A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM AUTHORIZING THE DIRECTOR OF PUBLIC
WORKS OR HER DESIGNEE TO SUBMIT AN APPLICATION
ON BEHALF OF THE CITY OF ANAHEIM TO THE
CALIFORNIA STATE DEPARTMENT OF HOUSING AND
COMMUNITY DEVELOPMENT FOR THE INFILL
INFRASTRUCTURE GRANT PROGRAM, AND IF
AWARDED, AUTHORIZING THE ACCEPTANCE OF SUCH
PROJECT ASSISTANCE ON BEHALF OF THE CITY
WHEREAS, funds are available through the California State Department of Housing
and Community Development "HCD for the Infill Infrastructure Grant Program (the "Grant
established under the Housing and Emergency Shelter Trust Fund Act of 2006 (Proposition 1C)
pursuant to the Infill Infrastructure Grant Program established under Part 12 of Division 31 of
California Health and Safety Code, commencing with Section 5345.12 et seq (the "Statute and
WHEREAS, pursuant to the Statute, HCD is authorized to approve funding allocations
utilizing monies made available by the State Legislature, subject to the terms and conditions of
the Statute and the Infill Infrastructure Grant Program Guidelines implemented February 28,
2008; and
WHEREAS, the City of Anaheim, a municipal corporation and charter city (the "City
is familiar with the terms, conditions and limitations of any such Grant; and
WHEREAS, the City is willing and able to conform to each of the terms, conditions and
limitations imposed upon any such Grant to the City; and
WHEREAS, the City desires to apply for and accept an allocation of funds through the
Infill Infrastructure Grant Program, which may be awarded to the City.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim
as follows:
1. The Anaheim Director of Public Works or her designee is hereby authorized to
submit an application for and on behalf of the City of Anaheim, a public entity
established under the laws of the State of California, and the Anaheim Director of
Public Works, or her designee is authorized to execute any actions necessary for the
purpose of obtaining the assistance provided by California State Department of
Housing and Community Development "HCD (the "Grantor including any
extensions and amendments thereof.
2. The City Council of the City of Anaheim hereby agrees to, and by this resolution,
does accept any such Grant so awarded to the City of Anaheim without further action
of the City Council being required therefore.
3. The City shall submit to HCD an application to participate in the Grant in response to
the Notice of Funding Availability issued on February 28, 2008 which will provide
funding for the following activities:
A. Street Improvements.
East Street from Lincoln Avenue to Santa Ana Street. The improvements
shall consist of resurfacing, removing and reconstructing of the existing
pavement, removal of curb, and replacement of curb and gutter. The
improvements shall also consist of re- striping, traffic signal loop
modifications and the adjustment to grade of existing utility fixtures. These
proposed improvements are integral and necessary to facilitate development
of the Qualified Infill Project (the "QIP as additional traffic flow will be
generated due to the fact that East Street is a major corridor to access the
proposed QIP development.
ii. Lincoln Avenue Beautification from Evergreen to East Street. The
improvements shall include median curb installation, curb and gutter
widening, street signal installation to improve safety, irrigation and
landscaping of the median and parkway. Such improvements shall improve
the aesthetics of the street adjoining the QIP or CHOC site.
iii. Olive Street and South Street from Vermont Avenue to Santa Ana Street and
from Olive Street to the Railroad Tracks. The improvements along Olive
Street and South Street shall consist of resurfacing, removal and
reconstruction of the existing pavement, removal of curb and replacement of
curb and gutter. The improvements shall also include re- striping, traffic
signal loop modifications, and the adjustment to grade of existing utility
fixtures. These proposed improvements are integral and necessary to facilitate
the development of the QIP as additional traffic flow will be generated from
the proposed site onto Olive Street and South Street.
B. Sewer Improvements.
Lincoln Avenue sewer from East Street to Larch Street. The sewer
improvement along Lincoln Avenue shall consist of the upgrade of the
existing 10 inch sewer line with 1800 linear feet of 15 and 12 inch vitrified
clay pipe "VCP sewer line. The proposed sewer improvements shall help
to accommodate the flow produced from the development of the QIP.
ii. South Street sewer from Lemon Street to East Street. The sewer
improvements along South Street shall consist of upgrading the existing 8
inch sewer line with 4200 linear fee of new 15, 18 and 21 inch VCP. These
proposed sewer improvements shall help to ease the downstream deficiency
caused by the additional flow produced from the QIP development.

THE FOREGOING RESOLUTION is approved and adopted by the City Council
of the City of Anaheim this 22nd day of April 2008, by the following roll
call vote:

4. The City of Anaheim hereby agrees to comply with each and all of the terms,
conditions and limitations imposed by the Grantor upon said Grant, and the Anaheim
Director of Public Works or her designee is hereby authorized and directed to execute
any agreements, assurances, or other documents as may be necessary in connection
with the acceptance of said Grant as may be required by the Grantor, if such Grant is
awarded to the City.
5. The annual budget of the City of Anaheim for Fiscal Year 2008 -09 is hereby
amended by increasing the appropriations and authorized expenditures in such
amount equal to the amount of the Grant funds to be received by the City.
