A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM ADOPTING THE NEGATIVE
DECLARATION AND DETERMINING ITS ADEQUACY
TO SERVE AS THE REQUIRED ENVIRONMENTAL
DOCUMENTATION FOR THE HIDDEN CANYON PUMP
STATION IMPROVEMENT PROJECT
WHEREAS, the City of Anaheim (the "City ") proposes to implement the Hidden
Canyon Pump Station Improvement Project (the "Project "); and
WHEREAS, the Project consists of the following: (i) the replacement of existing
outdated pumps with an equal number of new pumps; (ii) the installation of an emergency diesel
generator and a 580 square foot concrete masonry enclosure for the generator; and (iii) the
acquisition of a 2,745 square foot parcel of land for the new generator building, and
WHEREAS, the City is the lead agency for the preparation and consideration of
environmental documents for the Project, as defined in the California Environmental Quality Act
of 1970, as amended ( "CEQA ") and the State of California Guidelines for the Implementation of
the California Environmental Quality Act (the "CEQA Guidelines "); and
WHEREAS, a draft Negative Declaration was prepared, in accordance with
CEQA and the CEQA Guidelines, and was circulated for a 20 -day public /responsible agency
review on April 11, 2011, in compliance with the requirements of CEQA and the CEQA
Guidelines. A complete copy of the Negative Declaration is on file and can be viewed in the
Anaheim Public Utilities Department, Environmental Services Division; and
WHEREAS, the City conducted its own independent evaluation and analysis of
the documentation prior to releasing it for public review and determined that a Negative
Declaration was appropriate as the Project would not result in any new significant environmental
impacts and that further environmental analysis beyond the analysis contained in the Initial
Study was not warranted; and
WHEREAS, based upon a thorough review of the Project and the Negative
Declaration, including the comments received to date and the responses prepared, staff finds that
the Project would not result in any new significant environmental impacts or that potentially
significant impacts have been eliminated or reduced to a level considered less than significant;
and, that there is no substantial evidence that the Project will have a significant effect on the
environment.
NOW THEREFORE, BE IT RESOLVED, based upon the foregoing findings and
recitals, that the Anaheim City Council hereby adopts the Negative Declaration, and does find
and determine its adequacy to serve as the required environmental documentation for the Project,
based upon a finding by the City Council that the Negative Declaration reflects the independent
judgment and analysis of the City Council; that it has considered the proposed Negative
Declaration together with any comments and responses received during the public review
process; and, further finding on the basis of the Initial Study that there is no substantial evidence
that the Project will have a significant effect on the environment.
THE FOREGOING RESOLUTION is approved and adopted by the City Council
of the City of Anaheim this 17th day of M , 2011, by the following roll call vote:

Determination: Based on a review of the Project as proposed, the Department of Fish
and Game has determined that for purposes of the assessment of CEQA filing fees [F &G
Code 711.4(c)] the project has no potential effect on fish, wildlife and habitat and the
project as described does not require payment of a CEQA filing fee. This determination
does not in any way imply that the project is exempt from CEQA and does not determine
the significance of any potential project effects evaluated pursuant to CEQA.
Please retain this original determination for your records; you are required to file a copy
of this determination with the County Clerk after your project is approved and at the time
of filing of the CEQA lead agency's Notice of Determination (NOD). If you do not file a
copy of this determination with the County Clerk at the time of filing of the NOD, the
appropriate CEQA filing fee will be due and payable.
Without a valid No Effect Determination Form or proof of fee payment, the project will
not be operative, vested, or final and any local permits issued for the project will be
invalid, pursuant to Fish and Game Code Section 711.4(c)(3).
