A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM APPROVING AND ADOPTING GENERAL
PLAN AMENDMENT NO. 2008 -00467 PERTAINING TO
THE HOUSING ELEMENT.
WHEREAS, the City of Anaheim (`City pursuant to the recommendations of
the Planning Commission of the City of Anaheim, has heretofore adopted a General Plan for the
City; and
WHEREAS, the Housing Element identifies and analyzes existing and projected
housing needs and includes a statement of goals, policies, quantified objectives, and scheduled
programs for the preservation, improvement and development of housing; and
WHEREAS. the City. in adopting a Housing Element, must comply with the
statutory provisions of Article 10.6, Government Code Section 65580 et seq.; and
WHEREAS, the City is required to amend the Housing Element of its General
Plan as frequently as appropriate; and
WHEREAS, on October 29, 2002. the City Council, by its Resolution No. 2002-
229. approved and adopted the Housing Element for the 1998 -2005 planning period; and
WHEREAS, the City has prepared a revised draft Housing Element which
describes the current status of housing in the City; reviews the City's accomplishments in
meeting the objectives set forth in the current Housing Element; provides an overview of the
housing market as it relates to population and household trends; and assesses the City's existing
and future housing needs. and discusses both governmental and non governmental constraints in
meeting identified housing needs; and
WHEREAS, the revised draft Housing Element describes the housing goals for
the City through the year 2014: and
WHEREAS, pursuant to Government Code Section 65586, the City has submitted
its draft Housing Element for review and comment by the Department of Housing and
Community Development "HCD" which is required to review draft housing elements and
report its findings to the locality: and
WHEREAS, the City has addressed all of the comments and findings made by
HCD to the City in its revised draft Housing Element; and
WHEREAS, on July 8. 2009. the City of Anaheim Planning Commission did hold
a public hearing to consider an amendment to the Anaheim General Plan, designated as General
Plan Amendment No. 2008 00467, amending the Housing Element of the Anaheim General
Plan, including the revisions incorporated in response to the comments and findings made by
HC D: and
WHEREAS. at said public hearing, the Anaheim City Planning Commission did
duly adopt its Resolution No. PC2009 -068 containing a report of its findings, a summary of the
evidence presented at said hearing. and recommending that General Plan Amendment No. 2008-
00467 be adopted by the City Council: and
WHEREAS, upon receipt of said Resolution, summary of evidence, report of
findings and recommendations of the Anaheim City Planning Commission, the City Council did
fix the 11th day of August, 2009, as the time. and the City Council Chamber in the Civic Center
as the place for a public hearing on said proposed General Plan Amendment and did give notice
thereof in the manner and as provided by law; and
WHEREAS, the City Council did duly hold and conduct such public hearing and
did give all persons interested therein an opportunity to be heard, and did receive evidence and
reports and did consider the findings and recommendations of the Anaheim City Planning
Commission; and
WHEREAS. pursuant to the provisions of the California Environmental Quality
Act. the City Council, as lead agency for General Plan Amendment No. 2008 00467, does
hereby find and determine that the Mitigated Negative Declaration is adequate to serve as the
required environmental documentation in connection with said General Plan Amendment upon
finding that the declaration reflects the independent judgment of the lead agency and that it has
considered the Mitigated Negative Declaration together with any comments received during the
public review process and further finding on the basis of the initial study and any comments
received that there is no substantial evidence that the project will have a significant effect on the
environment: and
WHEREAS, the City Council does hereby determine that General Plan
Amendment No. 2008 -00467 amending the Housing Element of the City of Anaheim General
Plan setting forth the housing goals. policies and programs that the City intends to implement
through the year 2014 should be approved based upon the following findings:
1 That the proposed amendment maintains the internal consistency of the General
Plan. as the proposed modifications to the General Plan are consistent with General Plan goals
related to housing and does not require any amendments to any of the other General Plan
elements. with the exception of possible future amendments proposed by Housing Element
Strategies 3F and 3G. which require review of the Green and Community Design Elements to
ensure park and open space typology and requirements will serve the City's growing population
and infill development and that the design guidelines adequately provide aesthetic direction for
future residential development; and
The proposed amendment would not be detrimental to the public interest, health,
safety, convenience. or welfare of the City in that the proposed amendment would provide
housing policy, in compliance with State law, to meet the housing needs for all economic
segments of the community for the 2006 -2014 planning period; and
3. The proposed amendment would not amend the General Plan Land Use Map;
and. therefore. does not alter the balance of land uses as currently identified in the General Plan.
NOW. THEREFORE, BE IT RESOLVED by the City Council of the City of
Anaheim that General Plan Amendment No. 2008 -00467 amending the Housing Element, as set
forth in the document titled "City of Anaheim Housing Element 2006 2014 a copy of which is
on file in the Planning Department of the City of Anaheim and incorporated herein by this
reference, he, and the same is hereby, approved.
THE FOREGOING RESOLUTION is approved and adopted by the City Council
of the City of Anaheim this 11 thday of August 2009, by the following roll call vote:
