RES-2007-081RESOLUTION NO. 2007 -081 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM APPROVING AN AMENDMENT TO THE PLATINUM TRIANGLE MASTER LAND USE PLAN (MISCELLANEOUS CASE NO. 2007 00187) WHEREAS, The Platinum Triangle comprises approximately 820 acres located at the confluence of the Interstate 5 Freeway and the SR -57 Freeway in the City of Anaheim, County of Orange, State of California, generally east of the Interstate 5 Freeway, west of the Santa Ana River channel and SR -57 Freeway, south of the Southern California Edison easement, and north of the Anaheim City limit area and which area is further depicted in "Figure LU -5: Areas of the City with Special Density Limitations" of the City of Anaheim General Plan and which Figure is incorporated herein as if set forth in full; and WHEREAS, the adopted General Plan envisions The Platinum Triangle as a thriving economic center that provides residents, visitors and employees with a variety of housing, employment, shopping and entertainment opportunities that are accessed by arterial highways, transit systems and pedestrian promenades (set forth in Goal 15.1 of the Land Use Element); and WHEREAS, the recently adopted General Plan includes policies in the Land Use Element and the Community Design Element to implement the vision for The Platinum Triangle including providing for more detailed planning efforts to guide the future development of The Platinum Triangle; encouraging mixed -use projects integrating retail, office and higher density residential land uses; encouraging a regional inter -modal transportation hub in proximity to Angel Stadium of Anaheim; maximizing and capitalizing upon the view corridor from the Santa Ana (I -5) and Orange (SR -57) Freeways; maximizing views and recreation and development opportunities afforded by the area's proximity to the Santa Ana River; developing a comprehensive Mixed -Use Overlay Zone and Design Guidelines to implement the vision for The Platinum Triangle; providing for a mix of quality, high- density urban housing that is integrated into the area through carefully maintained pedestrian streets, transit connections, and arterial access; developing a Public Realm Landscape and Identity Program to enhance the visibility and sense of arrival into The Platinum Triangle through peripheral view corridors, gateways, and specialized landscaping; developing a strong pedestrian orientation throughout the area, including wide sidewalks, pedestrian paths, gathering places, ground -floor retail, and street -level landscaping; encouraging extensive office development along the highly visible periphery of the area to provide a quality employment center; developing criteria for comprehensive property management agreements for multiple family residential projects to ensure proper maintenance as the area develops; and, identifying and pursuing opportunities for open space areas that serve the recreational needs of Platinum Triangle residents and employees; and WHEREAS, on August 17, 2004, the City Council of the City of Anaheim adopted The Platinum Triangle Master Land Use Plan by Resolution No. 2004 -178 and The Platinum Triangle Standardized Development Agreement by Resolution No. 2004 -179 and on August 24, 2004, the City Council adopted the Platinum Triangle Mixed Use (PTMU) Overlay Zone by Ordinance No. 5935; and WHEREAS, the Platinum Triangle Master Land Use Plan provides for the implementation of the General Plan vision, goals and policies for The Platinum Triangle and will serve as a blueprint for future development and street improvements within The Platinum Triangle, including setting forth planning principles, development intensities, conceptual street, park and potential new signalized intersection locations and streetscape designs including, but not limited to, landscaping, lighting fixtures and street furniture and by identifying the existing Amtrack/Metrolink Station and the conceptual Anaheim Regional Transportation Intermodal Center (ARTIC) location; and WHEREAS, the Anaheim City Planning Commission did receive a verified petition for an amendment to The Platinum Triangle Master Land Use Plan (Miscellaneous Case No. 2007 00187) to increase the maximum number of dwelling units in the Gateway District from 2,075 to 2,396, which would result in an increase in the total number of permitted dwelling units in The Platinum Triangle from 9,500 to 9,821; and WHEREAS, thereafter, on April 10, 2007, the applicant reduced the request for an increase in the number of permitted dwelling units to provide that the additional number of dwelling units permitted in the Gateway District be increased from 2,075 to a total of 2,142, which would result in an increase in the total number of permitted dwelling units in The Platinum Triangle from 9,500 to 9,567; and WHEREAS, said petition is intended to increase the development cap by 67 dwelling units to provide for the development of the proposed A -Town Stadium project (an 878 unit, phased residential development, including six development areas with up to two high -rise towers, two public parks, public streets and infrastructure, on approximately 12.48 acres located at 2050 South State College Boulevard and 2025, 2115, and 2125 East Orangewood Avenue) and the Orangewood Condominiums project (a 341 -unit residential project on approximately 3.81 acres located at 2211 East Orangewood Avenue); and WHEREAS, the Anaheim City Planning Commission did hold a public hearing at the Civic Center in the City of Anaheim on April 30, 2007, at 2:30 p.m., notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.60, to hear and consider evidence for and against an amendment to The Platinum Triangle Master Land Use Plan (Miscellaneous Case No. 2007- 00187) to investigate and make findings and recommendations in connection therewith; and WHEREAS, on April 30, 2007, said Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of all oral and written evidence and reports offered at said hearing, did adopt its Resolution No. PC2007 -39 finding and recommending that the City Council approve the proposed amendment to The Platinum Triangle Master Land Use Plan (Miscellaneous Case No. 2007 00187) based upon the findings and facts as set forth in Resolution No. PC2007 -39; and 2 WHEREAS, the Anaheim Planning Commission has reviewed the proposed amendment to The Platinum Triangle Master Land Use Plan (Miscellaneous Case No. 2007- 00187) and did recommend, by its motion, that the City Council, based on its independent review of all evidence received at the public hearing, along with previously- certified FSEIR No. 332 and its Second Addendum, and Mitigation Monitoring Program No. 106A and the requirements of California Environmental Quality Act "CEQA including Section 21166 of the California Public Resources Code and Section 15162 of the CEQA Guidelines, and unless additional or contrary information is received during the public meeting, find and determine, that FSEIR No. 332 and its Second Addendum, including Mitigation Monitoring Program No. 106A, are adequate to serve as the required environmental documentation for the proposed Amendment and satisfy all the requirements of CEQA; and that no further environmental documentation need be prepared for said Amendment to the Platinum Triangle Master Land Use Plan (Miscellaneous Case No. 2007 00187); and WHEREAS, on June 5, 2007, the City Council held a duly noticed public hearing, gave all persons interested therein an opportunity to be heard, and independently reviewed and considered the evidence presented in the Staff Report to the City Council, including the recommendations and findings of the Anaheim City Planning Commission as set forth in Planning Commission Resolution No. PC2007 -39, and the oral and written evidence presented at the City Council public hearing; and WHEREAS, the City Council, after due consideration of the recommendations and findings of the Anaheim City Planning Commission, and all evidence, testimony and reports offered at said hearing, does hereby declare and find as follows: 1. That, by its Resolution No. PC2007 -39, the Planning Commission has recommended that City Council approve the proposed amendment to The Platinum Triangle Master Land Use Plan. 2. That said amendment to The Platinum Triangle Master Land Use Plan is consistent with the vision, goals and policies for the development of The Platinum Triangle as set forth in the City of Anaheim General Plan, as proposed for amendment by General Plan Amendment No. 2006 00449. 3. That the proposed amendment to The Platinum Triangle Master Land Use Plan is consistent with the goals and intent set forth in The Platinum Triangle Master Land Use Plan. WHEREAS, pursuant to the provisions of the California Environmental Quality Act "CEQA the City Council, as lead agency for the amendment to the Platinum Triangle Master Land Use Plan (Miscellaneous Case No. 2007 00187), by motion, does find and determine, based upon its independent review of the previously- certified FSEIR No. 332 and its Second Addendum, including Mitigation Monitoring Program No. 106A, that there are no changes to the originally approved Platinum Triangle Master Land Use Plan that would result in 3 significant adverse environmental impacts not otherwise addressed in the previously- certified environmental documents, and that the previously- certified FSEIR No. 332 and its Second Addendum, including Mitigation Monitoring Program No. 106A, are adequate to serve as the required environmental documentation for the Amendment and satisfy all of the requirements of CEQA, and that no further environmental documentation need be prepared for the amendement to the Platinum Triangle Master Land Use Plan (Miscellaneous Case No. 2007 00187). NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Council does hereby approve the amendment to the Platinum Triangle Master Land Use Plan (Miscellaneous Case No. 2007 00187), to increase the maximum number of dwelling units in the Gateway District from 2,075 to 2,142 and maximum number of dwelling units in the Platinum Triangle from 9,500 to 9,567.
