A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM FINDING THAT IT IS IN THE BEST INTEREST
OF THE CITY TO AUTHORIZE THE SALE OF CITY OWNED
SURPLUS PROPERTY WITHOUT COMPLYING WITH CITY
CHARTER SECTION 1222 AND AUTHORIZE CITY TO
ENTER INTO A PURCHASE AND SALE AGREEMENT WITH
KAISER FOUNDATION HOSPITALS FOR THE SALE OF
CITY OWNED SURPLUS PROPERTY COMPRISING OF THE
SOUTHWEST END OF GROVE STREET (ACQ 6228)
WHEREAS. the City of Anaheim "City owns that certain property, consisting
of approximately 9,285 square feet, located generally on the southwest end of the Grove Street
cul -de -sac. In the City of Anaheim. California (hereinafter "Property and
WHEREAS, the surplus Property is excess right -of -way and was vacated on
December 16, 2008 pursuant to Resolution 2008 -212 and recorded January 20, 2009 with the
Orange County Recorder's Office; and
WHEREAS, the Property is no longer required for municipal purposes; and
WHEREAS, an appraisal of the Property was conducted and determined the fair
market value of the Property to be 5192,000: and
WHEREAS, Section 1222 (Sale of Municipal Property) of the City Charter, states
that surplus municipal property with a market value in excess of Fifty Thousand Dollars
(550,000), shall be sold to the highest bidder after pt. )lication of the request for bids in the
official newspaper of the City, appraisal by the City, and Council acceptance of the bids; unless
City Council finds it in the best interest of the City to sell the Property without advertising for
bids or otherwise complying with the provisions of Section 1222 of the City Charter and
authorize the same b. an affirmative vote of two thirds of the members of the City Council; and
WHEREAS, Kaiser Foundation Hospitals "Kaiser has agreed to pay the fair
market value for the Property;
WHEREAS, the Property can only be fully used by Kaiser and as such, staff
requests that Council find it to be in the best interest of the City to sell the Property without
complying with the provisions of City Charter Section 1222 and authorize the City to enter into a
Purchase and Sales Agreement with Kaiser.
NOW, THEREFORE, BE IT RESOLVED that the City Council finds and
determines, for the above stated reasons, that it is in the best interest of the City to sell the
Property without advertising for bid or otherwise complying with the provisions of Section 1222
particularly described in Exhibits "A" and "B attached hereto and incorporated herein.
BE IT FURTHER RESOLVED that the City Council hereby authorizes the City
to enter into a Purchase and Sale Agreement with Kaiser for the Property described herein.
THE FOREGOING RESOLUTION is approved and adopted by the City Council
of the City of Anaheim this 27th day of January 2009, by the following roll call vote:

office of the County Recorder of said county on August 8, 2008,

COMMENCING at the southwesterly corner of Parcel 1 of said map; thence
along the southerly line of said parcel North 74 °08'54" East 735.04 feet
to a point on the southerly Right -Of -Way line of Grove Street, said
point being the TRUE POINT OF BEGINNING; thence along the Right -Of -Way
