applicable to the repair or reconstruction of
structures damaged as a result of the Freeway Complex Fire with the waiver of those fees expiring
on March 10, 2011. and
WHEREAS. the Public Utilities Board considered the requirements of the California
Environmental Quality Act and found that matters covered above come within Section 21080 (b) (8)
of the Public Resources Code of the State of California. Thus, the modification to Rules 13, 16, and
24 of the Electric Rates. Rules and Regulations are statutorily exempt from the California
Environmental Quality Act: and
WHEREAS, the Public Utilities Board considered and recommended the proposal
of the Public Utilities Department to revise Rules 13, 16, and 24 of the Electric Rates, Rules, and
Regulations by modifying said Rules; and
WHEREAS. the Public Utilities Board made the following findings with respect to
the need for the proposed modifications to the Electric Rates, Rules and Regulations:
1. It is reasonable and appropriate that only the fees identified in the Electric Rates,
Rules and Regulations as Rules 13, 16, and 24 that are otherwise applicable to the
repair and /or reconstruction of residential structures damaged as a result of the
Freeway Complex Fire are hereby temporarily waived for completed applications for
service received on or before March 10, 2011.
2. It is reasonable and appropriate that only the aforesaid fee waivers shall apply
only to "in- kind" (i.e., the same square footage plus up to 499 sq. ft., height, number
of stories. fence materials. etc.) repair and reconstruction of residential structures, and
shall not apply to any portion of a rebuilt residential structure that is greater than 499
sq. ft of the original square footage at the time the residential structure was destroyed.
3. It is reasonable and appropriate that only property owners of damaged or
destroyed residential structures as of the date of the Freeway Complex Fire are
eligible for the aforesaid fee waivers, and the aforesaid waivers cannot be applied to
a vacant parcel of any other non -fire damaged parcel.
4. It is reasonable and appropriate that a new buyer of a fire damaged parcel is not
eligible to receive this waiver of fees. For purposes of this Resolution, "new buyer"
shall mean any buyer whose escrow closed after the Freeway Complex Fire on
November 15 -17. 2008.
5. It is reasonable and appropriate that all new construction undertaken in the
repair or replacement of residential structures shall comply with all applicable
planning, zoning, building. and fire code requirements.
6. 1t is reasonable and appropriate that for purposes of this Resolution, "residential
structures" shall mean main residential building, attached garage, detached garage,
accessory buildings, irrigation systems. pool, pool equipment, fences, walls, patio
covers. and decks.
It is reasonable and appropriate that the fees identified in Rules 13, 16, and 24
shall only be waived once per lot.
8. It is reasonable and appropriate that the modifications to Rules 13, 16, and 24
shall automatically sunset and terminate without further action on March 10, 2011.
WHEREAS. based on the findings hereinabove made, the Public Utilities Board of
the Citv of Anaheim recommended to the City Council that the Council adopt the findings of the
Public Utilities Board with respect to the matters contained herein and adopt the amendments to the
Electric Rates. Rules. and Regulations as shown in Attachment A (Rule 13), Attachment B (Rule16),
and Attachment C (Rule 24): and
WHEREAS. based on the findings hereinabove made, the Public Utilities Board of
the City of Anaheim recommended to the City Council that the Council, by Motion, certify that the
adoption of the modified Rules 13, 16, and 24 of the Electric Rates, Rules, and Regulations is
statutorily exempt under the California Environmental Quality Act, Public Resource Code, Section
21080(b)t 8). in accordance with Title 14 of the California Administrative Code, Section 15273(a);

WHEREAS, the City Council has considered the evidence and concurs with the
findings of the Public Utilities Board as set forth herein above.

NOW. THEREFORE, BE IT RESOLVED by the City Council of the City of
Anaheim as follow,:

1. The findings set forth herein are hereby adopted by the City Council of the
City of Anaheim.
2. The amendments and modifications to the Electric Rates, Rules and
Regulations as set forth in Attachment A (Rule 13), Attachment B (Rulel6),
and Attachment C (Rule 24) shall be, and are hereby adopted by the City
Council of the City of Anaheim and shall be effective June 1. 2009.
3.
A CITY CLERK OF THE CITY OF ANAHEIM
The amendments and modifications to the Electric Rates, Rules and
Regulations as set forth in Attachment A (Rule 13), Attachment B (Rule16),
and Attachment C (Rule 24) shall automatically sunset and terminate without
further action by the City Council of the City of Anaheim on March 10, 2011.
4. The Public Utilities General Manager is authorized and directed to prepare,
promulgate. publish. and take any and all actions necessary to implement
the changes to the Electric Rates, Rules, and Regulations as set forth herein.
Neither this Resolution nor anything contained herein shall be construed as
amending or modifying any other existing fee resolution of the City of
Anaheim.

['he City shall_ if no undue hardship to its existing customers will result therefrom, furnish temporary
service under the following conditions:
The applicant shall pay in advance or otherwise as required by the City, the estimated cost
installed plus the estimated cost of removal, less the estimated salvage of the facilities necessary
for furnishing serv
The applicant shall establish credit as required by Rule No. 6, except that the amount of deposit
prescribed in Rule No. 7 shall not exceed the estimated bill for the duration of service.
If service is requested to any structure not of a permanent construction with a foundation, or which
can be classified as removable, such as trailers, billboards, sheds, signs, etc., they shall be
determined to be temporary and applicable to the terms and conditions of the requirements above
of this Rule.
Temporary service for construction purposes shall he discontinued to the applicant and removed if
it is used for other than the intended purpose. With the Utility's approval, a temporary service may
be used for non construction purposes when all applicable safety and construction codes are
adhered to. If a non utility approval power source is connected on the construction site, the
Utility's temporary service shall he discontinued. Service may be suspended without notice to the
applicant as required h% Rule No. i 4 -B.
Pursuant to the guidelines established in Resolution 2009- the collection of specified fees or charges
associated with the design, inspection, and connection fees applicable to the repair or reconstruction of structures
damaged as .i result of the Freeway Complex Fire shall be waived for those applicants deemed eligible with the
waiver of those fees expiring on March 10. 2011.

PREMISES.
Meter Installations
a. Location. All meters installed by the Utility shall be installed at some convenient place,
approved by the Utility. upon the customer's premises and so placed as to be at all times
accessible for inspection. reading and testing.
The customer shall, at his own expense, provide a new and approved location for the
meter or meters in order to comply with the foregoing whenever the existing meter or
meters becomes inaccessible for inspection. reading, or testing.
h. Separate Meters Required. Each single family dwelling or accommodation within a
residential multifamily accommodation will be separately metered by the Utility for new
installations on and after June 1, 1979, except where a commitment for installation of
other than separate metering has been made by the Utility to the owner /developer prior to
such date. However. if said commitment has not been exercised within an ensuing period
of twelve months, separate metering of electric service for each residential unit is
required.
Multiple- Occupancy Buildings. In all buildings in which meters are required to be
installed for various floors or groups of rooms in order to measure separately the
electrical energy supplied to each of several customers, all meters shall be located at one
central point or as otherwise specified by the Utility. Each meter position shall he clearly
marked, by the building owner. to indicate the particular location supplied by it.
d. Master Meters. A master meter will he furnished and installed by the Utility, except as
provided in Section A.1.0. above. upon application by the owner or lessee of any
residential building where the floors (or portions thereof) or rooms or groups of rooms
are rented separately and where electric energy is to he metered and resold by said owner
or lessee to the individual tenants as provided in Rule No. 18. In such cases, the said
owner or lessee shall furnish, install. maintain, and test the suhmeters.
Scaling of Meters. All utility meters will be sealed by the Utility, and no such seal shall
he tampered with or broken except by a representative of the Utility authorized to do so.

e. 'The City will furnish as a normal metering installation, meters adequate to measure at a
single point of delivery the demand and energy consumption, as specified in the rate tariff
or as determined by the Public Utilities General Manager the type of such meters to be
determined by the City. Provision must be made for installing a kilovar -hour meter on all
installations requiring a main switch of 600 amperes at 240 volts or 400 amps at 480
volts. The customer shall provide space acceptable to the Utility for the required
metering installation. Primary metering installations shall conform to the Utility's
requirements and specifications.
Miscellaneous Service Equipment
a. Equipment Furnished by Customer. All service switches, fuses, meter sockets, meter and
instrument transformer housing, switchboard meter test busses and similar devices,
irrespective of voltage. required in connection with service and meter installation on
customer's premises. shall be furnished, installed, and maintained by the customer in
accordance with the Utility's requirements. Detailed information will be furnished by the
Utility on request.
h. Equipment Furnished by Utility. The Utility will furnish and install the necessary
instrument transformers, test facilities (except switchboard meter test busses), and meters.
Also. the Utility, will furnish the metering enclosures when it deems it necessary to locate
metering equipment at a point that is not accessible to the customer.

Service Drops. Upon a bona fide application for service, and where the Utility's
distribution pole line is located on the customer's premises, or on a street, highway, lane,
alle',, road, or private easement immediately contiguous thereto, the Utility will, at its
own expense, furnish and install a single span of service wires from its pole to the
customer's first permanent support, provided such support is of a type, and is so located
that such service wires may be installed to a point approved by the Utility in accordance
with good engineering practice, and in compliance with all applicable laws, ordinances,
rules and regulations, including those governing clearances and points of attachments.
Impaired Clearance. Whenever any of the clearances required by the applicable laws,
ordinances. rules or regulations of public authorities from the service drops to the ground
or any object become impaired by reason of any changes made by the owner or tenant of
the premises. the customer shall, at his own expense, provide a new and approved
support, in a location approved by the Utility, for the termination of the Utility's existing
service drop wires and shall also provide all service entrance conductors and equipment
necessitated by the change of location.
Service Entrance Conductors. For each overhead service connection, the customer shall
furnish at his own expense a set of service entrance conductors which shall extend from
the point of service delivery at the point of termination of the Utility's service drop on the
customer's support to the customer's meter switch. Such service entrance conductors
shall be of a type and he in an enclosure which meets with the approval of the Utility and
City Electrical Inspector- Building Division- Development Services Department.

Underground Service Connections
a Any customer desiring the service conductors to be installed underground shall furnish.
install and maintain. at his expense, conduit or duct from a terminating pull box to the
pole, designated by the utility for the City on which the connection is to be made. The
customer shall also furnish at his expense, and convey to the Utility the necessary
material to reach the service arm of the designated pole. The Utility will thereafter own,
erect and maintain this material. Material furnished by the customer and its installation
shall he as specified by the Utility.

"1 size of conductors to he furnished or paid for by the customer will be determined by
the Utility and the Utility will assist on the installation at its expense. The customer shall
pay the cost of conductors for the entire distance. The customer shall furnish and install,
at his expense. a pull line as specified by the Utility.
Where the customer desires total underground facilities, the customer shall pay, prior to
the time of installation, the nonrefundable sum as determined by the Utilities Department.
The City will not install more than one service for the same voltage and phase
classification for any one building or group of buildings on a single premises, except as
separate services may he installed for a separate building or for groups of buildings.

I In cases where the City desires to install transformers on customer's premises, the customer shall
provide adequate space and easements for the transformer installation and furnish a satisfactory
right-}f-way for the service conductors.
a Where the customer has provided a fireproof room or vault at his expense, in which City
owned transformers and switching may be installed, the City will complete the
installation consisting of protective equipment, primary and secondary bus, and necessary
grounding.
h Where the customer has provided a concrete pad or foundation within an approved
enclosure. located outdoors. he shall also furnish and install, at his expense, all secondary
equipment and materials necessary to receive service at the secondaries of the
transformers n the secondary bus. The City will, at its own expense, complete the
installation.

The City reserves the right to specify the type of transformer installation to be used.
Each normal installation shall include, where necessary, facilities for one standard
transformation_
Premises for which arrangements are made for any special type of service (such as but not limited to: three
phase service to a residence. emergency. X -ray, welder, or transmitter service) will he served only by
underground connection where general service to the premises is by underground connection. All additions
to underground facilities to accommodate such service will be made by the Utility at the customer's
expense. Ownership of such additions will remain with the Utility.

CONNECTION OF CUSTOMER'S SERVICE TO UTILITY LINES
t)n3v duly authorized employees of the Utility are allowed to connect the customer's service or to
disconnect the same from the Utility's lines
OWNERSHIP AND MAINTENANCE OF FACILITIES
All transformers, meters, service wires, appliances, fixtures, and other facilities installed by the
Utility at its expense. upon the customer's premises for the purpose of delivering electric energy to
the customer shall continue to be the property of the Utility, and may be repaired or replaced by
the Utility at any time. and removed at the termination of service, and may also be used to supply
other customers whether or not on the same premises, provided the proper rights of way have been
obtained.
No rent or other charge whatsoever shall be made against the Utility for placing or maintaining
such facilities upon the customer's premises. The customer shall exercise reasonable care to
prevent the facilities of the Utility upon said premises from being damaged or destroyed, and shall
refrain from relocating or otherwise interfering with same and, in case any defect therein shall be
discovered, shall promptly notify the Utility thereof.
G CUSTOMER RESPONSIBILITY FOR OWN EQUIPMENT
The customer shall. at his own sole risk and expense, furnish, install, inspect and keep in good and
safe condition all electrical wires, lines, machinery, and apparatus of any kind of character which
may he required for (1) receiving electric energy from the lines of the Utility regardless of the
location of the transformers, meters, or other equipment of the Utility; and (2) applying and
utilizintl such energy, including all necessary protective appliances and suitable housing thereof.

The Utility shall not he responsible for any loss or damage occasioned or caused by the
negligence. want of proper care or wrongful act of the customer or of any of his agents.
employees. or licensees on the part of the customer in installing, maintaining, using, operating, or
interfering with any such wires. lines. machinery or apparatus.
The Utility,' shall, at all times. have the right of ingress to and egress from a customer's premises at
all reasonable hours for any purposes reasonably connected with the furnishing of electric energy
and the exercise of any and all right secured to it by law or these rules.
The utility shall require that each customer furnish the Utility, at the expense of the customer and
in the appropriate quantity as specified by the Utility, with the appropriate devices to gain access
to a customer's premises by way of keys. gate opener /clickers or a personal escort.
The Utility may charge a meter reading fee if the Utility cannot gain access to the customer's
metering equipment on the scheduled read date.
Rule No. 23 contains the above referenced charges.

The following charges. lees and bonds are to he assessed, as appropriate, from builders, developers and customers
requiring the Utili■'s services or reallocations.
SUBDIVISIONS RESIDENTIAL
1. Chapter 17.08.450 of Municipal Code requires developers to post a Subdivision and Tract
Improvement Bond for Public Improvements. The estimated cost for electrical underground
utilities: S4.500 per acre.
t3. Rule 15.1. Underground Extension Within New Residential Subdivision, of the Electric Rates.
Rules and Regulations provides that the developer, subdivider or other customers requesting
extensions within new residential subdivisions shall pay, before start of construction, a non-
refundable sum as determined by the Utility based upon:
111 costs for labor and material for the installation of said underground system, and the
preparation of plans. specifications and inspections for said system.
By a unit price per lot or dwelling unit, as established in paragraph B.4.b of Rule 15.1.
based upon historical costs adjusted annually.
In accordance with these Rules and Regulations, the following charges are established:
S1.550 per lot for RS -5000 and RS -7200 subdivisions where single family Tots
are under 9,999 square feet and padmounted transformers are required. If the
developer, subdivider or other customers request underground transformers, the
post will be an additional $400 per lot.
S1,700 per single family lot for lots in RS- 10,000 and RS- 22,000, and RSHS-
10.000 and RSHS 22,000 subdivisions where lots are larger than 10,000 square
feet and padmounted transformers are required. If the developer, subdivider or
other customers request underground transformers, the cost will he an additional
S400 per lot.
S2.300 per individual single family residence where an individual padmounted
transformer is required If the developer, subdivider or other customers request

If a residential subdivision/development, or individual residence is of a
nontypical layout (based on current typical single family or multifamily
developments as outlined above), the per lot/unit charge will be established by
the Electrical Engineering Division on an individual estimated basis to recover
all costs of labor and expense incurred by Anaheim Public Utilities in making
such installation.
In addition to the above tees, the developer shall provide all necessary trenching, conduits,
pull /splice vaults. hackfilling. and related work in accordance with Rule 15.1.
II construction of the suhdivision underground utility facilities has not begun within 12 months of
the date of the fee payment. the per lot fee shall be escalated by 10% per lot and paid by the
developer before construction proceeds.
These unit costs are reviewed and updated on an annual basis to reflect current expenses incurred
by the City for installation of this type of underground facility.
Fees for installation of an Underground Line Extension (backbone) in developer provided conduit
and substructure systems will be determined by the Electrical Engineering Division, and billed

Applicants requesting temporary electrical service shall pay, before start of construction, for each
installation and will he charged on an individual estimated basis to recover costs of labor and
expense incurred by the City in making such installation.
STREET LIGHTS
Chapter 18.04.080.030 of the Municipal Code requires the installation of street lighting facilities
or payment of street lighting per front foot fee. The ordinance requires all new developments to
install the street lighting facilities required in accordance with the official street lighting standards
on file in the Puhlic Utilities Department. Front foot fees are only collected when street lighting
facilities are existing and if the property has not previously paid a street light front foot fee.
The font toot fee for street lighting k 56.00 per front foot (Ordinance 4017 June 5, 1979).
Developers /builders /contractors are required to post a performance bond with the City to assure
installation of public improvements. The bond required for the street lighting facilities, which is a
part pr the Puhlic Improvements Bond deposited with the Real Property Section of the
Engineering division. Puhlic Works Department, is determined on a per front foot basis for
ahutting dedicated streets or highways at $32.00 per front foot; minimum $3.200.00 bond.
Private Streets Public Works department, Engineering Division Standard Detail No. 122, Note
10-A -4. states: Lighting adequate for pedestrian and vehicle safety and sufficient to minimize
police problems as approved by the Puhlic Utilities General Manager shall be provided."
It is the Puhlic Utilities Department's policy that street lighting on private streets be in accordance
with ILS street lighting recommendations. The luminaire and pole should be as required by the
developer and not the City's street lighting unit. Street lighting on private street shall be metered
in ac. rdance with the Utilities Rates, Rules and Regulations and service requirements. If a
private street is approved for dedication to the City as a public street, the street lights shall be
installed per Cite Standards and Specifications by the owner and the circuit re -wired for City
service prior to acceptance of dedication by the City.
Pursuant ur the guidelines established in Resolution 2009- the collection of specified fees or charges
associated with the deli« n, inspection. and connection fees applicable to the repair or reconstruction of structures
damaged as a result of the Freeway Complex Fire shall be waived for those applicants deemed eligible with the
waiver o+ these fees expiring on March 10. 2011.

AI REIMBURSEMENT FOR ACCESS REQUEST EVALUATION COSTS

IX ASSIGNMENT TRANSFER FEES
In the event that rights to any privately constructed facility are to be assigned to the City of
Anaheim, the assignment of rights under written agreement shall require prior City Council
appro‘ al and shall be subject to a fee of three hounded dollars ($300.00) to cover the cost of
processing the assignment.
X REIMBURSEMENT FOR TARIFF SHEETS
The tariff sheets with Rates, Rules and Regulations for the Electric Utility are available on -line at no cost. To
recover the ,ost of paper. disks. and personnel time of providing this information to requesting
ustomers /organizations, a charge of S5 per disk or $10 per paper copy will be assessed.
