AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM DISSOLVING THE ANAHEIM REDEVELOPMENT
COMMISSION AND THE ANAHEIM HOUSING COMMISSION
AND CONCURRENTLY CREATING AND ESTABLISHING THE
ANAHEIM REDEVELOPMENT AND HOUSING COMMISSION
WHEREAS, the Anaheim Redevelopment Agency (the "Agency"), a
public body, corporate and politic, formed, organized, existing
and exercising its powers pursuant to the California Community
Redevelopment Law, Health and Safety Code Section 33000 et seq.
(the "CRL"), was specifically formed by Resolution No. 6966 of
the City of Anaheim (the "City") adopted by the City Council of
the City on June 6, 1961; and
WHEREAS, subsequent to the adoption of Resolution No. 6966,
the City became a Chartered City and by a provision of the
Charter, it was provided that all lawful ordinances and
resolutions in force at the time of the adoption of the Charter
were continued in full force and effect and, therefore, said
Resolution No. 6966 is still in full force and effect; and
WHEREAS, the City Council of the City of Anaheim (the "City
Council") has declared itself to be the Redevelopment Agency and
established a Community Redevelopment Commission (the
"Redevelopment Commission") by Ordinance No. 2934 adopted on June
8, 1971, adding Sections 1.04.500 through 1.04.550, inclusive, to
the Anaheim Municipal Code; and
WHEREAS, the Anaheim Housing Authority (the "Authority"), a
public body, corporate and politic, formed, organized, existing
and exercising its powers pursuant to the California Housing
Authorities Law, Health and Safety Code Section 34200, et seq.
(the "HAL"), was specifically formed by Ordinance No. 3424
adopted by the City Council on May 13, 1975; and
WHEREAS, the City Council has declared the members of the
City Council to be the commissioners of the Housing Authority and
established an advisory Housing Commission (the "Housing
Commission") by Ordinance No. 3527 adopted on April 27, 1976,
adding Sections 1.04.600 through 1.04.640, inclusive, to the
Anaheim Municipal Code; and
WHEREAS, the City Council has determined that in furtherance
of more efficient and effective government and in the best
interests of the community it is no longer necessary or desirable
to have two separate commissions to perform redevelopment and
housing advisory functions as required or authorized by the CRL
and the HAL, respectively; and
WHEREAS, the City Council has determined the establishment
of a single joint commission to perform the functions formerly
provided and performed by the Redevelopment Commission and the
Housing Commission will better serve the needs of the City, the
Agency and the Authority; and
WHEREAS, the City Council has determined the new joint
commission shall be called the "Anaheim Redevelopment and Housing
Commission" (the "Redevelopment and Housing Commission") which
shall consist of seven (7) members, consistent with the
objectives of Section 33201, et seq., of the CRL and Sections
34290 through 34292, inclusive, of the HAL, and two (2) members
of the seven member Commission shall be tenants of the Authority
consistent and in compliance with Section 34290 of the HAL, and
all members of the Commission shall be appointed by the City
Council pursuant to the policies set forth in the City Charter,
this ordinance and any bylaws of the Commission.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES
HEREBY ORDAIN AS FOLLOWS:
SECTION 1.
The Anaheim Redevelopment Commission created by Ordinance
No. 2934 is hereby dissolved and Ordinance No. 2934 is hereby
repealed. The offices of the Redevelopment Commission are hereby
vacated and the capacity of the Redevelopment Commission to
transact business or exercise any powers is hereby suspended.
SECTION 2.
The Anaheim Housing Commission created by Ordinance No. 3527
is hereby dissolved and Ordinance No. 3527 is hereby repealed.
The offices of the Housing Commission are hereby vacated and the
capacity of the Housing Commission to transact business or
exercise any powers is hereby suspended.
SECTION 3.
Sections 1.04.500 through 1.04.550, inclusive, of Chapter
1.04 of Title 1 of the Anaheim Municipal Code, relating to the
Community Redevelopment Commission, be, and the same are hereby,
repealed.
SECTION 4.
Sections 1.04.600 through 1.04.640, inclusive, of Chapter
1.04 of Title 1 of the Anaheim Municipal Code, relating to the
Housing Commission, be, and the same are hereby, repealed.
SECTION 5.
The City does hereby adopt the procedural provisions of the
CRL and the HAL as set forth in the California Health and Safety
Code.
SECTION 6.
New Sections 1.04.500 through 1.04.560 be, and the same are
hereby, added to Chapter 1.04 of Title 1 of the Anaheim Municipal
Code, relating to the creation of a Redevelopment and Housing
Commission, to read as follows:
111.04.500 ANAHEIM REDEVELOPMENT AND HOUSING COMMISSION.
There is hereby established the Anaheim Redevelopment
and Housing Commission in accordance with the applicable
provisions of the Community Redevelopment Law and the
Housing Authorities Law of the State of California and
subject to the restrictions therein contained.
1.04.510 COMMISSION MEMBERSHIP AND TERMS.
.010 The Anaheim Redevelopment and Housing Commission
shall consist of seven (7) members, two of whom shall be
tenant members consistent with the Housing Authorities Law,
and none of whom shall hold any paid office or employment in
the City Government and each of whom shall comply with the
applicable provisions of the Community Redevelopment Law and
the Housing Authorities Law.
.020 The members of the Anaheim Redevelopment and
Housing Commission shall be appointed by the City Council
from the qualified electors of the City and shall be subject
to removal by motion of the City Council duly adopted by the
affirmative votes of a majority thereof.
.030 Each member shall serve for a term of four (4)
years and until his or her successor is appointed and
qualified; provided, however, that the terms of the members
first appointed shall expire as designated by the City
Council at the time of their appointments, as follows:
One on the thirtieth day of June of the first year
following appointment; two (including one tenant
commissioner) on the thirtieth day of June of the second
year following appointment; two (including one tenant
commissioner) on the thirtieth day of June of the third year
following appointment; and two on the thirtieth day of June
of the fourth year following appointment.
.040 A vacancy occurring before expiration of the term
of a Commission member shall be filled by appointment by the
City Council for the remainder of the term.
1.04.520 ORGANIZATION AND MEETINGS.
The Commission shall, as soon as practical after its
organization under Section 1.04.510 above, and each year
thereafter at its first regular meeting on or after July 1
of such year, elect a Chairman and Vice -Chairman in
accordance with the provisions of Section 904 of the City
Charter; provided, however, that the Commission shall meet
at least four (4) times each calendar year. A regular
meeting time may be established by the Commission through
its bylaws. A majority of the members of the Commission
shall constitute a quorum. A majority of the quorum present
and qualified to vote shall be required to approve any
action or motion of the Commission.
.010 Conduct and carry out jointly those functions and
in the manner as provided in the Community Redevelopment Law
and Housing Authorities Law.
.020 Perform such advisory functions, if any, as may be
required and assigned from time to time by the City Council.
1.04.540 COMPENSATION AND REIMBURSEMENT OF EXPENSES.
Members of the Redevelopment and Housing Commission
shall serve without compensation but shall be reimbursed for
travel and subsistence expenses incurred in the performance
of their duties while away from the City of Anaheim in
accordance with Council Policy and to the extent that
appropriations for such travel allowance have been provided
by the City Council.
1.04.550 APPROPRIATIONS.
The City Council shall annually, or from time to time,
appropriate to the Commission such sum or sums of money as,
in the opinion of the City Council, are necessary to carry
out the purposes of the Commission."
1.04.560 RULES AND BYLAWS.
The Commission may adopt rules of order and/or bylaws
relating to its meetings provided that any such rules or
bylaws shall require the approval of the City Council."
THE FOREGOING ORDINANCE is approved and adopted by the City
Council of the City of Anaheim this 22ndday of July 1997.
